I , �� ORDINANCE NO . v�.7.� Q ' AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING CHAPTER 7 of TITLE V � (BUSINESS REGULATIONS) OF ORDINANCE N0 . 1628 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY 0�' RENTON" RELATING TO MERCHANT PATROLMEN AND PRIVATE DETECTIVES , LICENSING AND REGULA- TION THEREOF- • THE CITY COUNCIL OF THE CITY OF REIVTON DO ORDAIN AS FOLLOWS : SECTION I.: There is hereby added a new subsection, entitled 5-701A to read as follows : Section 5-701A �PURPOSE AND SCOPE . The primary purpose o� this Chapter is to provide regulations in the interest of public safety and welfare as to those persons who, as independent contractors , agencies or businesses , act or employ personnel as merchant patrolmen and/or private detectives . No persons licensed hereunder shall be deemed or considered a City emgloyee nor shall any such person be enti-t�d to any of the benefits , privileges , immuniti.es or rights applying to any such City employee . SECTION II : Exi.sting Section 5-704 - APPLICATION FOR LICENSE , is hereby amended to read as follows : . .. ;Section 5-704, as amended, APPLICATION FOR LICENSE. Application for a "Private i�etective License" "Private Detective Agency License" , "Merchant Patrol Agency License" or "Merchant Patrol- Finance man LIcense" shall be made unto the Directbr.:rof/on forms to be furnished by him for that purpose, shall be signed and verified by the applicant, and shall state, among others , the following: (a) Hi.s full name, age, present residence and past residences during the immediately preceding five year period. (b) His present and �previous occupations for at least five ( 5) I years last past, ancl the address of the place of business and the name of his employer , Each application for each such license shall be accompanied by -1- � . ,. , „ , � , . ., , • . a complete set of fingerprints of the applicant and also by two (2) recent duplicate photographs of the applicant of the size to be deter_mined by the Chie.f of Police . One photograph shall be retained in the records of the Renton Police Department and the other attached ' to the license i,n such manner that it cannot be removed and another photograph substituted therefor without detection. Upon presentation �' of an applicat�on for any such license, and before acting upon same , I the Di.rector of Finance shall reques-t the Chief of Poli.ce to make a full invest�.gztl�n as t• the truth •f the sta.tements c�ntained. therei.n and as to any and all other matters which might tend to aid the Director of Finance in determining whether or not the license shall be granted. The Chief of Police shall furnish a written report I to the Director of Finance containing the results of his investigation �nd his recommendations as to the granting or refusal of said license;� provided however, that no `LPrivate Detective License" or "Merchant Patrolman License" shall be issued to a person not an employee of a duly licensed Private Detective Agency or Merchant Patrol Agency, which such license must have been issued by the City of Renton. SECTION III : �here i.s hereby created a .new-_-.section; � entitled 5-712 in lieu of existing Section 5-712 , reading as follows : Ii Section 5-712 - UNIFORM AND BADGES . The City, acting by and through the Chief of Police or his duly designated representative within the Police Department, shall designate and approve the type, color and character of uniform to be worn by all licensed merchant an.d/or private detectives patrolmen/in accordance with the provision of this Chapter. The wearing or display of any badge, star or other identifying insig�ia .shall likewise have the prior written approval of the City as aforesaid. Any such uni.form or other identifying apparel and/or insignia shall in no event be similar to or identical to that worn or displayed by any duly commissionez� �law enforcement officer such as members of I -2- % . � . . �. �f : . � . , . . Poli.ce, public safety or like governmental agenca.es primarily concerned with law enforcement. It shall be unlawful for any licensee hereunder to at any time wear or display any uniform, badge, star or similar insignia except those expressly approved and authorized by the City of Renton as herein provided for. It shall be unlawful for any li.censee hereunder to publish, announce, act or in any way profess himself to be associated or connected with any bona fide law enforcement agency of any governmental ' ' a e to members of the ublic such licensee shall clearl indlc t p uni.t but y ' that he ox she is an :indegendent contractor or agency, privately owned and operated and in no way connected with any governmental agency except for the fact of such personal agency being licensed hereunder. SECTION IV: There is hereby created a new section, entitled 5-713 reading as follows : Section 5-713 - MERCHANT PATROL VEHICLES AND EQUIPMENT . Special lights , light bars and sirens shall not be authorized or used by any licensee hereunder unless previously approved by the City of � Renton, acting by and through its Chief of Police or other duly designated representatives , and all of such equpment shall be in full compliance with provisions of RCW 46 . 37 . 190=194 and as same may be amended from time to time. The use of a spotlight as approved in �CW 46 . 37 .180 shall be permitted. SECTION V: There is hereby created a new section, entitled 5-714 reading as follows: Section. 5-714 - REPORTS TO POLICE DEPARTMENT Every licensee hereunder shall make a report to the Police Department of the City of Renton immediately upon determining by such licensee that any irregularity tending to show that a crime has been committed or may -3- , . �: ' • ` ' I . � • . • . � � be commit�ed whenever such licensee ha.s determined such facts or circumstances to exist during and while in performance af his duties . � I SECTION VI : There i.s hereby created a new section , enta,tled 5-715 (farmerly Sec�ian 5-711} , readi,ng as follows : i Section 5-715 : PENALTY; Any per�on vi.olating or failing to comply wi�h any o� -�he provisions of this Chapter shall be deemed guilty of a misdemeanor and upon canvic�ion thereo� shall be pun.ished by a fine in an.y sum nat exceeding five hundred dollars ($500 . 00} , or ; by imprisonment in the Ci.ty Jai.l far a peri.odre�t exceedin.g nine-�y (90? days , or by both such fine and imprisonmen�. � SECTION VII: There is hereby created a new sectiorz, entitled � 5-716 (formerly 5-712) , reading as follows: Secti.on 5-716 : CONSTITUTIONALITY: If any Section, provision I or part thereof in �his Chapter shall be adjudged to be invalid or uneonstitutional, such adjudicatian shall not affect the validi�y af the CHapter as a whale or any Sectian, provi�ion or any par-� thereof not so adjudged invalid or uncans-�itutional. S�CTION VIII : Any and all other Qrdinances or par�s o� Ordinances in conflz.c� herewith are herelay repealed.
