"431�3 � ���=�F� �'n�j-� �..:H��.�.�1.... :{::i::d��.:'a i„'11,,,1 CCf AN ORDINANCE OF THE CITY OF RENTON, WASfiINGTON, AMENDING ORDYNANCE NO. 3856 ADOPTED BY THE CITY COUNCIL OCTOBER 22, 1984, AS AMENDED BY ORDINANCE NO. 4074 ADOPTED BY THE CITY COUI�TCIL ON JUNE 15, 1987, AS AMENDED BY ORDINANCE 1�0. 4180 ADOPTED BY THE CITY COUNCIL ON OCTOBER 10, 1988, BY EXPANDING THE IMPROVEMENTS AUTHORIZED IN THOSE ORDINANCES AND INCLUDING THOSE IMPROVEMENTS W�THIN THOSE PERMITTED UNDER LID NO. 329. WHEREAS, by Ordinance No. 3856, adopted by the City Council on October 22, 1984, as amended by Ordinance No. 4074, adopted by the City Council on June 15, 1987, as amended by Ordinance No. 4180, adopted by the City Council on October 10, 1988, the City Council � �� ordered construction of curbs and gutters, sidewalks, street G� � lighting, signals, utility adjustments, storm drains, and all � necessary appurtenances thereto on S. 43rd from Talbot Road S. to SR � � 167; and � WHEREAS, the owners of all property included within LID No. 329 have requested the City Council to add certain improvements to LID No. 329 and allow the elimination of certain other improvements; and :_--_= WHEREAS, the City Council believes that requested changes are _—�, i=n^��'he ublic int p erest and in the best interests of the ro ert ,': P P Y own:ers. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, , ' WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. Section I of Ordinance No. 3856, as amended, is amended to read as follows : � SECTION I . The City Council orders the construction of tr.e following improvements in the vicinity of S. 43rd Street from Talbot 1 _ , � •, � . � , . � . . � I � ORDINANCE NO. 4313 I Road S. to SR 167, Renton, King County, Washington, more particularly described in Exhibit "A" attached hereto and made a part hereof as if fully set forth herein. There shall be included in the foregoing the acquisition and installation of all necessary pipes, manholes, valves, fittings, couplings, connection equipment and appurtenances, together with the acquisition of any easements, rights-of-way and land that may be required; and there shall be included the performance of such work as may be incidental and necessary to the foregoing construction and installation. The City Council may modify the details of the foregoing I described improvement where, in its judgment, it appears advisable, provided such modifications do not substantially alter the plan of � � said improvement. Al1 of the foregoing shall be in accordance with I `� the plans and specifications therefor to be prepared by the Director '� � of Public Works . � SECTION II. Section III of Ordinance No. 3856, as amended, � is amended to read as follows: SECTION III . The estimated cost and expense of said improvement is hereby declared to be approximately $3,200, 000 . 00 . � The entire cost and expense of said improvement, including the cost and expense of all engineering, legal, inspection, advertising, publication of notices and other expenses incidental thereto, shall be borne by and assessed against the property specially benefited by such improvement included in the Local Improvement District No. 329 � established, embracing, as near as may be, all property benefitted by such improvement. 2 I � ORDINANCE NO. 4.313 SECTION III. Section IV of Ordinance No. 3856, as amended, is amended to read as follows : SECTION IV. The nature of the improvements detailed herein is such that the s ecial benefits conferred u on the ro ert owner P P P P Y will be fairly reflected by lump sum assessment. SECTION IV. Except to the extent modified by this ordinance, Ordinance No. 3856, as amended by Ordinances No. 4074 and No. 4180, shall remain in full force and effect. SECTiON V. This Ordinance shall be effective upon its passage, approval, and five days after its publication.
