AMENDEI) ;BY.� 012D. #2946 ; - , • , • . , . ,•, . �1� • , 1 � :�1��j ORDINANCE N0 . 2��2 AN QRDINANCE OF THE CITY OF REN'�ON, WASHINGTON, AMENDING CHAPTER 3 (GARBAGE) 0� TITLE VIIZ (HEALTH AND SANITATION) 0�' ORDINANCE N0 . 1628 ENTITLED "CODE OF GENERAL ORDINANCES QF THE CZTY QF RENTON" RELATING TO RATES FOR CHARGE FOR GARBAGE COLLECTIONS THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON , DO ORDAIN AS FOLLQWS : SECTIONI : Existing Section 8-309 , subparagraphs (A) , (B) and (D) , together with Exhibit "A" and Supplement thereto , of I Chapter 3 , Title VIII (Health and Sanitation) o� Ordinance No . 1628 entitled "Code of General Ordinances of the City of Renton" is hereby amended to read as follows : Section 8-309 : , as amended: RATE FOR CHARGES : The following schedule be and the same is hereby adopted as a basis of classification and as a �hedule of charges to be paid to and collected by the City for services rendered: (A) Collection of garbage, refuse and swill from residential dwellings shall be made once a week and the charges therefor shall be as follows : l. For "garbage cans" and/or "garbage units" as herein defined,placed not more than twenty five feet (25 ' ) from the edge of street, curb or alley way abutti,ng ar adjoining unit serviced: Not more than 2 cans per week $ 2 . 20 per month Each additional can 0 . 50 per month 2 . For "garbage cans" and/or "garbage units" as herein , defined, placed more than twenty five feet (25 ' ) but less than sa.xty feet (60 ' ) from the edge of the street, curb or alley way abutting or adjoining unit serviced ; Not more than 2 cans per week $ 2 . 30 per month Each additional can 0 . 50 per month -1- . �. : . . . • . . . - " '. .. < � • . • . , • � , . . , �, . • • • • � � • J. .a • 3 . Any "garbage cans" or "garbage units" � herein defined, in excess of twenty (20) cans per month - 32� per can pickup per month provided, however, that the minimum monthly charge for each such business or commerci.al accoun.t shall be the sum of Three Dollars Twenty-five Cents ($3 . 25) per month. I 3 . Collecti,on of Industrial Waste and Rates : "Industrial Was.�e" ,� .as ; that term is herein defined, shall "be collected I -2- � �a • . � ~• �. , � � ' ' • • • � � � •_ � f I ♦ / �{�' � • � ' , � • � . • f � • by the City 's collector holding a valid and subsisting cont-r-act= the�or, from the manufacturing establishments havir�g such wastes� at the rates and upon the terms establ3shed by Exhi,bit"A"which is incorporated herei,n, and as same may be aJaended from time to ti.me. 2 . However, whenever any such manufacturing concern or establi,s.hment produces , on occasions , and has available for collection unusual q;uantities of such industrial waste ` as the direct by_product of its manufecturing operation and the rates for colleetion thexeof are not specified on Exhibit "A" , then such manufacturi,ng establishment may r cont�act with the City � s collector for collection - and disposal of such unusual quantities of industrial waste subject to the prior written ap�roval of the City; provide d however, that any such rates shall be nondiscriminatory and shall apply equally to all such users based on substantially like quantities , types and nature of such industrial wastes , its locations , accessi.bility for pi,ck u� by the collector and disposal thereof. S,uch rates shall at all times be fzled with the City Clerk withi,n ten (10) days after becoming effective, and be open to public inspectzon; and further provi.ded that the duration of any such special arrangement between the manufacturing concern and the Ci:ty_�ts - collector shall, �n no even.t, exceed the remaining term of the collector's contract with the Ci,ty. 3 . In the event, however, that the City 's collector is unable or unwilling to provi,de for the pickup and �sposal of such unusual quan�iti.es of industrial waste as hereinabove � s�eci.fi.ed, then such manufacturing establ�.shment may s�ter a�nto a separate contract with any other party for such -3- � • . . ; . . ` • • , . . . ' � . � . • , • . , . D ; . . I purpose upon the prior written approval of the City and upon such nondiscriminatory terms and conditions as hereinabove specified. 4 . Pursuant to any collection agreement between the City and any such Contractor , the City shall provide for all billings and collections based on the services rendered by the City' s collector of such "Industrial Waste" as herein defined and pursuant to any such contract , less any billing charge due the City. 5 . The City hereby expressly finds and determines that the collection and disposal of "Industrial Wastes" from certain manufacturing concerns located within the City is of a special and peculiar nature and type not commonly applicable to other business or commercial concerns; , therefore the establishment of special rates as hereinabove set forth and the various classifications therefor is reasonably necessary�' -�,' ,in view of the diverse nature and kind of by products produced by such manufacturing concerns , their various quantities , the locations thereof , and the accessi- bility and availability for pick-up disposal and like matters in connection therewith. i EXHIBIT "A" The below specified rates and conditions are based on quantities of ":Industrial Wastes" of at least 65 , 000 yards per year or more of loose measure or equivalent in combination of loose and com- pacted waste . Dumping fees under Items 1 and 2 below are paid for by the manufacturer separately and a-re not included in said rates : l . $28. 00 per foYty-yard load of loose industrial waste in contractor ' s containers exclusive of "Dumping Fee" at disposal facility. - 4 - ,. . . • ' , . • • • , , .� • • l � f., � • • � , � 2. $ 28 . 15 per load of compacted industrial waste in customer furnished containers , exclusive of "Dumping Fee�� at disposal facility. 3 . $1. 00 per cubic yard for industrial waste haialed to the disposal facility , including "Dumping Fee" for all loose material , but in the event said dump fees are modified or revised , then the aforespecified rate shall be adjusted accordingly. 4 . The rates as specified above are based on the "by- products" (industrial wastes) of such qualifying manufactur- ing concerns but shall exclude any material or substance containing wet styrofoam or like materials that have a tendency�tor affinity to stick or "gum up" containers ; such qualifying manufacturing concerns must furnish, at their own expense , compaction containers consisting in size of 30 yards or more and not less than 18 of such containers ; all of such containers and collection points shall be easily accessible to collector ' s vehicles without obstruction or impediment to such vehicles for loading and/or unloading purposes . 5 . All of such containers shall at all times be maintained in a good and serviceable condition ; damaged units shall be promptly replaced by the party owning such container and no industrial waste shall be placed therein that would damage or '!�am up" such container when same is unloaded . SUPPLEMENT TO EXHIBIT "A" The below specified rates and conditions are based on quantities of industrial waste of at least forty-five thousand (45 , 000) yards per year or more of loose measure or equivalent in combination of loose and compacted waste. Dumping fee under Item 1 below is paid for by the manufacturer separately and is no�t included in said rates , to-wit : 1 . $28. 15 per load of compacted industrial waste in customer furnished containers exclusive of "Dumping Fee" at Disposal facility. 2 . $1. 10 per cubic yard for industrial waste hauled to the Disposal facility, including "dumping fee" for all loose material , but in the event said dumping fees are modified or revised , then the aforesaid specified rate shall be adjusted accordingly. 3. $3 . 75 per cubic yard for industrial waste hauled to the Disposal facility, including "dumping fee" for " sand tubs" . 4 . The rates as specified above are based on the "by- products" (Industrial waste) of such qualifying manufactur- ing concerns , but shall exclude any material or substance which would damage or destroy contractor ' s containers ; such containers and collection points shall be easily accessible to contractor` s vehicles without obstruction or impediment to such vehicles for loading and/or unloading purposes . - 6 - � �• : ( . .. , . . � • ... � , d ' ♦ ' • • . 5 . SECTION II : Any and aIl ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION III : This Ordinance shall be effective on and after May l , 1973 and upon its passage , approval and five days after its publication, unless otherwise provided for hereinabove.
