E. and lO1F@�. AVENUE S.E. , LAKE WASHINGTON BLVD. AND AREAS ADJOINING TH�RETO , ALL IN ACCORDANCE WITH CITY OF REN.TON .RESOLUTION N0. 1614; ESTABLTSHING LOCAL IMPROVEMENT DISTRICT N0. 265 , ALL SITUATED IN , THE CORPORAT� " LIMITS OF THE CITY OF RENTON; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT; PROVIDING THAT PAYMENT FOR SAID IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTSUPON PROPERTY IN SAID DISTRICT, PAYABLE BY MODE OF "PAYMENT BY BONDS" OR "NOTES" IN LIEU THEREOF AS DETERMINED BY THE CITY COUNCIL; AND PROVIDING FOR THE SALE AND ISSUANCE OF LOCAL IMPROVEMENT DISTRICT WARRANTS ' REDEEMABLE IN CASH AND. LOCAL IMPROVEMENT DISTRICT BONDS OR NOTES. , WHEREAS by. Resolution No. 1614 adopted March 24, 1969 , the City Council of the City of Renton declared its intention to cons�hruct and install certain sanitary sewer lines , together with appurtenances thereto, within certain territory in the Kennydale area of the City of Renton as hereinafter more part.i.cularly described�, �which Resolution was passed and approved in support of a certain Pet-ition filed with the City of Renton on or about March 3 , 1969 , requesting the creation of a Local Improvement District, and WHEREAS the City Council fixed June 2 , 1969 in the City Council Chambers in the City Hall, Reriton, Washington, as the time and place for hearing all matters relating to said proposed improvements and all objections thereto and for determining the method of payment for said improvements ; and WHEREAS Jack Wilson, City. Engineer, has caused an estimate to be made of the cost and expense of the prnposed improvements and, has certified $aid estimate. to the City Council, together with all pape�s , data and information in his possession relating to the proposed improvement, description of the boundaries of the Distr.ict , a statement in detail of i the Local Improvement assessments outstanding or unpaid against the property within the proposed District and a statement of the aggregate � actual valuation of the real estate, including twenty five per cent ( 25%) -1- L � , , • . � � ' , • . . of the actual valuation of the improvements in the proposed District, according to the valuation last placed upon it for the purpose of general taxation; and WHEREAS said estimates are accompanied by a diagram of the proposed improvemerits showing thereon the lots , tracts , parcels of land, and other property which will be specially benefited by the proposed improvement, and the estimated amount of the cost and expense thereof to be borne by each lot, tr.act and parcel of land or other property within said District; and > � .. . : . WHEREAS due notice of the hearing upon said Resolution No. 1614 was given in the manner provided by law, and said hearing was duly held by the City Conncil at its regular meeting on June 2 , 1969 at the hour of 8 : 00 P.M. , and the following written protesl� having been received at said hearing, to-wit: See Exhibit "A" and said total protests as of th.e .date of said hearing amount to approxi- mately 14,3 0 of the total cost of the proposed improvement; and at WHEREAS/said hearing the City Council has given due consideration to the special benefits: to be received �rom such proposed improvement .by all of the properties: to. be included within the proposed local improvemerit distr.ict; and WHEREAS the City. Council deems it in the best interest of the City and of the owners of the property within the proposed Local Im�rovement District that said improvemerit as hereinafter described be carried out, and that a Local Improvement District .be a�ated in connection therewith; NOW THEREFORE �� -2- BE fT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE C►TY OF RENTON, WASHINGTON, AS FOLLOWS : SECTION I : The following sanitary sewer lines, including trunk lines, shall be constructed and installed in the Kennydale area located inside the corporate limits of the City of Renton, Washington, as follows, to-wit: �pp rox. The City Council may modify the details of the foregoing described improve- ments where, in its judgment, it appears advisable, provided such modifications do not substantial (y alter the plan of said improvement. Ail -4- of the foregoing shall be in accordance with the plans and specifications . therefor to be prepared by and through the City� s Engineering Department. SECTION II: There is hereby established and created a Local Improvement Distr.ict to be called "Local Improvement Distr.ict No. 265 of the City of Renton, Washington" , theboundaries- of such Local Improvement District being described as follows : All that portion of the North'wes�t - 1/4 of Sectinn 5 , Township 23 North, Range 5 East, W.M. , deseribed as follows : Beginning at a point on the notth line of the Northwest 1/4 of Sectinn 5' , Township. 23 N. , Range 5 East, W.M. 330 _feet easterly of the northwest corner thereof; thence easterly along said northerly line a distance of 1, 719 feet , more or less, to an intersection with the .Westerly margin of F.A.I . Highway No. 405 ; thence 5o.ti$ierly along said westerly highway margin a �stance of 1,350 feet, more or less, to an intersectinn with the southerly margin of Southeast lO.Oth Street; thence westerly along said southerly margin a distance of 25 feet; thence continuing southerly along the westerly margin of F.A. I . 405 a distance of 554 feet, more or less to an intersection with the south line of Tract 334, C.D. SECTION :IV: The nature of the improvement provided for herein is such that the special benefits conferred upon the property are fairly reflected by the use of the statutory termini and zone method of assessment � and it is hereby provided and ordered that th.e assessment shall be made against the property of the District in accordance with said method. All proper.ty included within thelimits of the Local Improvement Distri�t above created shall be considered to be the property specially benefitted by such Local Improvement and shall be the property to be assessed to pay th.e cost and expense thereof as hereinab.ove specified. SECTION V'.' Local Improvement Distr-ict warrants shall be issued in payment of the cost and expense of the improvement herein ordered. Such warrants shall be payable out of said"Local Improvement Fund, District No. 265" to bear interest from the date thereof at a rate to be fixed hereafter but not to. exceed 8o per annum and to be redeemed in cash, and/or by Local Improvement Distr.ict bonds herein auth.orized to be issued, said interest-bearing warrants to be hereafter referred to as "revenue warrants" . Such bonds shall bear interest at a rate to be hereafter fixed but not exceeding 8o per annum; shall be payable on or before t.we.lve years �rom the date of issuance,: th.e life of the improvement ordered being not less than twel.ve (12) years , and shall be issued in exchange for and in redemption of any and all revenue warrants issued her.eunder and not redeemed ' in cash within a period not to exceed sixty daysafter the first publication � by the City Treasurer of notice that the assessment roll for Local Improvement District No. 265 is in his hands for collection. In case of def.au.lt i.n the payment of any as.sessment, when the same shall become .due, there shall be added inte.res� at .a rate to be. hereafter fixed but not ta_ exceed 8o per annum, and a penalty o� 8Q which shall also be. callected. SECTION VIII : The City Engineer is hereby authorized and directed to call for bids , in the ma�iner provided by law, for the constr.uction and installation of the impr.ovements authorize.d herein. SECTION IX: The City reserves the right .to issue, in lieu of bonds and warrants in payment of the cost and expense of the aforesaid Local Improvement District installment note or notes payable out of the Local Improvement Di.st�'.ict .Fund whenever s.uch note or notes are sold exclusively to another fund of the City as an investment .thereof, and as furth.er pr.ovided by law. Such installment note or notes may be issued any time after a thirty ( 30) day per�d allowed by law for the payment of assessments of said District without penalty or interest, and .such note or notes may be oi any denominati.on or denominati.ons, the aggregate of wh.ich shall represent .the balance of the cos� and expense of the Local Improvement District which is to be borne by. the property owner.s therein, and as further provided by law.
