AN ORDINANCE QF THE CITY OF RENTON, WASHINGTQN,
VACATING A CERTAIN PORTION OF WHITMAN COURT N.E. �,�,p � 7��
FORMERLY 134th AVENUE S.E. , IN THE CITY 0�' RENTON, G�`zl ��',��
i • KING COUNTY, WASHINGTON
� WHEREAS a praper petition for vacating a certazn portion o�
street hereinafter mare particu.larly describad wa� duly filed wi-�h the
City Glerk on or about May 8 , 1970 , and said peti�ian has been signed
( by the owners of more than two-thirds of �he property abutting upon
j such gortion of street saught to be °vaca-ted; and
WHEREAS the City Council by Resolution Nc�, 1687 approved an
May 25 , 1970 , and af�er due investigation did fix and determine the
22nd day of June , 1970 �a� �he hour of 8 : 00 P.M. in the City Council.

hearing thereon; and the Clerk having given due notice o� such hearing
in �he manner provided by 1.aw and all persons hav`�iig been heard
ap.pearing in favor of or opposition there-�o, and
, WHEREAS the Plann.ing Commissian having duly considered said

petition and said vaca�ian as hereinafter mare particularly described
and same being found to be in the public intere�t and for the public
benefit a.nd no injury or damage to any person. or properties will
result therefrom, and
WHEREAS the City Council caused ta have made an appraisal
of �he property sought to be vaca�ted as provided ,�or in City of Renton
� Qrdinance No. 2349 ;
NQW THEREFORE, B� IT ORDAINED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF RENTON, AS FOLLOWS:
, SECTION I : The follawing described partian a�' Whi-tman

All that par�ian of Whitman Caur�t N,E, lying between
' the North line of �ec. 10 , Twp. 23 N. , Range 5 E. W.M. ,
and the nor-th 1.ine of the pla-� af Honey Dew Estates j
Division Na. 1, according to plat recorded in Vol. 72 1
of plats , pg, 98 , recording o� King County, Washington,
M BE AND THE SAME IS HEREBY VACATED, subject , however, to a �wen�y C24)
foo� utility easemen� re�ained by the City �or utility and related
I purposes , the centerline thereof being loca�ed, to-wit : i

The centerline of said Utility Easement being the centerline of said I�
Whitman Court Northeast.
and further subject to those certain "Declaration of Restrictive
Covenants" dated July 15 , 1970 , executed by the Petitioners-Owners
herein pertaining to properties abutting said portion of right of
way herein vacated which said covenants and Petitioners-Owners '
plot plan dated June 30 , 1970 , being incorporated herein as if fully
set forth.
SECTION II : The City Council hereby elects to charge a fee
of $1, 000 . 00 to Petitioners-Owners , said amount being less than
one-half (1/2) of the City' s appraisal of the right-of-way herein
vacated, and said charge being in the public interest and for the
public benefit.
SECTION III : This Ordinance shall be in full force and effect '
from and after its passage , approval and legal publication as provided
by law. A certified copy of this Ordinance shall be filed with the
King County Auditor' s office and as otherwise provided by law. ,
PASSED BY THE CITY COUNCIL this 20th day of July, 1970. ,
