HomeMy WebLinkAboutORD 2918 � , ; , i � ;. a � ��• � . •,� �,;.,. . �r .;. �, .. , , �' . � ' �, ' ORDIr1ANCE NO. 2918 AN ORDINANCE OF THE CITY OF RENTON, WASHIDIGT�N, ORDERING THE GONSTRUCTIOI3 AND INSTALLATION OF CERTAIN STREET IMPROVEMENTS INCLUDING ST��� SEWERS , UNDERGROUND �������X POWER CONVERSION, SIDEWALKS , CURBS , GUTTERS , AND CERTAIN ASPHALT OVERLAY AND PAVING IN THE VICINITY OF CEDAR AVENUE , RENTON HILL AREA, RENTON, KING COUNTY, WASHINGTON, ALL IN ACCORD- ANCE WITH RESOLUTION N0. 1956 OF THE CITY COUNCIL OF THE CITY OF RENTON, WASHING�ON; ESTABI�ISHING LOCAL IMPROVEMENT DISTRTCT NO. 293 PROVIDING THE METHOD OF ASSE5SMENT IN SATD DISTRICT; PROVIDING THAT PAYMENT FOR SAID IMPROVEMENT BE MADE BY SPECIAI, ASSESSMENTS UPON PROPERTY IN SAID DISTRICT, PAYABLE BY THE MG�E OF "PAYMENT OF BOI�TDS" , OR "?�TOTES" IN LIEU THEREOF AS DETERI�IINED BY THE CITY COUNCIL; PROVIDING FOR THE ISSUANCE AND SALE OF LOC'AL IP�iPROVEMENT DISTRICT WARRAi3TS REDEEMABLE IN CASH AND LOCAL IMPROVEMEI�]T DISTRICT BONDS OR NOTES. WHEREAS by Resolution No. 1956 passed and approved on January 27 , 1975 , the City Council of the City of Renton declared its intention to construct and install certain street improvements including storm sewers , underground power conversion , sidewalks , curbs , gutters , and certain asphalt overlay and paving within certain territory in the vicinity of Cedar Avenue , Renton Hill Area, Renton, King County , Washington, as hereinafter more particularly described, and fixed the 24 day of February , 1975 in the City Council Chambers in the Municipal Building, Renton, Washington, as the time and place for hearing all matters relating to said improvements and all objections thereto and for determinzng the method of payment for said improvements , and WHEREAS the Director of Public Works has caused an esti- ', mate to be made of the cost and expense of the proposed improve- ment and has certified said estimate to the City Council, to- � gether with all papers, data, and information in his possession relating tn the proposed improvement, description of the boundaries of the District, a statement of what portion of the cost and expense should be borne by the properties within the proposed District, a statement in detail of the Local Improvement assess- ment outstanding or unpaid against the property in the proposed District, and a statement of the aggregate actual valuation of the real estate, including 25°s of the actual valuation of the - Z - ' .. The entire cost and expense of said improvement, including the ' cost and expense of all engin��ring, legal, inspection, adver- tising, publication of notices and other expenses incidental � thereto, shal� be borne by and assessed against the property specially benefite� by such in��rovement included in the Local Improveznent District No. 293 established, embracing, as neax° as ina� beo all pra�er�y speci��.�� ;��r�2tited by such improvement. , SECTION IV: The nature of th� improvement provided for ' herein is such that the special benefits conferred upon the property are fairly reflected by the use of the �ront foot method of assessment, and it is hereby provided and ordered that the assessment shall be made against the prop- , erty of the District in accordance with said methods. All property included within the limits of the Local Improvement District above createc� shall be considered to be the property specially benefited by such Local Improvement and shall be the property to be assessed to pay the cost and expense thereof as hereinabove specified. SECTION V: Lacal Improvement District warrants shall be issued in �ayment of the c�st and expense of the improve- ment herein ordered. Such warrants shall be payable out of said "Local Improvement Fund, District No. 293 " , to bear interest from the date thereof at a rate to be fixed hereafter, but not to exceed 8 $ per annum and to be redeemed in cash, and/or by Local Imgrovement District bonds herein authorized to be issued, said interest-bearing warrants to be hereafter referred to as "revenue warrants" . Such bonds shall bear interest at a rate to be hereafter fixed but not exceeding lo � per annum; i shall be payable on or before twelve�12) years from the date of � issuance, the life of the improvement ordered being not less than ten (10.)� years, and shall be issued in exchange for and in - 4 - • ,` . ` , 1 • I . '-�'. ,�, . . � , redemption of any and all revenue warrants issued hereunder and I not redeemed in cash within a period not to exceed sixty days after the first publication by the Director of Finance of � notice that the assessment roll for LocaZ Improvement District No. 293 is in his hands for collection. The bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property �aithin said District, payable in lo equal � installments, with interest at a rate to be fixed hereafter but not exceeding 8 � per annum, and a penalty of lo $ which shall also be collected. The exact form, amount, da�e, interest rate and denomination of said warrants and bonds shall be here- after fixed by Orciinance of the City Counail. SECTION VI: �11 �he work necessary to be done in con�ec- tion with the making of said improvements shall be done by and made by cont�act upon competitive bids and the City shall have and reserves the right to reject any and all bids. The call for bids for work authorized pursuant to this Ordinance shall include a statement that payment for said work will be made in cash warrants drawn upon the "Local Improvement Fund, District No. 293 " . � SECTION VII: There is hereby created and established in the Finance Director' s Office of the City of Renton, for Local Improvement District No. 293 , a special fund to be known and designated as "Local Improvement Fund, District No. 293 " , into which fund shall be deposited the proceeds from the sale of reve- nue warrants drawn agaix�st said fund which may be issued and sold by the City and collec�ions pertaining to assessment, and against which fund shall he �ssued cash warrants for the contractor or contractors in pay�erat for the work to be done by them in connec- tion with said improvement, and against which fund cash warrants shall be issued in payment of all other items of expense in connec- tion with said improvement. - 5 - � , , 't ' , , . .. • �i- ��Q . . . SECTION VIII : The Director of Public Wo�ks is hereby authorized and directed to call for bids, in f�h� manner provided by law, for the construction a�icf installation of the improvements authorized herein. SECTION IX: The City reserves the right to is�ue, in lieu of bonds and warrants in payment of the cost and expense of the aforesaid Local Improvement: District, installment note or notes payable out of the Local Improvement District Fund, pur- suant to RCW 35. 45.s50, whenever suck� n�te or notes are sold exclusively to another fund of �he City as an investment thereof, and as further provided by law. Such installment note or notes may be issued any time after a thirty-day period allowed by law �ar �he payment of assessments of said District without penalty or interest, and sz�ch note or notes may be of any denom,�nation or denominations , the aggregate of which shall represen4 the balance of the cost and expense of the Local Improvement District b,rhich is to be borne by the p�r,perty owners therein, and .�s further provided by law.
