HomeMy WebLinkAboutORD 3769 otQ CITY OF RENTON, WASHINGTON ORDINANCE NO. 3769 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON: 1) ADOPTING THE ANNUAL BUDGET FOR THE YEAR 1984; 2) AMENDING ORDINANCE NO. 3647 RE: CITY IMPOSED SALES OR USE TAX BY DELETING SUNSET DATE AND RE-ADOPTING THE SALES TAX WITH SPECIAL INITIATIVE; 3) CREATING A CAPITAL IMPROVEMENT FUND. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I: That the Annual Budget for the City of Renton for the year 1984, heretofore prepared and filed with the City Clerk, as modified and approved by vote of the City Council of the City of Renton on December 5, 1983, after due notice and hearing thereof as provided by law, be and the same is hereby in all respects ratified, adopted and confirmed as such Annual Budget for the year 1984, and same by this reference is incorporated herein as if fully set forth, and a complete and accurate copy of said budget being attached hereto, labeled Exhibit "A". Ordinance No. 3764 , adopted under the date of December 12, 1983, fixed the amount of tax levies necessary for the year 1984. SECTION IV: The City of Renton did by Ordinance No. 3647 adopted July 26, 1982, adopt a one-half of one percent sales or use tax on the selling price or value of the article used. The Ordinance specifically took effect October 21 , 1982 and was to expire December 31 , 1983. SECTION V: Removal of Expiration Date. The words "and expire 'December .31 , 1983" are hereby stricken from Ordinance No. 3647. -2- Y " CITY OF RENTON, WASHINGTON ORDINANCE NO. 3769 - Continued SECTION VI: Imposition of Sales - Use Tax. There is hereby imposed a sales or use tax, as the case may be, as authorized by RCW 82.14.030(2) , upon every taxable event, as defined in RCW 82.14.020 occurring within the City of Renton. The tax shall be imposed upon and collected from those persons from whom the state sales tax or use tax is collected pursuant to Chapters 82.08 and 82.12 RCW. SECTION VII: Rate of Tax Imposed: The rate of the tax imposed by Section VI of this ordinance shall be one-half of one percent of the selling price or value of the article used, as the case may be; PROVIDED, HOWEVER, that during such period as there is in effect a sales tax or use tax imposed by King County under Section 17(2), Chapter 49, Laws of 1982, First Extraordinary Session at a rate equal to or greater than the rate imposed by this section, the County shall receive fifteen percent of the tax imposed by Section VI; .PROVIDED FURTHER That during such period as there is in effect a sales tax or use tax imposed by King County under Section 17(2), Chapter 49, Laws of 1982, First Extraordinary Session at a rate which is less than the rate imposed by this section, the County ; shall receive from the tax imposed by Section VI that amount of revenues equal to fifteen percent of the rate of the tax imposed by the County under Section 17(2), Chapter 49, Laws of 1982, First Extraordinary Session. SECTION VIII : Sections VI and VII of this Ordinance shall be subject to a Special Initiative. The number of registered voters needed to sign a petition for Special Initiative shall be fifteen percent of the total number of names of persons listed as registered voters within the City on the day of the last preceding municipal general election. If a Special Initiative Petition is filed with the City Council , the operation of this Ordinance shall not be suspended pending a final decision on the disposition of the Special Initiative. -3- CITY OF RENTON, WASHINGTON ORDINANCE NO. 3769 - Continued SECTION IX: There is hereby established and created a new fund to be known as the "Capital Improvement Fund". Said fund is created for the purpose of accounting for capital improvements that may be undertaken by the City of Renton. Appropriations into said fund shall be from any City revenue source not otherwise prohibited from said use and any applicable federal , state or local funding sources. SECTION X: This Ordinance shall be effective upon its passage, approval and five days after publication. PASSED BY THE CITY COUNCIL this 19th day of December, 1983. Maxine E.
