ORDINANCE N0. 2806
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
� ORDERING THE CONSTRUCTION AND INSTALLATION OF
WATER MAINS , HYDRANTS AND APPURTENANCES THERETO
IN THE VICINITY OF STEVENS�N':W. 'AND � TAYLOR N. W.
ON N. W. 2ND STREET '
RENTON, KING COUNTY, WASHINGTON, ALL IN ACCORDANCE
WITH RESOLUTION N0. 1874 OF THE CITY COUNCIL OF THE
CITY OF RENTON, WASHINGTON ; ESTABLISHING LOCAL
IMPROVEMENT DISTRICT N0. 281 , PROVIDING THE METHOD
• OF ASSESSMENT IN SAID DISTRICT; PROVIDING THAT
PAYMENT FOR SAID IMPROVEMENT BE MADE BY SPECIAL
ASSESSMENTS UPON PROPERTY ZN SAID DISTRICT, PAYABLE
BY THE MODE OF "PAYMENT OF BONDS" , OR "NOTES" IN
LIEU THEREOF AS DETERMINED BY THE CITY COUNCIL;
PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL
IMPROVEMENT DISTRICT WARRANTS REDEEMABLE IN CASH
AND LOCAL IMPROVEMENT DISTRICT BONDS OR NOTES
WHEREAS by Resolution No. 1874 passed and approved ori-September 10,
1973 , the City Council of the City of Renton declared its intention to
construct and install certain water mains , hydrants and appurtenances
thereto
within certain territory in the vicinity of Stevens N.W. and Taylor
N. W. on N. W. 2nd Street (a portion of said area being located outside
the City limits as hereinbelow set forth)
as hereinafter more particularly described, and fixed the lst day
of October , 1973 in the City Council Chambers in the City Hall ,
Renton , Washington, as the time and place for hearing all matters
relating to said improvements and all objections thereto and for
determining the method of payment for said improvements , and

WHEREAS x���x���������� has caused an estimate to be
made of the cost and expense of the proposed improvement and has
certified said estimate to the City Council , together with all papers ,
data, and information in his possession relating to the proposed
improvement , description of the boundaries of the District , a statement
of what portion of the cost and expense should be borne by the
pr,o,perties within the proposed District , a statement in detail of
the Local Improvement assessment outstanding or unpaid against the
property in the proposed District , and a statement of the aggregate
actual valuation of the real estate , including 25% of the actual

WHEREAS said estimate i� accompanied by a diagram of the �

�hereof to be borne by each lot, tract and parcel of land or other (
property within said District; and �

BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
RENTON, WA5HINGTON, AS F4LLOWS:
SECTIQN I: The following water mains , hydrants and
appurtenances thereto
shall be canstructed and installed in the vicinity af Stevens N. W. �
and Taylar N. W. on N. W. -2nd S�reet �partially located inside Renton,
lfi.ng County, Washington and par�ially located outside said city limits)
Renton, King County, Washington, as mare particularly described a� per

and there sha11 be included in the foregoing the acquisition and .

cauplings , connection equipment and appurtenances , together with
the acquisition of any easements , rights of way and land tha� may
be required; and there shall be a.ncluded the perfarmance of such '
work as may be incidenta3. and nec�ssary to the faregaing constructic,n
and instal3.ation.
The City Council may modify �he details o�" �he foregoing
described impravement where , �.n its judgment , it appears advisable , .
provided such modifi�ations da not substantially alter the plan of
said improvement. AlI af the foregoing sha31 be in accordance wi�h
the plans and specificatians therefor to be prepared by the City F's����•
Engineering Department .
SECTION IIe There is. hereby established and created a Lacal
Improvement Distriet to be called "Local �mpravement District No. 281 `
of the City of Rentan, Washa.ngton" , the boundaries of such Local
Improvemen� Di�trict being de�cribed as follaws� :

SECTION III : Th� �stimated cost and expense of said improvemer�t
is hereby declared to be approximately $ 12 , 605. 46 , The entire cost
and expense of said imp��ovement , including the cost and expense of
all engineering , legal , inspection , advertising, publication of
notices and other expenses incidental thereto, shall be borne by
and assessed against the property specially benefited by such
improvement included in the Local Improvement District No . 281
established , embracing , as near as may be , all property specially
benefited by such improvement.
SECTION IV : The nature of the improvement provided for herein
is such that the special benefits conferred upon the property are
fairly reflected by the use of the statutory termini and zone method
of assessment , and it is hereby provided and ordered that the assess-
ment shall be made against the pro�erty of the District in accordance
with said method. Al1 property included within the limits of the Local
Improvement District above created shall be considered to be the '.
;
property specially benefited by such Local Improvement and shall be
the property to be assessed to pay the cost and expense thereot as
hereinabove specified.
SECTION V : Local Improvement District warrants shall be issued
in payment of the cost and expense of the improvement herein ordered.
Such warrants shall be payable out of said "Local Improvement Fund ,
District No. 281 " , to bear interest from the date thereof at a rate to
be fixed hereafter but not to exceed 8 o per annum and to be
redeemed in cash , and!or by Local Improvement District bonds herein
authorized to be issued , said interest-bearing warrants to be here-
after referred to as "revenue warrants" . Such bonds shall bear
interest at a rate to be hereafter fixed but not exceeding 8 °�
per annum; shall be Fayable on or before twelve years from the date
of issuance , the life ��f the improvement ordered being nct less than
twelve years , and shall be issued in exchange for and in redemption of

any and all revenue warrants issued hereunder and not redeemed in cash
within a period not to exceed sixty days after the first publication
by theD���X r o� Finan�e
��� ��Z� o notice that the assessment roll for Local
Improvement District No. 281 is in his hands for collection. The
bonds shall be redeemed by the collection of special assessments to be
levied and assessed upon the property within said District , payable
in ten equal annual installments , with interest at a rate to be fixed
hereafter, but not exceeding 7 . 25 o per annum, under the mode of �
�
"Payment by bonds" or by "notes in lieu thereof" , as defined by law
and the ordinances of the City of Renton. In case of � default in the
payment of any assessment , when the same shall become due , there
shall be added interest at a rate to be hereafter fixed but not to
exceed 8 % per annum, and a penalty of 8 o which shall also be
collected. The exact form, amount , date , interest rate and denomination
� of said warrants and bonds shall be hereafter fixed by Ordinance of
the City Council.
SECTION VI : All the work necessary to be done in connection
with the making of said improvements shall be done by and made by
contract upon competitive bids and the City shall have and reserves
the right to reject any and all bids . The call for bids for work
authorized pursuant to this Ordinance shall include a statement that
payment for said work will be made in cash warrants drawn upon the
"Local Improvement Fund , District No. 281 " . I

SECTION VII : There is hereby created and established in the
Director of Finance

Improvement District No. 2gl , a special fund to be known and
designated as "Local Improvement Fund , District No. 281 " , into
which fund shall be deposited the proceeds from the sale of revenue
warrants drawn against said fund which may be issued and sold by
the City and collections pertaining to assessment , and against which
fund shall be issued cash warrants for the contractor or contractors
in payment for the work to be done by them in connection with said

improvement , and against which fund cash warrants shall be issued
in payment of all other items of expense in connection with said
improvement.

SECTION VIII : The ��x�a��ae is hereby authorized and
directed t� call for bids , in the manner provided by law, for the
construction and installation of the improvements authorized herein.
� SECTION IX : The City reserves the right to issue , in lieu of
bonds and warrants in payment of the cost and expense of the aforesaid
Local Improvement District ,installment note or notes payable out of
tr�e Local Improvement District Fund, pursuant to RCW 35 . 45 . 150 ,
whenever such note or notes are sold exclusively to another fund of
the City as an investment thereof, and as further provided by law.
Such installment note or notes may be issued any time after a
thirty-day period allowed by law for the payment of assessments of
said District without penalty or interest , and such note or notes
may be of any denomination or denominations , the aggregate of which
shall represent the balance of the cost and expense of the Local
Improvement District which is to be borne by the property owners
therein, and as further provided by law.

The boundaries of the Local Improvement District are hereinbelow
set forth to-wit:
a. Portion of Local Improvement District located within
City limits :
All of that portion of Latimers NH Lake Washington Plat
as recorded in Volume 6 Page 70 of Plats records of King
County , 4lashington - described as follows :
Beginning at the S.W. corner of Block 58 of said plat ,
thence north along the west line said Block 58 , 120
feet; thence east 200 feet to the west line Block 58 ,
thence south along said east line 30 feet; thence east
320 feet to the west line block 60 of said Plat; thence
north along said west line 10 feet, thence east 1.00 feet ,
thence south 1Q0 feet to the south line block 60 , thence
west along the south lines of Blocks 60 , 59 and 58 of
said plat 620 feet to the point of beginning .
b . Portion of Local Improvement District located outside
the City Limits : �
All that portion of Earlington Acre Tracts as recorded
in Volume 15 , Page 84 of Plats records of King County
described as follows :
Beginning at the N.E . corner of tract 5 , block 30 of said I�
plat, thence south along the east line of tract 5 120
feet , thence west parallel to and 120 feet south of the
north line block 30 , 600 feet to the west line tract 10
of said block 30 , thence north along said west line 120
feet, to the north line block 30 , thence east along
said north line 600 feet to the point of beginning
together with that portion of S . 132nd Street adjacent.
