Shellan, Cfty Attorneq � ; ,n �_ , , . �, � � � A , � I MUTUAL FIRE FIG1iTING ASSISTANCE AGREEMENT G. � � ���0�� 7 THIS AGREEMENT, m�de and entered into this �_�p£i1 .�„ I9�7 by City of Kent , a Municipal Corporation, YCing County, Washington, and Citv of RPnt�n King County, Washin�ton; WITNESSETHs WHEREAS, each of the parties hereto maintains equipment and pe�sonnel for the suppression of fires within its own jurisdfction and areas, and WHEREAS, the parties hex�eto desire to augment the fire protection avaiLable in their various establishments, distric�s, agencies, and municipalities in the event of large fires or conflagratfons, and WHEREAS, the lands or districts of the parties her�to are adjacent or contiguous so that mutual assistance in a fire emergency is deezned feasible and , WHEREAS, it is the policy of the above municipalities or other , districts and of their governing bodies to conclude su�h agreements , wherever practicable, and desirable racticable and WHEREAS it is mutuall deemed sound, , p , � y beneficial for the parties to this agreement to render. assistance �o one another in accordance with these terms: THEREFO RE BE IT AGREED THAT: 1. Whenever it is deemed advisable by the commanding officer of a fire department belonging to a party to this agreement, or by the commanding officer of any such fire department actually present at any fire, to request fire fighting assistance under the terms of this agreement, he is authorized to do so, and the commanding officer of the department receiving the request, or his authorized subordinates, shall forthwith take the following action: a. I�nediately determine if apparatus and personnel can be spared in response to the call. b. What apparatus and personnel might most effectively be dispatched. c. The exact mission to be assigned in accordance with the detailed plans and procedures of operation drawn in accordance with this agreement by the techni�.al heads of the fire department concerned. d. Forthwith dispatch such apparatus and personnel as, in the judgment of the responsible officer receiving the call should be sent, with complete instructions as to the mission, in accordance with the terms of thfs agreement. e. The rendering af assistance under th� terms of this a�reement shall not be man�iatory, but the party receiving the request for assistance should immediat�ly infarm th� requesting a�ency if, for any reason, assistance I cannot be r�nd�reci. 3. Each party agrees to ' assume a21 4� its Iasses and dan�a�;e, both to persanal praperty and to persannel, '� arising aut a£ the gerformance of this t�greement. It being agreed and under- stood that whenever a firernan enga�es in any duty outside the limits of his I employing municipality, such duties shall be considered a part of his duty I as a fireman for said municipality, and a fireman who is injured while engaged in such duties outside the I.imits ot his own employing municipality, shall be entitled to the same benefits that he or his family would be i entitleci to receive, had h� been injured t�rithin the service of his own municipality. 4. The comzr,anding affic�� of the fire degartment requestin� assistance I shall assume full eharge o£ the ape�aticsns, but if he specifically ', requests a seniar otficer af ,� fire depelCtTT1?T�IL. f�rnishing assistance ta I assume command, he shall not, by relinquishin� command, be relieved of his responsibtliCy for the operation; provided, that the apgaratus, persannel i and equipment of the agency rendering a assistance shall be under the i immediate supervision of and shall be the immediate responsibility of the , senior responding fire afficer or the cammanding officer of the department ' rendering assistance. I ' S. The chief fire officers and personnel af the fire departrnents of both I , parties to this ag�eement are invited and encoura�ed, on a recipracal basis, tc frequently visit each other�s activities for guided familiarizati.on taurs consistent with local security requirements and as feasib2e, ta jointly I conduct pre-fi�°e plannin�; inspections and drills> 6. The cammanding pfficers af the fire departments af the parties to this agreement are authorized to meet and draft any deta3led plans and procedures of operation necessary ta effectively implement this agr�ement. Such plans and procedures of operations shall become effective upon ratification by the signatory parties. 7. This a�reement shaZl hecome effectzve upon the date hereaf and shall remain in full farce and effect untfl cancelled by mutual agreement of the parties hereto or by wrftten notice by one garty to the ather garty, g3ving ten (10) days notice of said cancellation.
