ORDINANCE NO. 3789
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
AMENDING ORDINANCE NO . 3201 WHICH VACATES A
PORTION OF TALBOT ROAD SOUTH AND 100TH AVENUE
S .E . BY RELEASING A PORTION OF EASEMENTS
RETAINED BY THE CITY.

WHEREAS the City of Renton did vacate a portion of Talbot
qRoad South and 100th Avenue S.E. by. Ordinance No . 3201 adopted
March 13, 1978 , and
00 WHEREAS the City of Renton did retain an easement in favor
of the City described as follows :
Over , across , under and on all of the aforedescribed
property in favor of the City for utility and related
purposes .
and
WHEREAS the City of Renton has determined that the necessary
easements need not cover the entire parcel , NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN
AS FOLLOWS :
SECTION I : The easement in favor of the City of Renton
contained in Ordinance. No . 3201 is hereby modified to read as
follows :
See attached Exhibit "A" which is attached hereto
and made a part hereof as if fully set forth.
The reduction in the easement is also SUBJECT TO concurrent or
prior release by private utilities of easements affecting the
portion of the easement to be released by the City .
SECTION II : This Ordinance shall not be effective until
such concurrent or prior releases by the private utilities having
been properly recorded. Should they not be properly recorded,
this Ordinance is of no force and effect .

EXHIBIT "A"
An easement for utilities and related purposes over, under
and across that portion of vacated 100th Avenue S.E. accord-
ing to City of Renton Ordinance Number 3201 as recorded
under King County Auditor' s File Number 7803270679 being 60
feet wide and lying South of the North line of the South 125
feet of the City of Seattle's 200 foot Diablo Right-of-Way
as contained in instrument recorded under Auditor 's File
Number 3560496 AND North of Puget Drive Right-of-Way. '
EXCEPT the. North 35 feet thereof.
