HomeMy WebLinkAboutORD 4488 CITY OF RENTON, WASHINGTON ORDINANCE N0. 4488 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY AND PROPERTY RIGHTS BY EMINENT DOMAIN AND PROVIDING FOR THE PAYMENT THEREOF; AUTHORIZING THE CITY ATTORNEY TO PREPARE A PETITION FOR CONDEMNATION IN THE SUPERIOR COURT IN AND FOR THE COUNTY OF KING AND FOR THE PROSECUTION THEREOF FOR THE ACQUISITION OF SUCS PROPERTY AND PROPERTY RIGHTS FOR THE PURPOSE OF DEVELOPING THIS SITE FOR ACTIVE AND PASSIVE RECREATIONAL USES INCLUDING THE DEVELOPMENT OF PLAYFIELDS. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN 'i AS FOLLOWS: I SECTION I. The City Council finds that the property which is des.cribed on Exhibit "A" was previously acquired from King County by the City of Renton for development of passive and active recreational .us�es, including athletic fields . The legal description to this property is imcorporated herein as if fully set forth. The title to this property is clouded by claims of various parties that they have an interest in this property through adverse possession. To the extent that the removal of these clouds on the title require acquisition of property, the City Council finds acquisition of that property and/or those property rights is necessary for a public purpose and use, i.e. active and passive recreational uses including the development of playfields . The City of Renton is authorized by the laws and statutes of the state of Washington to appropriate i lands and property rights through the exercise of its rights of eminent domain within its corporate limits necessary for the above- stated purpose. ORDINANCE N0. 4488 SECTION II. The Cit Attorne is hereb authorized and Y Y Y directed to commence condemnation proceedings against the owners and all other parties in interest in the above described lands and improvements, if any, as provided by law; to prepare the necessary petition for condemnation, and commence and prosecute such action in the Superior Court in and for the County of King against all the owners and interested parties in the hereinabove described property; ' and to acquire the aforedescribed property and property rights for ' the City of Renton. Such proceedings shall be to determine the just compensation for the appropriation of such property and property rights by the City of Renton. SECTION III. Compensation for the acquisition of said �property and �property r.ights shall be from the City of Renton' s Federal, State and. Local Grant Match Money Account, Account No. 594- 766112 . SECTION IV. Nothing in this Ordinance shall be construed as a waiver by the City of Renton of its right to decline to take and pay for said property and property rights after the amount of just compensation has been ascertained, and within the time allowed by law. SECTION V. This Ordinance shall be effective upon its passage, approval, and five days after its publication.
