Amends Ordinance No. 2234 Amended by Ordinance No. 2745 ORDINANCE NO.� �v�� 5155 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CREATING ANO ESTA(iLISHING A "BOARD OF ADJUSTMENT", DEFINING ITS MEMaERSHIP AND ORGANIZATIOfV, ESTABLISHING TERMS OF OFFICE, PRESCRIBING ITS DUTIES AND ESTABLISHING A NEW CHAPTER TO BE KNOWN AS CHAPTER 9 OF TITLE 11 , (COMMISSIONS AND BOARDS) OF ORDINANCE N0. 1628 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON, WASHINGTON" BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL Of THE CITY OF RENTON, WASHINGTON, AS FOLLOWS: Sections 4-731 (A) and 4-731 (B) of Title IV (�uilding Regulations) of Ordinance No. 1628 entitled "Generai Ordinances of the City of Renton" are hereby repealed and there is hereby established a Chapter to be known as Chapter 9 of Titl.e 11 (Commissions and Boards) of said Ordinance No. 1628, reading as follows : SECTION 1 : Establishment of Board of Adjustment. There is hereby estab)ished a Board of Adjustment composed of seven members, all mf whom shall be residents of .the City of Renton. All of such members shall be appointed by the Major subject to confirmation or concurrence by a majority of the members of the City Council . The residency requirements may be waived by majority vote of the City Council . SECTION 11 : Composition. The composition of said Board shall be such as to provide a knowledgeable, experienced and representative body genera�ly skilled in the building and related fields and shall consist of the following positions and qualifications : Position No. 1 . Shall be a practicing architect licensed by the State of Washington. Position No. 2. Shall be a home bwilder and member of the � Association of Home Builders. Position No. 3. Shall be a practicing professional engi- neer licensed by the State ot' Washington. Position No. 4. Shall be a general contractor member of � the Associated General Contractors and licensed by the State of Washington. Position. No. 5. Shall be a mechanical , plumbing or elec- trical contractor licensed by the State of Washington. Position No. 6. Shall be appointed from members of the general public. Rosition No. 7. Shall be appointed from members of the general public. � SECTION 111 . Appointment and Term of Office. On or before tp�.y 1971 , the Mayor shall appoint, subject to confirmation or concurrence ' �. ,- • ` ' � r • y � . - �• • , . ' , ' - . • � by majority of the members of the City Council , qualified persons to each of ; the seven positions provided in Section II of this Chapter. Appointees shall , h�old office for a four year term and until their successors are appointed and qualified; provided that in the initial appointment positions one and two shall be for a four year term, positions three anci four shall be for a three year term, positions five and six shall be for a two year term, and position ' seven for a one year term. Vacancies shall be filled in the same manner as the original appointment for the unexpired term of the particular position. Each such appointment shall be effective upon the filing of a copy thereof in the office of the City C1erk. SECTION IV. Organization. The Board shall convene and hold its � first busine me i ss et ng not more than thirty (30) days after appointments are completed as specified in this Ordinance. At such first meeting the Board shall select a Chairman and a Secretary by a majority vote of its members. The Chairman and Secretary shall each serve for a period of one year and un- til his ar her successor is appointed in the same manner. The secretary may be a member of the regular City staff and not a member of the Board. Members of the Board shall be reimbursed for their actual expenses incurred in connection with Board business at the same rate as provided by � law for City officials enerall . 9 Y The Board shall meet at least once a month or more often as it� deems necessary. Special Board me�tings may be called at any time by any four of its members upon not less than forty-eight (48) hours notice to its members and the public media as required by law. A majority of the Board shall con- stitute a quorum. In the event that a Board member is absent from three consecutive mee:tings and unless excused by majority vote of the members, the Board shali de.clare that particular position vacant and shall so notify the appointing authority. SECTION V: Powers and Duties. The Board of Adjustment shall have all the powers and duties prescribed by law and as the City Council may prescribe by Ordinance from time to time, including but not limiting it to, the provisions of Section 4-731 (C) of Title IV (Building Regulations) of Ordinance No. 1628 entitled "General Ordinances of the City of Renton" and as same may be amended �from time to time. - 2 - .�, � � .o r' _ .r _. ,� '. - - • � � ` � • • � �a �� , , • . � • t SECTION VI : This Ordinance shall be in full force and effect from and after its passage, approval and legal publication.
