This ordinance addresses the following matters : SECTION I . This ordinance modifies and establishes setbacks relating to the commercial and industrial zones : CS (Center Suburban) , CN (Center Neighborhood) , CC (Convenience Commercial) , CO (Commercial Office) , CA (Commercial Arterial) , IL (Light Industrial) and IM (Medium Industrial) . New setback requirements are added when the industrial or commercial zone abuts to or is adjacent to certain residential zones . This ordinance restricts parking of vehicles related to commercial uses on residential streets with modification provisions for that prohibition. The ordinance also provides a conditional use permit process for buildings in excess of the permissible height when SUMMARY OF ORDINANCE NO. 4 5 9 3 adjacent to certain single family zones, upon a showing of lack of substantial or undue adverse effects on adjacent property. This ordinance also provides special development requirements if the commercial or industrial development is adjacent to certain residential uses including such things as landscaping, location of loading docks, storage, repair and maintenance areas and the � location of garbage, refuse and dumpsters . THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS : SECTION I . Sections 4-31-10 . 2 .D.2 , 4-31-10 . 2 .D. 5, 4-31- 10 .2 .D. 7 and 4-31-10 .2 .E. 3 of Chapter 31, Zoning Code, of Title IV (Building Regulations) , of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" are hereby amended to read as follows : 4-31-10.2 .D.2 : Setbacks : Setbacks in the CS zone shall be required as follows : a. Front/Street Setback: (1) Minimum Setback: (a) A minimum setback of ten feet (10 ' ) is required. ' (b) The minimum setback may be reduced down to zero feet (0 ' ) through the site plan review process provided that blank walls are not located within the reduced setback. ORDINANCE N0. 4593 (2) Maximum Setback: On lots abutting more than one street, the maximum setback requirement shall only be applied to the primary street as determined by the Reviewing Official . For additions to existing structures, the maximum setback requirements ' shall only apply when the addition is subject to site plan review. (a) A maximum setback of fifteen feet (15' ) shall be required of the streetside facade of the structure. (b) The maximum setback may be modified by the Reviewing Official through the site plan review process if the applicant can demonstrate that the site plan meets the following criteria: (i) Orient development to accommodate the pedestrian and create a pedestrian environment through such measures as; providing pedestrian walkways, encouraging pedestrian amenities and supporting alternatives to Single Occupant Vehicle (SOV) transportation, and; � (ii) Create an attractive and interesting streetscape with a strong and defined streetfront through such measures as; promoting visible landmarks, fostering distinctive architecture, mitigating the visual dominance of extensive and unbroken parking along the streetfront and modifying building orientation to offset large setbacks (e.g. using varied setbacks, locating separate smaller buildings near the streetfront) , and; (iii) Promote safety and visibility through such measures as; discouraging the creation of hidden spaces, minimizing conflict between pedestrians and traffic and ensuring adequate setbacks to accommodate required parking and/or access that could not be provided otherwise. (c) The Reviewing Official may also modify the maximum setback requirement if the applicant can demonstrate that 2 � ORDINANCE N0. 4593 the preceding criteria cannot be met; however, those criteria which can be met shall be addressed in the site plan: (i) due to factors including but not limited to the unique site design requirements or physical site constraints such as sensitive areas or utility easements; or (ii) one or more of the criteria would not be furthered or would be impaired by compliance with the maximum setback; or ! (iii) any function of the use which serves the public health, safety or welfare would be materially impaired by the required setback. b. Rear and Side/Interior Setbacks : None shall be required except as listed in Special Requirements provisions below in Section 2 . c . c . Special Requirements : If a CS lot abuts or is � adjacent to a lot Zoned R-1, R-5, R-8, R-10, R-24 or RM-I, then there shall be a fifteen foot (15 ' ) setback subject to the landscaping provisions in Section 7 . c . (1) or 7 . c. (2) . �I 4-31-10 .2 .D.5 : Parking: Parking of vehicles related to the commercial uses shall not be allowed on residential streets . See Chapter 14 of Title IV of the Renton City Code . ' 4-31-10.2 .D.7 : Landscaping/Improvements : a. Street Frontage : Lots abutting public streets shall have a minimum landscaping strip of ten feet (10 ' ) , except where reduced through the site plan review process . b. Pedestrian Connection: A pedestrian connection shall be provided from a public entrance to the street unless the Reviewing Official determines that the requirement would unduly endanger the pedestrian. 3 � ORDINANCE NO. 4593 c . Special Requirements : (1) If the CS lot is adjacent to a lot zoned R-1, R-5, R-8, R-10, R-24 or RM-I, then there shall be a minimum fifteen foot (15 ' ) sight obscuring landscaped strip. The Hearing Examiner may modify the sight obscuring provision in order to provide reasonable access to the property. If the street is designated arterial in the Transportation Element of the City Comprehensive Plan, non-sight obscuring landscaping shall be provided unless otherwise determined by the Hearing Examiner. These provisions may be modified by the Hearing Examiner where the applicant can show that the same or better results will occur because of creative design solutions, unique aspects or use, etc . , that cannot be fully anticipated at this time. (2) If the CS lot abuts a lot zoned R-1, R-5 , R-8, R-10, R-24 or RM-I, then there shall be a fifteen foot (15 ' ) sight obscuring landscaped strip. A ten foot (10 ' ) sight obscuring � landscaping strip may be allowed through the Site Plan process ! provided that a solid six foot (6 ' ) high barrier wall is provided within the landscaped strip and a maintenance agreement or easement for the landscape strip is secured. A solid barrier wall shall not � be located closer than five feet (5 ' ) to an abutting lot zoned R-1, � R-5, R-8, R-10, R-24 or RM-I . These provisions may be modified by the Hearing Examiner where the applicant can show that the same or better results will occur because of creative design solutions, unique aspects or use, etc. that cannot be fully anticipated at this time. (3) If the CS lot abuts or is adjacent to a lot zoned R-1, R-S, R-8 , R-10, R-24 or RM-I, then all outdoor storage, 4 ORDINANCE N0. 4593 repair, maintenance or work areas shall be screened by a sight obscuring fence or landscaping or some combination thereof as determined by the Reviewing Official . Loading docks shall not be located adjacent to or abutting a lot zoned R-1, R-5, R-8, R-10 R- 24 or RM-I . These provisions may be modified by the Hearing Examiner where the applicant can show that the same or better results will occur because of creative design solutions, unique aspects or use, etc. that cannot be fully anticipated at this time . (4) Garbage, refuse or dumpster areas shall not be located within fifty feet (50 ' ) of a lot zoned R-1, R-5 , R-8, R-10, R-24 or RM-I except by approval of the Hearing Examiner. In no case shall the garbage, refuse or dumpster area be located within the required setback. 4-31-10 .2 .E.3 : Effect on Adjacent Properties : Buildings in excess of fifty (50 ' ) in height shall not result in substantial or undue adverse effects on adjacent property. When a building in excess of fifty feet (50 ' ) in height is proposed adjacent to or abuts a lot zoned R-1, R-5, R-8, R-10, R-24 or RM-I, then setbacks shall be equivalent to the requirements of the adjacent residential zone if the setback standards exceed the requirements of the CS Zone. � SECTION II . Section 4-31-10 .2 .D. 15 of Chapter 31, Zoning Code, of Title IV (Building Regulations) , of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" is hereby rescinded. SECTION III . Sections 4-31-10 .3 .D. 2 , 4-31-10 .3 .D. 5 , 4-31- 10 .3 .D. 7 and 4-31-10 . 3 .E.3 of Chapter 31, Zoning Code, of Title IV (Building Regulations) , of Ordinance No. 4260 entitled "Code of 5 ORDINANCE N0. 4593 General Ordinances of the City of Renton, Washington" are hereby amended to read as follows : 4-31-10 .3 .D.2 : Setbacks : Setbacks in the CN zone shall be required as follows : a. When a building in excess of thirty five feet (35 ' ) in height is proposed adjacent to or abuts a lot zoned R-1, R-5, R-8, R-10, R-24 or RM-I , then setbacks shall be equivalent to the requirements of the 9 ORDINANCE N0. 4593 adjacent residential zone if the setback standards exceed the requirements of the CN Zone . SECTION IV. Sections 4-31-10 .4 .D. 1, 4-31-10 .4 .D.4, 4-31- 10 .4 .D. 6 and 4-31-10 .4 .E . 3 of Chapter 31, Zoning Code, of Title IV (Building Regulations) , of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" are hereby amended to read as follows : 4-31-10 .4 .D.1: Setbacks : Setbacks in the CA zone shall be required as follows : a. Section 4-31-10 .4 .D. 12 of Chapter 31, Zoning Code, of Title IV (Building Regulations) , of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" is hereby rescinded. SECTION VI. Sections 4-31-10 .5 .D. 2 , 4-31-10 . 5 .D. 5 and 4-31- 10 .5 .D. 7 of Chapter 31, Zoning Code, of Title IV (Building 12 ORDINANCE N0. 4593 Regulations) , of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" are hereby amended to read as follows : 4-31-10 .5 .D.2 : Setbacks : Setbacks in the CC zone shall be required as follows : , a. Front/Street Setback: (1) Minimum Setback: (a) A minimum setback of ten feet (10 ' ) is required. (b) The minimum setback may be reduced down to zero feet (0 ' ) through the site plan review process provided that blank walls are not located within the reduced setback. Pedestrian Connection: A pedestrian connection shall be provided from a public entrance to the street unless the Reviewing Official determines that the requirement would unduly endanger the pedestrian. c. Special Requirements : (1) If the CC lot is adjacent to a lot zoned R-1, R-5, R-8, R-10, R-24 or RM-I, then there shall be a minimum fifteen i, foot (15 ' ) sight obscuring landscaped strip. The Hearing Examiner may modify the sight obscuring provision in order to provide reasonable access to the property. These provisions may be modified by the Hearing Examiner where the applicant can show that the same or better I results will occur because of creative design solutions, unique aspects or use, etc . that cannot be fully anticipated at this time . (4) Garbage, refuse or dumpster areas shall not be located within fifty feet (50 ' ) of a lot zoned R-1, R-5, R-8, R-10, R-24 or RM-I except by approval of the Hearing Examiner. In no case shall the garbage, refuse or dumpster area be located within the required setback. SECTION VII. Sections 4-31-11 . 1 .D. 1 and 4-31-11 . 1 .D. 6 of Chapter 31, Zoning Code, of Title IV (Building Regulations) , of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" are hereby amended to read as follows : 16 ORDINANCE N0. 4593 4-31-11.1.D.1: Setbacks : a. On lots abutting more than one street, the maximum setback requirement shall only be applied to the primary street as determined by the Reviewing Official . b.
