HomeMy WebLinkAboutRES 1408 CnVK31NAL RESOLUTION No. WHEREAS the CITY OF 2ENTON, a Municipal Corporation, is the grantee and holder of a certain easement heretofore granted by FRANK BDNNELL, Sr. , now deceased, and recorded in volume 4196 of Deeds, page 568, Records of King County Auditor, des- cribed as follows: PARCEL A An easement twenty feet in width, 10 feet on each side of center- line: Beginning at a point S 1°35'30" W, 590 feet from the quarter corner between Section 18 and 19, T 23 N, R5E, W.M. , said point being on the centerline of Section 19 thence N 89°10'15" W, 865.8 feet, parallel to the N line of Section 19, thence S 1°35'30" W, ten feet east of and parallel to the centerline of 89th Ave. South extended, to the north right-of-way line of the Northern Pacific Railway Co. All located in Renton, King County, 1'7ashington and , WHEREAS the present owners of the property on which above easement is located requested the relocation of same for the purpose of relocating certain water mains, and WHEREAS said relocation has been completed and said owners have heretofore conveyed unto the City their easement pertaining to said relocated facilities over, unto and across the following described property, to-wit: PARCEL B An Easement 20 feet in width, 10 feet on each side of the following described centerline: Beginning at a point south 0°48'15" west 590 feet from the quarter corner between Sections 18 and 19, Township 23 North, Range 5 East, W.M. , said point being on the centerline of Section 19; thence North 88°26 ' west 20 feet, more or less, to the westerly margin of 92nd Avenue South and the true point of beginning; thence continuing North 88°26' west, 429 feet; thence south 1°12 ' west, 319.10 feet; thence south 74°14' west, 256.90 feet; thence north 1°13'20" east 224.90 feet; Together with an easement 20 feet in width, 10 feet of each side of the following described centerline: Beginning at the termination of the centerline of the previously des- cribed easement; thence south 1°13'20" west 224.90 feet to the true point of beginning; thence south 74°14' west 184.00 feet; thence south 1°47' west 40.55 feet to the northerly margin of the Northern Pacific Railroad Company right-of-way All located in Renton, King County Washington and, WHEREAS it is in the public interest to vacate the easement first above here- in described (Parcel A) , and the same being superseded by the revised easement as des- - 1 - cribed hereabove (Parcel B), NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTO N AS FOLLOWS: SECTION I: The above facts and recitals are hereby found to be true and correct in all respects and the CITY OF RENTON hereby accepts the easement as des- cribed in parcel B hereinabove. SECTION II: The easement hereinabove described (Parcel A) be and the same is hereby relinquished and vacated in all respects in favor of the estate of FRANK DONNELL, Sr. , now deceased, his heirs and distributees, and the Mayor and City Clerk are hereby authorized to execute any instrument reasonably necessary to evidence such relinquishment and vacation.
