""!, } • . . . .- """"w .v � �. ! a w..M ��`� Or��y�� ORDINANCE N0 . ���'� AN ORDINANCE 0�' THE CITY OF RENTON, WASHINGTON AMENDING CHAPTER 25 0�' TITLE I (ADMINISTRATIVE) OR ORDINANCE N0. 1628 ENTITLED "CODE OF GENERAL ORDINANCESOF THE CITY OF RENTON" RELATING TO SICK LEAVE AND MATTERS INCIDENTAL THERETO THE CITY COUNCIL OF THE CITY OF RENTON DO ORDAIN AS FOLLOWS : :�E�TION--�I : Existing subsection D of Chapter 25 , Title I (Administrativ;e) of Ordinance No . 1628 entitled "Code of General Ordinanc� of_ the City of Renton" is hereby amended to read as tollows : I�-2501 SICK LEAVE (�D) , as amended. (1)In any case in which an em lo ee shall be entitled to bene�its or payments P Y under the State Workman' s Compensation Act or similar com ensator le islation rovidin benefits for injured or P Y g P g � disabled workmen, then the City shall only pay the difference between the benefi.ts and payments received under such act b said em lo ee and his re ular rate of com ensation that Y P Y g P he would have received from the City if able to work. The e Ci a 1 be fore oin a ment or contribution b th t sh 1 , g g P Y Y Y limited to the peri.od of time that such employee had i i this accumulated sick leave credits as s ec fied n P ' Chapter. ' (2) �'urthermore, notwithstanding any prior City ' Ordinance or Resolution to the contrary, all qualitied City Employees now or hereafter having membership in the and State of Washington Law Enforcement Of.ficer� Fire Fighters Reti�nent System (LE�'F) , as fu�ther specified in RCW 41. 26 , shall likewise be entitled to receive sick leave benefits as provided by this Chapter commencing and effective as of March l, 1970 , but not prior thereto; provided Yiowever that any full time member of the City Fire Department who was so employed on and prior to May 3 , 1965 and who was likewise so employed on March 1, 1970 , and then being or -1- . I becoming a member of the LEFF system shall be entitled to and receive the accrued sick leave benefits , if any, standing to such employee ' s credit as of May 3 , 1965 as shown on the City' s records and same shall be credited and carried over to such employee ' s benefit, subject, however� to the total sick leave accrual limitations set forth in sub chapter A hereinabove. The City Clerk or her duly appointed representative is hereby directed to and shall be responsible for keeping and maintaining ancup to date, uniform system of sick leave records for each employee of the City. (3) No sick leave benefits of any type shall be granted or credited to any full time fireman so employed during all or any portion of the period computed from May 3 , 1965 to March l, 1970 and while Ordinance No . 2155 was then in effect for that specified period. (4) All employees now or hereafter covered by the LEFF system and entitled to the benefits thereunder, shall �n case o�f illness or disability, iiiiti.ally use and exhaust any and all sick leave benefits which such employee would be entitled to under the provisions of this Chap-ter prior to receiving any benefits under any "disability leave or retirement leave" provisions of RCW 41. 26 et seq; it being the established policy of the City of Renton that under no circumstances shall a City employee receive dual or overlapping benefits payable froin-�botYi `City and State funds while sick or disabled for the same or substantially same period of such incapacity; but in lieu thereof the benefits granted by any State statute shall become a.vailable upon exhaustion of any sick leave benefits provided -2- � . _ . • . _ . • i . , . SECTION II : Existing subsection E of Chapter 25 , ';Title I _ f (Administrative) of Ordinance No. 1628 entitled "Code of General Ordinanc� of the City .of Renton" zs hereby amended to read as follows : 1-2501 SICK LEAVE (E) , as amended. . �l) Accumulated sick leave -benefit : Each City employee as herein defined, sh�ll upon his retirement for time in serv�.ce as provided by law, or upon his voluntary separation while an employee in good standing , receive a cash amount whic3� shall be equal to one-hal� day' s pa�r .for the position or grade -last permanently held by su�h employee for each day of accumulated sick leave then standing in such employee 's credit on the records of the City. The aforestated benefits shall not apply to any employee who is discharged for cause or terminates for cause at the request of the City, nor shall such benefit be applicable to any member of the LEFF system who does not retire for "time i.n service" as provided by law but leaves active service and receives the benefits of "di.sability leave" and/or "di.sability retirement" pursuant to RCW 41. 26 et seq. (2) No accrual of sick leave benefits as hereinabove defined shall be permitted to any employee who has applied for or has been granted "disability leave" or "disability retirement" under th e provisions of theLEFFsystem or any other similar legislation of theState of Washington and who is no �longer on active service with the City because of such "disability leave" for a period of six months or ore and is recei.vin his monthl salar or substantially m g Y Y -3- � , � • . - -�'.�; . . . . . • • � • equal benefi.ts during such period; in the event, however, such employee is returned to full active duty status with the City prior to the expiration of said six months period and �rior to any final disabi.lity retirement and thereafter continues to per�orm his regular duties for the City , then such sick leave credit shall accrue to his benefit durin� such temporary period of disability, subject to the rate and condi,tions speci.fied in this Chapter. SECTION IIZ; Any and all other Qrdinances or part o� Ordinances in conflict herewith are hereby superseded and repealed.
