' � t1� , . . �. , :----.... � CITY OF RENTON, WASHINGTON ORDINANCE NO. ���1'..� AN ORDINANCE of the City of Renton� Wash-- ington, ordering the construction and installation of underground power and other utility lines, ornamental street lighting system and improvements incidental thereto, all in accordance with Resolution No. 1747 of the City Council of the City of Renton, Washington; establishing Local Improvement District No. 274; providing the method of assessment in said District; providing that payment for said improvement be made by special assessments upon property in said District, payable by the mode of "payment by bonds" or °'notes" in lieu thereof as determined by the City Council; and providing for the issuance and sale of local improvement district warrants redeemable in cash and local improve- ment district bonds or notes . 1 r WHEREAS , by Resolution No. 1747 , adopted June 21, 1971, the City Council of the City of Renton, in support of that certain petition filed with the City Clerk on or about June 14 , 1971, for the creation of a local improvement district, declared its intention to construct and install underground power and other utility lines , ornamental street lighting system and improvements incidental thereto and fixed the 12th day of July, 1971, at 8 :00 o'clock p.m. (PDST) in the Council Chambers in the City Hall in the City of Renton, Washington, as the time and place for hearing all matters relating to said proposed improvement and all objections thereto and for determining the method of payment for said improvement; and WHEREAS , Jack Wilson, City Engineer, caused an estimate to be made of the costs and expenses of the proposed improvement and certified said estimate to the City Council, together with all ' papers and information in his possession touching the proposed improvement, a description of the boundaries of the District, a statement of what portion of the cost and expense of the improvement should be borne by the property within the proposed District, a statement in detail of the local improvement assessments outstanding , ' � � or unpaid against the property in the proposed District, and a statement of the aggregate actual valuation of the real estate, � including 250 of the actual valuation of the improvements in the proposed District, according to the valuation last placed upon it for the purpose of general taxationo and WHEREAS, said estimate is accompanied by a diagram of the proposed improvement showing thereon the lots, tracts , parcels of land, and other property which will be specially benefited by the proposed improvement, and the estimated amount of the cost and expense thereof to be borne by each lot, tract and parcel of land or other property; and , WHEREAS , due notice of the hearing upon said Resolution No. 1747 was given in the manner provided by law and said hearing was held by the City Council on July 12 , 1971, and all written protests filed with the City Council on or before said date were duly considered by the City Council and all persons appearing at said hearing were heard� said total protest not exceeding B .Olo of the total cost bearing owners within said District; and WHEREAS , at said hearing the City Council has given due consideration to the special benefits to be received from such proposed improvement by all of the properties to be included within the proposed local improvement districtr and WHEREAS , the City Council has determined it to be in the best interests of the City that said improvement as hereinafter ' described be carried out and that a local improvement district be created in connection therewith; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, as follows : S`ectiori l. The City Council of the City of Renton, Washington, hereby orders the construction and installation of underground electric utility distribution lines � underground telephone transmission lines and an approved street lighting system, together with the necessary -2- �I ditching, the installation of conduits , ducts , manholes , handholes, covering with granulithic backfill, tamping, restoration to grade, including replacement of curb, gutters and sidewalks where necessary, and the installation of primary and secondary cables, all distribution lines (with the exception of the overhead high voltage transmission lines) , transformers , switch gear, light ,standards and luminaires, and other appurtenances consistent with good distribution line , telephone line and street lighting installations , all of such improvements located within certain designated streets in the Downtown Area of the City of Renton and all within the boundaries of the local improvement district hereinafter described in Section 2 hereof. There shall be included in the foregoing the acquisition of any property and easements , right-of�way and land that may be required, together with the installation of all necessary equipment, supplies and appurtenances theretor and there shall further be included the performance of such work as may be incidental and necessary to the foregoing construction and installation. The City Council may, in its discretion, modify and amend the details of the foregoing described improvement, including the financing thereof, where in its judgment it appears advisable; provided, such modifications and amendments do not substantially alter the general plan of said improvement project. The improvement shall be carried out in accordance with the plans and specifications therefor to be prepared by Jack Wilson, City Engineer, and such plans and specifications are hereby adopted � for said improvement. Section 2 . Tliere is hereby created and established a local improvement district to be called "Local Improvement District No. 274" of the City of Renton, Washington, the boundaries of such local improvement district being described in "Exhibit A" attached hereto / and by this reference made a part hereof. -3- ' , , , � Section 3 . The total estimated cost and expense of the improvement is hereby declared to be approximately $225 ,000 . 00. The entire cost and expense of the improvement, including the cost and expense of all engineerinq, legal, inspection, advertising, publication of notices and other expenses incidental thereto, shall be borne by and assessed against the property specially benefited by the improvement included in the local improvement district herein established embracing as near as may be all property specially benefited by the improvement. There shall be included in the cost and expense of the improvement all cost items specified in RCW 35. 44. 020 . Section 4 . In accordance with the provisions of Section 7 of Chapter 258 , Laws of Washington, 1969 , lst Ex. Sess . , the City hereby finds and declares that the front foot method of computing assessments fairly reflects the special benefits to the property being assessed, and such property shall be assessed on a front foot basis of not to exceed $10. 00 per front foot. Sectiori 5. Local improvement district warrants shall be issued in payment of the cost and expense of the improvement, such warrants to be payable out of the "Local Improvement Fund, District No. 274 , " hereinafter created, to bear interest from the date thereof at a rate to be hereafter fixed by ordinance not to exceed 8% per annum and to be redeemed in cash and/or by local improvement district bonds herein authorized to be issued, such interest�bearing warrants to be hereafter referred to as "revenue warrants. " Such bonds shall bear interest at a rate to be hereafter fixed by ordinance not exceeding 8o per annum, shall be payable on or before twelve (12) years from the date of issuance, the life of the improvement ordered being not less than twelve years , and shall be issued in exchange for and in redemption of any and all revenue warrants issued hereunder and not redeemed in cash within a period of not to exceed sixty (60) days a�ter the first publication by the City Treasurer of notice that the assessment roll for Local Improvement -4- . 1 � � � 4 District No. 274 is in her hands for collection. The bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said District, payable in ten (10) equal annual installments , with interest at a rate to be hereafter fixed by ordinance not exceeding 8-1/2o per annum, under the mode of "payment by bonds , " or by "notes in lieu thereof, " as defined by law and the ordinances of the City of Renton, Washington. In the event of default in the payment of any assessment when the same shall become due, there shall be added interest at a rate to be hereafter fixed by ordinance not to exceed 8-1/2o per annum and a penalty of 'f o .. which shall also be collected. The exact form, amount, date, interest rate and denomination of said warrants and bonds shall be hereafter fixed by ordinance of the City Council; however, the City Council may, in lieu of the issuance of such bonds issue installment notes payable out of the Local Improvement District Fund as provided by law, special reference being made to RCW 35.. 45 . 150 . Said warrants and bonds , or notes in lieu of said bonds� shall be sold in such manner as the City Council shall herea�ter determine. 5ectiori 6 . All the work necessary to be done in connection with the making of said im�rovement shall be done by and made by contract upon competitive b�.ds and the City shall have and reserves the right to reject anX and a11 bids. The call for bids for work authorized pursuant to this ordinance shall include a statement that payment for such work will be made in cash warrants drawn upon the "Local Improvement Fund, District No. 274 , " Sectiori 7 . There is hereby created and established in the office of the City Treasurer o� the City of Renton� for Local Improvement District No. 274 , a special fund to be known and designated as "Local Improvement �'und, District No. 274 , " into which fund shall be deposited the proceeds from the sale of revenue warrants drawn against said fund which may be issued and sold by the City and collections pertaining to assessments, and against which fund -5- i � + r . shall be issued cash warrants to the contractor or contractors in payment for the work to be done by them in connection with the improvement, and against which fund cash warrants shall be issued in payment of all other items of expense in connection with the improvement. Section 8 . Jack Wilson, City Engineer, is hereby authorized and directed to call for bids , in the manner provided by law, for the construction and installation of the improvement I authorized herein. 'I Section 9 . The City reserves the right to issue, in lieu I of bonds and warrants in payment of the cost and expense of the aforesaid local improvement district, installment note or notes payable out of the Local Improvement District Fund whenever such note or notes are sold exclusively to another fund of the City as an investment thereof� and as further provided by law. Such installment note or notes may be issued any time after a thirty-day , period allowed by law for the payment of assessments of said District without penalty or interest, and such note or notes may be of any denomination or denominations , the aggregate of which shall represent the balance of the cost and expense of the local improvement district which is to be borne by the property owners therein, and as further provided by law.
