HomeMy WebLinkAboutORD 2647 � . - •-r�� ' ` ' + d_. -'-.�. . .�y � � �� p b C�����a�� ��-� � ORDINANCE NO . - p���, AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON , ORDERING THE CONSTRUCTIQN AND INSTALLATION OF CERTAIN SANITARY SEWER LINES AND AP�URTENANCES THERETO IN THE VICINITY OF SOUTHWEST 43RD STREET _ AND WEST VALLEY HIGHWAY, RENTON, I�ING COUNTY, WASHINGTON, ALL IN ACCORDANCE WITH RESOLUTION N0. 1745 OF THE CITY COUNCIL OF THE CITY OF RENTON, � WASHINGTON; ESTABLISHING LOCAL IMPROVEMENT DISTRICT N0 . 273 , PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT; PROVIDING THAT PAYMENT FOR SAID IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTS UPON PROPERTY IN SAID DISTRICT, PAYABLE BY THE MODE OF '�PAYMENTS 0�' BONDS'� , or "NOTES" IN LIEU THEREOF - AS DETERMINED BY THE CITY COUNCIL; PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRICT WARRANTS REDEEMABLE IN CASH AND LOCAL IMPROVEMENT DISTRICT BONDS OR NOTES. WHEREAS by Resolution No . 1745 passed and approved on June 7 , 1971, the City Counci.l of the City ot Renton, in support of that certain Petition for the creation of a Local Improvement District filed with the City Clerk on or about April 16 , 1971, declared its intention to construct and install certain sanitary sewer lines , together with appurtenances thereto, as hereinafter more particularly described, and fixed the 19th day of July, 1971 in the City Council Chambers in the City Hall, Renton, Washington, as the time and place for hearing all matters relating to said improvements and all objections thereto and for determi.ning the method of payment for said improvements , and WHEREAS Jack Wilson, City Engineer, has caused an estimate to be made of the cost and expense of the proposed improvement and has certi.fied said estimate to the City Council , together with all papers , data, and information i.n his possession relating to the proposed improve- ment , description of the boundaries of the District, a statement of what portion of the cost and expense should be borne by tre properties within the proposed District, a statement in detail of the Lacal Im�rovement assessment outstanding or unpaid against the property in the proposed District, and a statement af the aggregate actual valuation , of the real estate, including 250 of the actual valuation of the improvements -1- , . i, . • . . 1 . . . . in the proposed Distxict� according to the valuation last placed upon it for the purpose of general taxation; and WHEREAS said estimate is accompanied by a diagram of the proposed i.mprovement showing thereon the lots , tracts , parcels of land :s arid other property which wi.11 be specially benefit�l by the proposed improvement, and the estimated amount of the cost and expense thereof to , be borne by each lot, tract and parcel of land or other property wi�iin said Distri.ct; and WHEREAS due notice of the hearing upon said Resolution No . 1745 was given in the manner provided by law, and said hearing was duly held by the City Council at its regular meeting on July 19 , 1971 at the hour of 8 : 00 P.M. and the following protest having b:e�n filed and duly considered, to--wi.t: Name of Protestant , Address George C. Oistad and John Id. Tax Lot 11 0� Section 36-23-4 Anderson, partners and said total protest not exceeding u1'.:7 ::& ._,:;'��.r percent of the total cost bearing owners within said District; an d WHEREAS at said hearing the City Council has given due cansideration to the special benefits to be received from such proposed improvement by all of the properties to be included within the proposed Local Improvement Distric-t; and WHEREAS the City Council deems it in the best interest of the City and of the owners of the property within the proposed Local Improvement District that said improvement as herei.nafter described be carried out, and that a Loc�l Improvement District be created in connection therewith; NOW THEREFQRE -2-- � . , z • ' . • .- . . . - THE CITY COUNCIL OF THE CITY 0�' RENTON DO ORDAIN AS FOLLOWS : SECTION I; The following sanitary sewer lines , including trunk� li.nes and appurtenances thereto, shall be constructed and znstalled in the vicinity of S .W. 43rd and West Valley Highways Renton, Ki.ng County, Washington, as more particularly described on the attached Exhibit , entitled Exhibit fTBip which i.s made a part hereof as if �ully set forth; =�and there �shall be included in the foregoing the acquisi.tion and installation of all necessary pipe,_ manholes, ,valves , fi.ttings , couplings , connection equigment and appurtenances, together with the acquisition of any easements , rights of way and land that may be required9 and ther.e shall be a.ncluded the �erformance of such work as may be incidental and necessary to the foregoing construction and installat�,on. The City Counci.l may modify the d�.ils of the foregoi.ng described improveanent where, in its judgment , it appears advisable, provided such modifications da not substantially alter the plan of said improvement. All of the foregoing shall be in accordance with the plans and specifications therefor to be prepared by the City Engineer. SECTION II : There is hereby established and ��:created a Local Improvement District to be called "Local Improvement District No . 273 of tl�e City of Renton, Washingtan" , tYie boundaries of such Local Improvement District being descri.bed on the attached Exhibit "AYe whi.ch is incorporated herein as if �ully set forth. SECTION III : The estimated cost and expense of said improvement i is hereby declared to be approximately $ 9.Z ,480. 20 : The entir�e cost and expen,se of sai.d improvement, including the cost and expense of all engineering, legal, inspection, adver�ising, p�lication of notices and other expenses incidental thereto, shall be borne by and assessed against the property specially benefited by such improvement in.cluded in the Local Improvement District established, embracing, as near as may be , ,all -3- . , , • ' � • . '-. ' • . property specially benefited by such improvement . Tl�e shall be included in the cost and expense of the improvement all cost items specified in RCW 35 . 44. 020 . SECTION IV: The nature of the i.mprovement provided for herein is such that the special benefits conferred upon the property are fairly reflected by the use of the statutory termini and zone method of asseesment , and it is hereby provided and ordered that the assessment shall be made agai.nst the property of the pistrict in acco�dance with said method. All property included within the limits of the Local Imp�ovement District above created shall be consi.dered to be the property speci,ally benefited by such Local Improvement and shall be the property to be assessed to pay the cost and expense thereof as hereiriabove specified. SECTION V: Local Improvement District warrants shall be issued in payment of the cost and expense of the improvement herein ordered. Such warrants shall be payable out of said 'tLocal Improvement Fund, Distr�:.ct No . 273" to bear interest from the date thereof at a rate to be fixed hereafter but not to exceed � a per annum and to be redeemed in cash, and/or by Local Improvement Di�rict bonds herein authorized to be issued, said interest -bearing warrants to be hereaf�ter referred to as "revenue warrants" . Such bonds shall bear interest at a rate to be hereafter fixed but not exceeding � o per annum; shall be �yable on . � or before twelve years from the date of issuance, the life of the �mprz�vement ordered bei.n.g not less than twelve years , and shall be issued in exchange for and in redemption of any and all revenue warrants issued hereur�der and not redeemed in cash within a period not to exceed sixty days after the first publication by the City'I`i�easurer of notice that the assessment roll for Local Im�rovement District No. 273 is in his hands for collection. The bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said District, payable in ten equal annual installments , with interest at a rate to bef ixed 1..; i . ._ _ . . .. ..�... _�- . _ ,; ♦ . • , . herea�ter, but not exceeding 7 o per annum, under the mode of "Payment by �nds" or by "notes �n lieu thereo�", as defined by law and the ordinances ot the City of Renton. In case of default in the payment of any assessment, when the same shall become due, there shall be added interest at a rate to be hereafter fixed but not to exceed -7 % per annum, and a penalty of � o which shall also be collected The / exact form, amount, date, interest rate and denomination of said warrants and bonds shall be hereafter fixed by Qrdinance of the City Counci.l; however, the City Council may, in lieu of the issuance of such bonds issue �.nstallment notes payable out of the Local Improvement District Fund as provided by law, special reference being made to RCW 35 .45 .150 . Said Warrants and bonds , or notes in lieu of said bonds , shall be sold in such manner as the City Council shall hereafter determi.ne . ' SECTION VI All the work necessary to be done in connection wi.th the making of said im�rovements shall be done by and made by contract upon competitive bids and the City shall have and reserves the right to reject any and all bi,ds . The call for bids for work authorized pursuant to thi.s Ordinance shall include a statement that payment for said work will be made in cash warrants drawn upon the ."Local Improvement Fu�i.d, District No. 273'� . SECTION VII There is hereby created and established in the o�fice of the Ci.ty Treasurer of the City of Renton, for Local Improvement District No. 273 , a special fund to be known a� designated as "Local Improvement Fund, District No. 273" , into which fund shall be deposited the proceeds from the sale of revenue warrants drawn against said fund which may be issued and sold by the City and collections pertaining to assessment, and against which tund shall be issued cash warrants for the contractor or contractors in payment for the work to be done by them in connection witl� said improvement9 and against which fund cash warrants ' shall be issued in payment of all other items of expense in connection with said improvement . . -5- � '� . . � ' � , � , „ .r Y . SECTION VIII The. Cit En ineer is hereb authorized and Y g Y directed to call �or bids , in the manner provided by law, for the construction and installation of -the i.mprovements authorized herein. SECTION IX The City reserves the right to _issue, in lieu of bonds and �rarrants in payment of the cost and expense of the aforesaid Local Improvemen�t Distri.ct installnent note or notes payable out of the Local Improvement District Fund whenever such note or notes are sold exclusively to anothe.r fund of the city as an investment thereof, and as further provided by law. Such installment note or notes may be issued any time after a thirty-day period allowed by law for the payment of assessments of said District without penalty or int�rest, and , such note or notes may be of any denomination or denominations , the aggregate of which shall represent the balance of the cost and expense , ;� of the Local Improvement District which is to be borne by the property owners therein, and as fur-ther provided by law.
