HomeMy WebLinkAboutORD 2818 ., � ' - ��)i�,�,i L(,�� �,��?G� ����/� � - ; ;. �" ,. � � Amended by ORD 4462 CITY OP RENTON, WASHINGTON , ORDINANCE N0 . 2glg AN ORDINANCE OF THE CITY OF .RENTON , WASHINGTON, AMENDING SECTION 6-116 OF TITLE VI (POLICE REGULATIONS) OF ORDINANCE N0 . 1628 ENTITLED rrCODE OF GENERAL ORDINANCES OF THE CITY OF RENTON'� RELATING TO THE PUBLIC SAFETY AND MO RAL S THE CITY COUNCIL OF THE CITY OF RENTON DO ORDAIN AS FOLLOWS : SECTION I : Section 6-116 of Title VI (Police Regulations) of Ordinance No . 1628 entitled "Code of General Ordinances of the City of Renton" is hereby amended to read as follows : 6-116 (1) It shall be unlawful for every person: a. Having knowledge of the contents of any obscene film, publication, performance and other written or graphic matter to exhi.bit, sell, distribute, display for sale or distribution, or having =knowledge of the contents thereof to have in his or her possession with the intent to sell or di.stribute any book, magazine , pamphlet, comic book, newspaper, writing, photograph, motion picture film, phonograph record, tape or wire recording , picture, drawing, figure , image or any object or thing which is obscene ; or b. Having knowledge of the contents thereof to cause to be performed or exhibited or to engage in the performance or exhibition of any show, act, play, dance, or motion picture which is obscene. I 6-116 (2) OBSCENE - - DEFINITION� For the purpose of this or Section, the term "obscene" shall be defined as mate.rial/ acts which, in sex taken as a whole, appeal to the prurient interest/of the average person upori application of contemporary community standards which portray sexual conduct in a patently offensive way, and which, taken as a whole ' do not have serious literary , artistic, political, or scientific value. ' -1- I� y , ,� ' �, . - . � � � �a , � .. The term "community standard" shall mean� . the standard within the State of[ngshi.ngton. Obscene material or acts shall be deemed to include: a. Patently offensive representations or descripti.ons of ultimate sexual acts , normal or perverted, actual or simulated, including those between humans and animals ; � b. Patently offensive representations or descriptions of masturbation, fellatio, cunnilingus , excretory functions , and lewd exhibition of the genitals . 6-116 (3 ) VIOLATION -- PENALTY Each day's exhibition, display, distributinn, or possession of any material in violation of this Section shall be deemed a separate and distinct offense, and except as otherwise specified, any person convicted of a violation of thi,s Section shall be fined a sum not less than $100 . 00 nor more than $500 . 00 or imprisoned in the City Jail for a period not exceeding ninety (90) days , or by both such fine and imprisonment for each day's violati.on. SECTION II ; Any and all Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
