"'^''' ` � � ORDINANCE NO�-�^-�'-� 'J � AN ORDINANCE 0�' THE CITY OF RENTON, WASHINGTON, PROVIDING FOR THE LICENSING AND REGULATING OF CERTAIN SECOND HAND DEALERS , IMPOSING LICENSE �'EES , AND PROVIDING PENALTIES FOR THE VIOLATION THE RE 0 F., THE CITY COUNCIL OF THE CITY OF RENTON DO ORDAIN AS FOLLOWS : SECTION I; DEFINITION; Any person, firm, corporation or partnership that, �rithin the City, shall as a business engage in the purchase, sale , trade , barter or exchange of second-hand goods , other than i`junk" as defined in tI-iis Code, shall be deemed a second- � hand dealer, provided, ho�aever, that �a duly franchised appliance, I fur..n.iture, auto parts and accessory dealer, service stations , auctions , ', wrecking yards and junk dealers , sYiall be exempted from the provisions ' of this Ordinance as long as such business holds a valid and subsisting license for such designated activity in compliance with the City of Renton Code. I LICENSE FEE; It shall be unlawful for any person , to engage in the Yausiness of second hand dealer, as above defined, without first procuring a license so to do, to be known as a second- hand dealer' s license.. The fee for such second-hand dealer` s license shall be, and the same is hereby fixed and established in the sum of T�zenty-five dollars ($25 . 00 ) per annum. �� Any person having more than one placec� business where second- I hand goods are bought , sold, traded, bartered or exchanged, shall be I required to procure a separate license for each and every such place of business . APPLICATION FOR LICENSE : Prior to the issuance of such license , the applicant , or someone on his behalf, shall make i written application to. the Director of Pinance for a second-hand dealer' s license on such forms as may be furnished by the City and such application shall be accompanied by the required license fee. � Thereupon such application shall be referred to the Police Department for investigation and recommandation. Any applicant who has been - 1 - ' • ,�' . '�. • . • •. � , . . convicted, during the previous ten C10 ) year period, for the crime of burglary, larceny, receiving stolen goods , and similar crimes as may be determined by the Chief of Police, shall be ineligible to receive such license. Upon recommendation by the Police Department, the City Council may then�.a�prove the ap�lication for such 1.i.cense and same shall then be issued by the Director of Finance to such applicant. SECTION IV: CHANGE LOCATION OF BUSINESS : A second-hand dealer' s license shall not be transferable from one person to another, - to but such licensee may, upon written application/the Director of Finance , have such license transferred to a new location in the City. Such a�plication shall likewise be �:._��:�eferred to the Police Department for recommendation and a�proval and the change of address shall thereupon be noted on the license, together with the date of such change. In case of sale of such business , application must be made by the proposed purchaser for such li,cense as provided for in Section III hereinabove. SECTION V: REQUIRED TO KEEP RECORDS : It shall be the duty of every second-hand dealer to maintain, at his place of business , a bound book in r,�thich shall be legibly written in ink, in the English language , at the time of such exchange , purchase:_� or sale , a record �4 thereof containing the follo�ring, among others : I l. The date of the transaction. 2 . The name of the person or employee conducting the same . --.__ , " _ ' _ _, �, 3. The name, date of birth, correct �current a_ddress_� „�and� the general description of the person �ith`�hom the transaction is inade . The description shall include the sex, race , height and �zeight of such person. 4, The name and street and houee number of the owner of the pro�erty bought or exchanged. 5 . The descriptibn of the property bought, exchanged or traded, including all serial numbers and identifying markings , which, in the case of watches ,shall contain the name of the maker and the number of both the works � and the case� and in the case of jewelry shall contain the description of all letters and marks inscribed thereon. 6 . The price paid for each item purchased or exchanged. - 2 - • . ' ' ' . - . . . • - � �' ' ' ' � It shall be unla�rful for any second=hand dealer, his agent, employee , or representative of such secondThand dealer to fail , neglect or refuse to make entry of any material matter in this record, as required by this ordinance , or to make any false entry therein, or to obliterate , destroy or remove from his place of business any such record. Anyone who sells , consigns , or exchanges any property to or �rith a second-hand dealer as hereinabove defined, shall sign the record re uired to be ke t b such dealer with his true name and shallinclude 9. P Y his correct, current residence address ; ever� second-�hand dealer, h�.s agent, employee or representative3 shall require identification I�I of such person i.n each instance. Such identi�ication shall include the name of the person, birth date, sex, race and current address of the ' person who sells , consigns or exchanges the property. The signature shall be verified for correctness and legibility by such licensee , his ' agent, employee or representative. SECTION VI : TIME LIMIT - HOLDING ITEM REQUIRED: It shall be unlawful for any second hand dealer, his agent , employee or representa- tive, to remove any goods , articles or things purchased by him or left �ith him from his store or place of business until the expiration of thirty (30) days after the same was purchased or received unless said goods , articles or things have , within said time period , been inspected I and approved for release by the Police Department. It shall be unlawful for any second�hand dealer, his agent , employee or representative to purchase or exchange any article or thing � from any person under eighteen (18) years of age , or �rom any person �ho is at the time intoxicated, or from any habitual drunkart��: or from any person addicted to the use of narcotic drug, or from any person who is known to be a thief, or a receiver of stolen goods , or from any person �rhom he has reason to suspect to believe to be such. Notification by the Police Department unto such licensee,his agent , employee or representa- tive , that a person has been convicted of burglary, larceny or receiver of stolen goods , shall constitute sufficient notice of such convictions under the provision of this Chapter and shall be prima facie evidence - 3 - I ! � . • . • ♦ � ♦ ♦ �. • Y ' . � • that the licensee, his agent, employee or representative , has due notice thereof. SECTION VII : DAILY TRANSCRIPT: It shall be the duty of every second�hand dealer to report to the Chief of Police , or his duly authorized representative , prior to twelve o�clock of every business day, on forms furnished by the City, a full, true and correct transcript of the record of all transactions had on the preceding business day. It shall further be the duty of such second^hand dealer, having good cause to believe that any property in his possession has previously promptly, been lost or stolen, to/report such facts , together with all pertinent evidence , to the Police Department , together raith the name of the owner, if known, and the date, and name of, the person from �thom the same was received by such second-hand dealer. Every second-�and dealer, hisT �gent:;:��employee�..or�:�r.e�rese.n,tative r�ahoc:sliail.,.fail,._�eglect , or refuse to make such report, or who shall falsely report any material matter to the Police Department shall be guilty of �.�a� violation of this Ordinance. SECTION VIII : RECORDS TO BE OPEN POR INSPECTION: All books , writings and other records of any second-hand dealer pertaining to the purchase , exchange, barter, sale or receipt of any goods , wares , reasonable merchandise or other articles or things of value , shall at all/times be open for inspection by the Chief of Police, or his duly authorized representative , which inspection shall include all storage areas and all articles or things received, purchased or exchanged and stored with said second-hand dealer SECTION IX: Any firm, person or cor�oration violating any provisions of this Ordinance shall , upon conviction, be guilty of a misdemeanor and be fined by a sum not exceeding Five Hundred Dollars C$500 . 00 ) or be confined to the City Jail for a period up to ninety C90) days , or both such fine and imprisonment. - 4 - i . , � . � , , - � . _ , . ; . • . . . � . SECTION X: Any and all ordinances or �arts o�' ordinances in conflict herewith are hereby repealed.
