' ' . . .. . , � , . t,. � ,� , .. .,. ___._ I • r t��e ���o CITY OF RENTON, WASHINGTON � ORDINANCE N0. 2��� AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON AMENDING CHAPTER 25 of TITLE I (ADMINISTRATIVE) OF ORDINANCE N0. 1628 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON" RELATING TO SICK LEAVE BENEFITS , PAYMENT THEREOF, AND MATTERS INCIDENTAL THERETO THE CITY COUNCIL OF THE CITY OF RENTON DO ORDAIN AS FOLLOWS : SECTION I : Subsection (A) of Section 1-2501 of Title I (Administrative) of Ordinance No. 1628 entitled "Code of General Ordinances of the City of Renton" is hereby amended to read as follows : Section 1-2501 (A) as amended. Each full time City employee , as hereinbelow defined, but excepting those employees who are members of and covered by the provisions of the "Washington Law Enforcement Officers and Firefighters Retirement System Act" , as amended, or such similar State Act relating to benefits for personnel of the City' s Police and Fire Departments , hereafter employed shall be entitled to sick leave , upon completion of their six months ' probationary period, at the rate of one (1) day per month , thus providing for a total annual sick leave benefit of twelve (12) days after completion of one year continuous service with the City. Such sick leave may be accumulated up to a total of one hundred twenty C120 ) days , and all the foregoing shall be subject to conditions and provisions of this Chapter. "Full time City employee" for the purposes of this Ordinance , shall be an employee regularly employed by the City of Renton and working not less than twenty (20 ) hours per week but shall exclude temporary, seasonal or part-time employees working less than twenty C20 ) hours per week. Ordaances of the City of Renton" is hereby amended to read as follows : Section 1-2501 CD) 2 as amended. Notwithstanding any prior City ordinance or resolution to the contrary, all qualified employees now or hereafter having inembership in the "Washington '� Law Enforcement Officers and Firefighters Retirement System Act" as amended, or any similar State Act relating to benefits for personnel of the City's Police and Fire Departments , hereafter { employed shall be entitled to receive sick leave benefits as provided by this Ordinance effective on and after January l , 1973 , as follows , to-wit : A. Each member of the Renton Fire Department working a twenty four (24) hour shift shall be entitled to and receive sick leave on the basis of one such shift per month , up to a maximum total accrual of seven shifts per annum, but any unused benefit in any one year may be carried over unto the following year, PROVIDED, HOWEVER, that in no event shall the maximum accrual exceed at any time s�ev.en ., (?._7,;); wo�king :Shiftsper annum. B. Each member of the Fire Department working an eight (8) hour work day shall accumulate sick leave benefits at the rate of one (1) working day per month , and such sick leave benefits may be acnumulated up to am�.ii�um of fifteen (15 ) working days per annums any unused benefit in any � one year may be carried over unto the following year; PROVIDED, HOWEVER, that in no event shall the maximum accrual exceed fif�teen C15) working days at any one time. �• Pursuant to said certain Contract by and between the City of Renton as employer, and Renton Fire Fighters Local No. 864 dated February 5 , 1973 , any and all sick leave benefits of every type and nature accrued by the members of said Local prior to January l , 1973 , - 2 - � � , � �- i rk � • � • . . ' � r t ' • ` ' i shall be duly computed and determined as of said date for each such I employee covered by this Agreement. The City , as employer, shall thereupon pay unto each such employee for such accrued sick leave benefits an amount equal to one-half C1/2) pay at the applicable straight time pay scale ,during the calendar year 1973 ; provided, however, such payment , in full liquidation of all prior sick leave i benefits , shall be contingent upon the City being . reimbursed by the City Firemen's Pension Fund at the time of such payment to the employee. In the event, however , that sueh reimbursement is not feasible , then thereupon payment shall be made unto such employee upon his retirement for "time in service"or voluntary separation from the City' s service I while an employee in good standing, and in any such case , payment to be made on the basis of one-half (1/2) days ' pay of the then applicable I pay scale in effect. 'I D• Effective January l , 1973 , each member of theR.enton Police Department shall accumulate sick leave benefits at the rate of one(1) working day per month, and such sick 1 leave benefits may be accumulated up to a maximum of I, fifteen (15) working days per annum , but any unused I benefit in any one year may be carried over unto the - following year� pROVIDED, HOGdEVER that in no event shall the maximum accrual exceed fifteeri, C15) working �, days at any one time. E. The accrual of all sick leave benefits ,as defined in this Ordinance ,shall commence . upon completion of an , employee's six months probationary period,computed at the rate of one day per month thus providing for a total annual sick leave benefit of I2 days after completion of one year continuous service with the City. F. Al1 sick leave benefits accrued by members of the Renton Police Department prior to January l, 1973 , in compliance with then applicable City ordinances , shall be duly computed and determined as of said date for each employee thereof. The total amount - 3 - ._ .� - . • ' . . _ ` • � 4 � so determined shall then be paid to such employee, earned prior to January 1, 1973, in cash, at the rate of one-half (1/2) of the then applicable ; straight time pay scale in affect at the time of the employee' s retirement or termination of employment I while an employee in good standing. In the event, however, that sick leave and/or disability benefits are reduced under the presently existing provisions of the "Washington Law Enforcement Officers and Firefighters Retirement System Act" , as amended, `then in any such event sick leave benefits theretofore a' accrued or thereafter accruing shall be immediately reinstated to such employee' s benefits, pro tanto, and such benefits shall be payable in accordance with this Section. G. No cash benefits shall be paid to any employee covered by this Chapter who separates or is separated from the employ of the City other than for retirement or termination of employement while in good standing. SECTION III: The City Clerk or such other City employee as designated by the Director of Finance shall be responsible for keeping and maintaining an up-to-date, uniform system of sick leave records, as provided in this Chapter, for each such employee of the City, and copies thereof may be furnished unto such employee, upon request, at all reasonable times. SECTION IV: No accrual of sick leave benefits as defined in this Chapter shall be permitted to any employee who has applied for or has been granted "disability leave" or "disability retirement" - 4 - • , • °- • ,, • . - ' . . + ' • � . � � under the provisions of the "Washington Law Enforcement Officers and Firefighters Retirement System Act" , as amended, or any similar I State Act relating to benefits for personnel of the City' s Police and Fire Departments , and who is no longer in active service with the City by reason of such "disability leave or retirement" for a period of six (6) months or more , and is receiving his �y salary or substantially equal .:�benefits during such period. In the event , however, such employee is returned to full active duty status with the City prior to the expiration of said six (6 ) months period, and /prior to any final disability retirement , and thereafter continues - II to perform his regular duties for the City , then such sick leave benefits shall again accrue to such employee ' s benefits effective as of the date of his return to full active duty status . SECTION V: Any employee covered by the provisions of the "Washington Law Enforcement Officers and Firefighters Retirement System Act" , as amended, or any similar State Act relating to benefits for personnel of the City' s Police and Fire Departments , shall, in case of illness or disability, initially exhaust any and all sick leave benefits to which such employee is entitled under the provisions of ' maximum this Chapter, to the extent of such permissible/accumulation, prior to applying or rec�iving any benefits under any "disability leave" and�or "retirement leave" provisions as set forth in RCW 41. 26 . et seq. SECTION VI : The City hereby reaffirms its previously established policy that under no circumstances shall a City employee receive dual or overlapping benefits derived or payable from both City and State funds while sick, injured or disabled, for the same or substantially the same period of time while so sick, incapacitated or injured. �, - 5 - � , � ,r � � . . ' • ' � . . w � � ,� • f' , SECTION VII : Each City employee :.as defined in Section 1-2501 (A) (but excluding all members covered by the "WAshington Law Enforcement Officers and Firefighters Retirement System Act" ; as �amended, or such similar State Act relating to benefits for personnel of the City' s Police and Fire Departments) shall upon li his retirement for "time in service" as provided by law , or upon his voluntary separation while an employee in good standing, receive a cash amount which shall be equal to one-half (1J2) day' s pay for the position or grade last permanently held by such employee for each day of accumulated sick leave then standing in such employee' s credit on the records of the City of Renton. SECTION VIII : Any and all ordinances , or parts of ordinances , I in conflict herewith are hereby repealed, including Sections DC2) , D (3) , D (4) , E (1) and E (2) of Section 1-2501 of Title I (Administrative) �! of Ordinance �No. 1628 entitled "Co:de: �of Ge�ieral Ordinaces of the City of Renton" . SECTION IX: This ordinance shall be effective , retroactively, as of January l , 1973 , and thereafter, and upon its passage , approval �, and publication. This ordinance is passed by a majority plus one of the whole membership of the Council and is necessary for the protection of the public health, public safety and morals .
