HomeMy WebLinkAboutORD 3782 CITY OF RENTON , WASHINGTON ORDINANCE NO . 3782 AN ORDINANCE OF THE CITY OF RENTON , WASHINGTON REPEALING AND RE-ENACTING THE PROVISIONS OF CHAPTER 8 , TITLE V (BUSINESS REGULATIONS) OF ORDINANCE NO. 1628 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON" RELATING TO OVER-SIZE LOAD REGULATIONS . THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON DO ORDAIN AS FOLLOWS : SECTION 1 : Existing Chapter 8 of Title V (Business Regulations) of Ordinance No. 1628 entitled "Code of General Ordinances of the City of Renton, is hereby repealed and re-enacted as Chapter 33, Title VI (Police Regulations) , as follows : CHAPTER 33 OVER-SIZE LOADS 6-3301 Definition : For the purpose of this Chapter , the term "over-sized load" shall mean a housing structure of any type or description, or any other structure , load or motor vehicle with a height , width or length exceeding the limitations set forth in RCW Chapter 46 . 44 . 6-3302 Permit Required: It shall be unlawful for any person to engage in any moving, transportation of, removing or hauling of an over-size load over , across or upon any public street , alley, roadway or public place without first having obtained and being the owner and holder of a valid permit therefor to be known as an "over-size load moving permit'! . The fee for such permit is hereby fixed in the sum of $ 10 . 00 . The permit shall be posted and conspicuously displayed on the over-size load , or carried on the person of the party in charge of such moving and said permit shall be displayed at the request of any duly authorized official of the City. 6-3303 Application For Permit : Any person desiring a "over-size load permit" shall make written application therefor to the Department of Public Works upon a form to be furnished for said purpose , at least three ( 3) days prior to such moving . Such - 1 - application shall state , among others , the name and residence address of the person for whom a permit is sought , the date of intended moving, the exact route to be taken , the size and weight of the over-size load , and the escort service to be furnished , if any. A copy of such application shall thereupon be submitted to the Chief of Police and if the move originates or terminates within the City, to the Building and Zoning Department for approval . 6-3304 Liability Insurance And Bond Required : Every person applying for an "oversize load permit" shall , in addition to the requirements contained hereinabove , submit evidence of adequate liability and property damage insurance coverage which shall not be less than one hundred thousand dollars ( $100 , 000. 00) per person and three hundred thousand dollars ($300 ,000 .00 ) per accident , coverage of not less than fifty thousand dollars ($50 , 000 . 00) , which insurance coverage shall adequately protect the City against any loss to property or bodily. injury or other damages sustained or claimed by any person, or sustained or claimed by the City, arising out of the granting or use of this permit or any acts or omissions done or performed under or in connection with such activities . In addition to the foregoing insurance coverage , the applicant shall submit with his application a cash bond with a lawful corporate surety to be approved by the Department of Public Works in the amount of ten thousand dollars ($10 ,000 .00) , conditioned upon his compliance with all the provisions of this section and agreeing to pay and hold the City harmless from any claim which may be made against it by reason of the occupation of any street , alley , sidewalk or other public place by the over-size load, or by reason of any damage done to any person , or the City' s or other person' s. property . 6-3305 Additional Cost Reimbursement : (A) If the owner or holder of any such "over-size load permit" fails or neglects , in the sole judgment of the Department of Public Works or Chief of Police , to provide and furnish an adequate escort service for moving any over-size load within the City, he shall pay to and/or reimburse the City in advance for any such service rendered by the City while moving such over-size load within the City Limits . (B) If it shall be necessary to move or alter any traffic signals or utility structures , the holder of any "over-size load permit" shall pay to or reimburse the City or other effected utility company in advance for any such service rendered . SECTION 2: If any section , subsection, sentence , clause , phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction , such portion shall be deemed to be a separate , distinct and independent - 2 - { provision and such decision shall not affect the validity of the remaining portions of this Ordinance . SECTION 3: Existing Chapter 8 , Title V (Business Regulations) of the City Code is hereby repealed . SECTION 4: This Ordinance shall be in effect upon its passage , approval and thirty (30) days after publication. PASSED BY THE CITY COUNCIL on December 19th 1983 . Maxine E.
