HomeMy WebLinkAboutORD 2839 � � � � � . .y �� . � � , � .,.. . . � �..-..__... � CITY OP RENTON, WASHINGTON ORDINANCE NQ . 2839 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON , APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0 . 279 �'OR THE IMPROVEMENT 0�' A C�RTAIN AREA IN THE VICINITY OF SPRINGBROOK ROAD _ AND RELOCATED BENSON HIGHWAY 515 RENTON , KING COUNTY , WASHINGTON BY THE CONSTRUCTION AND INSTALLATION OF CERTAIN SANITARY SEWER LINES AND APPURTENANCES THERETO ; BY DOING ALL WO�K NECE��ARY IN CONNECTION THEREWITH; LE�IYING AND ASSESSING THE AMGUNTS THEREFOR AGAINST THE SEVERALL�TS , TRACTS , PARCELS OF LAND AND OTHER PROPERTY ' AS SHOWN ON SAID ASSESSMENT RO.LL AS CONFIRMED BY THE CITY COUNCIL; AND PROVIDING �OR THE PAYMENT OF SUCH ASSESSMENTS INTO THE LOCAL IMPROVEMENT FUND, DISTRICT N0 . 279 OF THE CITY OF RENTON , WASHINGTON AS CREATED BY ORDINANCE N0 . 2782 . I WHEREAS the assessment roll levying -the special assessment � against the property located in �Local Improvement District No . 279 located in the vicini.ty of S�ringbrook Road and relocated Benson Highway (SR 515) Renton, King County, Washington , as created under Ordinance No . 2782 , has been filed with the City Clerk of the City of Renton by the Director of Public Works , as provided by law, and , WHEREAS due notice of the time and place of hearing thereon and making objections and protests to said roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for � Mfi.-rch 4 , 1974 at the hour of 8 : 00 o ' clock P.M. in the City Council Chambers , City Hall, Renton, Washington and notice thereof was duly mailed by the City Clerk to each property owner shown on said roll as provided by law and as further specified in RCW 35 .44. 090 , and said hearing having been duly held as aforesaid, and WHEREAS at the time and place fixed and designated in said notice, said hearing on said assessment roll resulted in the tollowing -1- � • ♦ �� ' ` l • protests and/or objections as received by the City Clerk prior to , at and during said hearing , to-wit: I NAME OF PROTESTING PARTY ADDRESS LEGAL DESCRIPTION I' Frank Nakanishi 17015 Springbrook Rd. LESS Roads. and the City Council having duly considered said assessment roll and the written protests and objections filed in connection therewith, as aforestated , and having duly overruled �d protest of 5.314°0 and the City Council sitting and acting as a Board of Equalization j far the purpose � considering the roll, benefits to be received by each lot , parcel and tract of land shown upon said roll, including the increase and enhancement of the fair market value o� each such parcel of land by reason of said improvement; NOW THEREFORE , THE CZTY COUNCIL OF THE CITY OF RENTON , WASHINGTON, DO ORDAIN AS FOLLOWS : SECTION I : That the assessments and assessment roll of Local Improvement District No . 279 which has been creat�ed and established for the purpose of paying the cost of constructing and installing certai,n sanitary sewer lines and all appurtenances thereto in that certain area in the vicinity of Springbrook Road and relocated Benson Highway (SR 515) , Renton, King County, Washington, and all -2- � � as more particularly described in Ordinance No . 2782 , further reference hereby had thereto and all in accordance with said Ordinance, be and the same is hereby in all things approved and confirmed so that the total amount of the assessments and assessment roll of said Local Improvement District is in the sum of $ 57 ,088. 14 . SECTION II : That each of the lots, tracts , parcels of land and other property shown upan said assessment roll is hereby determined and declared to be specially benefited by said improvement in at least the amount charged against the same , and the assessments appearing against the same are in �roporti.on to the several assessments appearing upon said roll. There is hereby levied and assessed against each lot, tract or parcel of land, or other property appearing upon said roll, the amount finally charged against the same thereon. SECTION III : That the assessment roll as approved and confirmed shall be �iled w�th the Directar of Finance for collection and said Director of �inance is hereby authorized and directed to publish notice as required by law, stating that said roll is in her hands for collection and that payment o� any assessment therenn or any portzon of said assessment can be made at any time within thirty days �rom date of first �blic��on of said notice, without penalty, inte�est or cost , and that thereafter the sum remaining unpaid, may '' be paid in ten equal annual installments with interest thereon hereby fixed at the rate of 7 per cent per annum. The fixst installment of assessment on said assessment roll shall become due and payable during the thirty day period succeeding the date one year after the date of first publication by the Director of Finance of notice that the assessment roll is in her hands for collection and annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessment remains -3- � ��� . 1 . . , ' , . . _ . unpaid after the first thirty day period-, interest upon the whole unpaid sum shall be charged at the rate of 7 per cent per annum and each year thereafter one of said installments , together with interest due on the whole of the unpaid balance , shall be collected. Any installment not paid prior to expiration of the said 30 day period during which said installment is due and payable shall thereu�on become delinquent . All delinquent installments shall be subject to a charge of interest at 7 per cent per annum and for , an additional charge of 8 per cent penalty levied upon both principal and interest due upon such installment or installments . The collection of such delinquent installments shall be enforced in the manner provided by law. SECTION IV: All of such assessments or installments thereof, � and interest and penalty , a.f any "thereon, when collected by the Director of Finance shall be paid into the Local Improvement Fund, Distri.ct No . 279 , of the City of Renton as created by said Ordin.ance No . 2782 , and shall be used solely for the purpose of paying the � rinc' al and interest on the warrants and bonds drawn u on or issued � �-P P against said Fund , or in case no bonds have been issued, then in paymentc� any installm.ent note or notes as provided for in RCW 35 . 45 . 150 , as may be determined by the City Council of the City . o� Renton. � - -4- , • • ,� � ~. 1t � . � .
