ORDINANCE N0. ���� r AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ORDERING THE CONSTRUCTION AND INSTALLATION OF CERTAIN SANITARY SEWER LINES AND APPURTENANCES THERETO IN THE VICINITY OF THE MANCE ADDITION (94th Ave. S . � S . 174tYi St. ) RENTON, G�ASHINGTON, AND AREAS ADJOINING THERETO , ALL IN ACCORDANCE WITH CITY OF RENTON RESOLUTION N0. 1632 ; ESTAB- LISHING LOCAL IMPROVEMENT DISTRICT N0. 264 , ALL SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF RENTON; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT; PROVIDING THAT PAYMENT FOR SAID IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTS UPON PROPERTY IN SAID DISTRICT, PAYABLE BY MODE OF "PAYMENT BY BONDS" OR "NOTES" IN LIEU THEREOF AS DETERMINED BY THE CITY COUNCIL; AND PROVIDING FOR THE SALE AND ISSUANCE OF LOCAL IMPROVEMENT DISTRICT WARRANTS REDEEMABLE IN CASH' AND LOCAL IMPROVEMENT DISTRICT BONDS OR NOTES . WHEREAS by Resolution No. 1632 adopted June 23 , 1969 , the City Council of the City of Renton declared its intention to construct .and install certain sanitary sewer lines, together with appurtenances thereto , within certain territory in the Mance Addition of the City of Renton as herelnafter more particularly described, which Resolution was passed and approved in support of a certain Petition filed with the City of Renton on or about January 17 , 1969 , requesting the creation of a Local Improvement District, and WHEREAS the City Council fixed July 28 , 1969 in the City Council Chambers in the City Hall, Renton, Washington, as the time and place for hearing all matters relating to said proposed improvements and all objections thereto and for determining the method of payment for said improvements ; and WHEREAS Jack Wilson, City Engineer has caused an estimate to be made of the cost and expense of the proposed improve- ments and has certified said estimate to the City Council, together , with all papers , data and information in his possession relating to the proposed improvement , description of the boundaries of the District , a statement in detail of the Local Improvement assessments outstanding or unpaid against the property within the proposed District and a statement of the aggregate actual valuation of the real estate , including twenty five per cent (250) of the actual valuation of the improvements in the proposed District , according -1- , _ , , • � , . to the valuation last placed upon it for the purpose of general taxation; and WHEREAS said estimates are accompanied by a diagram of the proposed improvements showing thereon the lots , tracts , parcels of land, and other property which will be specially benefited by the proposed improvemerit, and the estimated amount of the costs and expense thereof to be borne by each lot , tract and parcel of land or other property within said District ; and WHEREAS due notice of the hearing upon said Resolution No. 1632 was given in the manner provided by law, and said hearing was duly held by the City Council at its regular meeting on July 28 , 1969 at the hour of 8 : 00 P.M. , and thereafter duly continued to the regular meeting of the City Council on August 11, 1969 and the following written protests having been received at said hearing, to-wit: Mr. Howard Harding, 409 S. 36th Street, owner of Tax Lot 45 in Section 30, Township 23 North, Range 5 East, W.M. ; and Mr. Oliver Wakelam, 10056 Southeast 190th Street, owner of Tax Lot 37 in Section 30, Township 23 North, Range 5 East, W.M. � .n.=- _ �� and said total protest as of the date of said hearing amounting � to approximately 7 . 110 of the total cost of the proposed improvements ; and WHEREAS at said hearing the City Council has given due • consideration to the special benefits to be received from such proposed improvement by all of the properties to be included within the proposed local improvement district ; and WHEREAS the City Coun�il deems it in the best interest of the City and of the owners of the property within the proposed Local Improvement District that said improvement as hereinafter described be carried out , and that a L,ocal Improvement District be -2- ' r • created in connection therewith ; NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, AS FOLLOWS : �SE"CTION l: The following sanitary sewer lines, including trunk lines , shall be constructed and installed in tYae Mance Addition, as hereinafter more particularly described, and located inside the corporate limits of the City of Renton , Washin,�ton, as follows , to-wit: Approx. Lot 9 Street and there shall be included in the foregoing the acquisition and installation of all necessary pipes , manholes , valves , fittings , couplings , connection equipment and appurtenances , together with the acquisition of any easements , rights of way and land that may be required; and there shall be included the performance of such work as may be inciderital and necessary to the foregoing construction and installation. The City Council may modify the details of the foregoing described improverrients where , in its judgment , it appears advisable , provided such modifications do not substantially alter the plan of said improvement. All of the foregoing shall be in accordance with the plans and specifications thereafter to be prepared by and through the City' s Engineering Department. -3- � . • • ' • � � SECTION II : There is hereby established and created a Local Improvement District to be called "Local Improvement District No. 264 of the City of Renton, Washington" , the boundaries of such Local Improvemerit District being described as follows : All that portion of the Southeast One-Quarter of Section 30 , Towriship 23 North, Range 5 East , W.M. and of the Mance Addition, according to the Plat recorded in Volume 68 of Plats , Page 21 , records I of King County, Washington described as follows : j Beginning at the southwesterly corner of said Mance Addition; thence North 7°50 ' 45" east along ', the westerly line of said subdivision a distance I of 300 feet ; therice South 82°26 ' 35" east along '�, the northerly line of Lot 4 , Mance Addition, a dis- tance of 109 .45 feet; thence North 21°52 ' 05" East along the westerly line of Mance Addition a distance of 394 . 23 feet to the northerly line of Mance Addition; said north line also being the south line of the North one-half of the Southeast one-quarter of Section 30 , Township 23 North, Range 5 East, W.M. ; thence westerly along said South line a distance of 98 feet , more or less , to the west line of east 360 feet of the west 1512 . 80 feet of said sub-division ; thence northerly along said west line a distance of 194 feet to the north line of the south 194 feet of said sub-division ; thence easterly along said north line a distance of 360 feet to the easterly line of the westerly 1512 . 80 feet of said sub-division; thence southerly along said easterly line a distance of 194 feet to the south line of said subdivision ; thence westerly along the south line of said sub-divi�sion a distance of �+0 feet, more or less , to the northeast corner of said Mance Addition; thence South 2°15 ' 25" t�rest= along the easterly line of said Mance Addition a distance of 247 . 52 feet ; thence south 84°08 '16" east a distance of 347 feet , more or less , to the westerly margin of Talbot Road (Springbrook Road) (96th Avenue South) ; thence southerly along sa�.d westerly margin a distance of 471 feet, more a� less , to the southerly margin of South 37th Street (formerly South 174th Street; ) thence north 82°26 ' 35t1 west along said : southerly margin a distance of 680 feet to the easterly line of Lot 1, said Mance Addition ; thence southerly along said easterly line a distance of 1. 0 foot to the southeast corner of said Lot l , the southerly line of said Mance Addition; thence north 82°26 ' 35" west along said southerly line a distance of 120 . 33 feet to the southwest corner of said Mance Addition and the point of beginning. All situated in Renton, King County, Washington. SECTION III : The estimated total cost and experise of said improvement is hereby declared to be approximately $46 ,217 . 99 , I, The entire cost and expense of said improvement, including the cost and expense of all engineering, legal , inspection, advertising, publication of notices and other expenses incidental thereto , shall be borne by and assessed against the properties specially benefitted by such improvement included in the Local Improvement District � -4- established , embracing, as near as may be, all property specially benefitted by such improvement. SECTION IV : The nature of the improvement provided for herein is such that the special benefits conferred upon the property are fairly reflected by the use of the statutory termini and zone method of assessm�nt, and it is hereby pr.ovided and ordered that �he. assessment shall be made against the property of the District in accordance w�th said method. Al1 property included within the limits of the Local Improvement District above created shall be considered to be the property specially benefitted by such Local Improvement and shall be the property to be assessed to pay the cost and expense thereof as hereinabove specified. SECTION V : Local Improvement District warrants shall be � issued in payment of the cost and expense of the improvement herein ordered. Such warrants shall be payable out of s.aid "Local Improvement Fund, District No. 264". to bear interest from the date there- of at a rate to be fixed hereafter but not to exceed 8% per annum and � to be redeemed in cash, and/or by Lacal Improvement District bonds herein authorized to be issued , said interest-bearing warrants to be hereafter referred to as "revenue warrants" . Such bonds shall bear interest at a rate to be hereafter fixed but not exceeding 80 per annum; shall be payable on or before twelve years from the date of issuance, the life of the improvement ordered being not less than twelve (12) years, and shall be issued in exchange for and in redemption of any and all revenue warrants issued hereunder and not redeemed in cash within a period not to exceed sixty days after the first publication by the City Treasurer of notice that the assessment roll for Local Improvement District No . 264 is in his hands for collection. The bonds, shall be redeemed by the collection of special assessments to be levied and as�essed upon the property within said District, payable in ten equal annual installments , with interest at a rate to be fixed hereafter , but not exceeding 8o per annum, under the -5- i . mode of "payment by bonds" or by "notes in lieu thereof" , as defined by law and the ordinances of the City of Renton. In case of default I� in the payment of any assessment, when the same shall become due , there shall be added interest at a rate to be hereafter fixed but not to exceed 8% per annum, and a penalty of 8o which shall also be collected. The exact form, amount, date , interest rate and denomination of said warrants and bonds shall be hereafter fixed by Ordinance of the City Council. Said warrants and bonds, or notes in lieu of said bonds, shall be sold in such a manner as the City Council shall hereafter determine. SECTION VI : AI.l the work necessary to be done in connection with the making of said improvements shall be done by and made by contract upon competitive bids and the City shall have an�. reserves the right to reject any and all bids. The call. for bids for caork auth- orized pursuant to this Ordinance shall include a statement that payment for said �aork will be made in cash warrants drawn upon the "Local Improvement Fund, Dis.trict No . 264 . " SECTION VII�. There is hera�y created and established in the office of the City Treasu re�r of the City of Renton, for Local Improve- ment District No. 264 , a special fund to be known and designated as "Local Improvement Fund, District No. 264" into wh'ich fund shall be de�,o5ited the proceeds from the sale of revenue warrants drawn against said fund which may be issued and sold by the City and collections pertaining to assessment, and against which fund shall be i.ssued cash warrants to the contractor or contractors in payment for the work to be done by them in connection with said improvement, and against which fund casn warrants shall he issued in payment of all other items of expense in connection with said improvement. SECTION VIII : The City Engineer is hereby authorized and directed to call for bids , in the manner provided by law, for the construction and installation of the improvements authorized herein. ' SECTION IX: The City reserves the right to issue , in lieu of bonds and warrants in payment of the cost and expense of the afore- said Local Improvement District installment note or notes payable out I -6- e t � of the Local Improvement District Fund whenever such note or notes are sold exclusively to another fund of the City as an investment thereof, and as further provided by law. Such installment note or notes may be issued any time after a thirty ( 30) day period allowed by law for the payment of assessme.nts of said District without penalty or interest, and such note or notes may be of any deriomination or denominations , the aggregate of which shall represent the balance of the cost and expense of the Local Improvement District which is to be borne by the property owners therein, an.d as further provided by law.
