The letter also proposes an agreement between you and the City of Renton regarding a means of resolving this problem. If you agree to the provisions of this proposal,please execute and return this agreement to the undersigned. We will then move forward with corrective actions. Background: The City of Renton's Heritage Park and the Leisure Estates Manufactured Housing Community share a common border near the southwest corner of the City Park. A natural depression and drainage way exists between the two adjacent properties that conveys runoff water from rain events from the Heritage Park property to the Leisure Estates property. There are two Leisure Estates manufactured housing units on the east side of Cedar Drive that are in the location of this natural drainage course. At some time in the past an unknown party installed without City permit a rough inlet structure and plastic pipe from the Heritage Park property on the east side of the fence that separates Leisure Estates from Heritage Park. This pipe is partially buried, and conveys drainage from Heritage Park between the subject housing units, where it daylights adjacent to Cedar Drive. The purpose of the pipe is to convey drainage along the natural drainage course from Heritage Park to Cedar Drive, where it flows across the street and enters an existing catch basin. This catch basin and piping conveys the flow through the Leisure Estates private drainage system,which consists of a series of drainage swales and culverts. The flow is carried to a drainage channel west of Leisure Estates. This drainage channel carries flow to Maplewood Creek. The City of Renton is in the process of developing Heritage Park into a recreational facility. This project involves some grading work and removal of trees, and installation of walking paths. Statement of Issue: The Puget Sound region experienced the rainiest November on record in November 2006. This included a storm event very close to the 100-year storm event(storm expected to happen once every hundred years) in magnitude of rainfall. As a result of this record rainfall, localized flooding occurred in many places in the Puget Sound Region and in Renton. Proposal: Although the City believes that it shares no fault in the flooding that was experienced at Leisure Estates,we are of the opinion that it would be to our common benefit to work to resolve the problem and to forestall claims or litigation now or in the future. This system will consist of an inlet, and a system of culverts and drain pipes and/or swales that will carry runoff from Heritage Park to a suitable portion of the Leisure Estates private drainage system. The installation will be mutually acceptable to Renton and the Leisure Estates Management. Leisure Estates Management will provide needed temporary construction easements or right of entry documentation for Renton to install the improvements within Leisure Estates property. The duration of the right of entry will not be more than six(6)months. 2) Leisure Estates Management will accept maintenance responsibilities for the new drainage system located on Leisure Estates property upon its completion. 3) During the investigation of the flooding event, it was discovered that catch basins and drain lines within Leisure Estates are partially filled with silt and need to be cleaned. Leisure Estates Management commits to cleaning out the system at this time and implementing a routine maintenance program that will be sufficient to prevent the build up of silt in the existing drainage system. 4) The costs for constructing this improvement that are borne by Renton will not be passed along as extra costs to Leisure Estates residents. 5) Leisure Estates Management will not file any claims or lawsuits against the City due to any damages that may have been experienced due to the subject flooding events. 6) Leisure Estates Management agrees, upon their approval of the new drain system and the installation of the system by Renton to waive any future drainage claims regarding runoff from Heritage Park.
