HomeMy WebLinkAboutORD 4266 Amends Ordinance No . 3635 ' Amended By ORD 4723 CITY OF RENTON, WASHINGTON �ended by Ord 4860, 5000 , ORDINANCE NO. 4266 I AAT ORDINANCE OF THE CITY OF RENTON, WASIiINGTON, AMENDING CHAPTER 14, VACATIONS, OF TITLE I3t (PUBLIC WAYS AND PROPERTY) OF ORDINANCE NO. 4260 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON" BY AMENDING SUBSECTION , 9-14-2B, SECTION 9-14-4, AND SUBSECTIONS 9-14-5A, B, C, D, AND E THEREOF CONCERNING OBTAINING APPRAISALS FOR STREET VACATIONS, REPEALING SECTION 9-14-6, AND ADDING SECTION 9- 14-10 RELATING TO APPRAISAL FEES. THE CITY COUNCIL OF THE CITY OF RENTON, Wi�SHINGTON, DO O�tDAIN AS FOLLOWS: SECTION I. Subsection B of Section 9-14-� of Chapter 14, Vacations, of Title IX (Public ways and Property) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton" is hereby amended to read as follows : Section 9-14-2B: Upon the filing of the petition with the City Clerk, the petitioning owners shall simultaneously pay a street vacatiori filing fee in the amount of $250 . 00, as specified in the fee schedule ordinance. to compensate the City for administrative cost and expense in processing, checking, and handling such application, whicYi fee shall likew.ise include the publication and posting expense of ar�y nntice p�rtaining to the va�ation. SECT.ION II. ��ection 9-14-4 of Chapter 14, Vac�tions, of Title IX (Public Ways a�d Pro.perty) of Ordinance No. 4260 entitled "Cocie of General OrdinanCes of the City of Renton" is hereby amended to read as follows: Section 9-14-4: �treet, A11ey Right-of-Way: For the purposes of this Ortiinance, all st�eets a�d alleys within the City of Renton, whether acquir�d by plat, grant, dedicat.ion, gift, 1 ORDINANCE NO. 4266 acquisition or condemnation are subject to the provisions of this i Ordinance. SECTION III. Subsections A, B, and C of Section 9-14-5 of ' Chapter 14, Vacations, of Title IX {Public Ways and Property) of Ordinance No. 4260 entitled "Code of General Ordinances of the City � of Renton" are hereby amended to read as follows : Section 9-14-5A: The applicant shall pay a street vacation , processing fee in the amount of $250 . 00 as set forth in the fee I schedule ordinance to defray the remaining administrative costs of processing and completing the proposed vacation. Section 9-14-5B: The City shall receive compensation in accordance with RCW 35 . 79 . 030, which amount for the purpose of this chapter is to be determined by an appraisal; provided that the City Council shall have the authority, upon recommendation of the Administration, to accept real property or a property right in lieu ' of a part or all of the cash compensation that would be paid. When '� the value of the property or property right is less than the cash compensation required for the alley or street right-of-way to be vacated, the petitioner shall pay the difference to the City. When the value of the property or property right exceeds the value of the alley or street right-of-way to be vacated, the City shall pay the difference to the petitioner. Section 9-14-5C: Following a recommendation for vacation after a public hearing, by the City Council or committee thereof, the Director of Public works shall obtain an appraisal of the street ' or alley rights-of-way recommended for vacation. The appraisal � shall be from a qualified independent appraiser and the appraisal � 2 ' ORDINANCE NO. 4266 shall be in writing, with the results thereof to be furnished unto the Director of Public Works for evaluation and approval . The Director of Public Works shall further obtain appraisals of the fair market value of property or property rights to be given to the City in lieu of cash compensation as contemplated in section 9-14-5(B) . SECTION IV. Subsection D of Section 9-14-5 of Chapter 14, Vacations, of Title IX (Public Ways and Property} of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton" is hereby deleted. SECTION V. Subsection E of Section 9-14-5 of Chapter 14, Vacations, of Title IX (Public Ways and Property) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton" is hereby amended to read as follows : Section 9-14-5E: When a street or alley is vacated for a governmental agency, and compensation is required, compensation shall be based upon the administrative costs of the vacation and may, at the discretion of the City Council, be based upon original cost to the City of acquisition. No governmental agency is exempt from compensating the City for the vacation of a street or alley i right-of-way. SECTION VI. Section 9-14-6 of Chapter 14, Vacations, of i Title IX (Public Ways and Property) of Ordinance 4260 entitled "Code of General Ordinances of the City of Renton" is hereby repealed. ' SECTION VII. There is hereby added a section to Chapter 14, Vacations, of Title IX (Public Ways and Property) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" to read as follows : 3 ORDINANCE NO. 4266 Section. 9-14-10: Appraisal Fees: Petitioner shall pay the actual cost for preparation of the appraisal report. At the time the City Council, or a committee thereof, recommends granting the vacation, the petitioner shall deposit with the Director of Public Works an additional fee of six hundred dollars ( $600.00) for appraisal of the subject vacation. In the instance when property is to be granted or dedicated by petitioner, an additional $600 .00 shall be deposited for the appraisal of said property. In the event the appraisal cost is less than the deposit, the difference shall be deducted from the vacation compensation payable to the City; and, when the appraisal cost exceeds the deposit, the difference shall be added to the vacation compensation payable to the City. The appraisal fees are in addition to the filing fee and the processing fee. � SECTION VIII. This ordinance shall be effective upon its passage, approval, and thirty days after publication.
