AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
AMENDING A PORTION OF SECTION 9-1204 OF TITLE IX
(PUBLIC WAYS AND PROPERTY) AND SECTION 1-4101
(ADMINISTRATIVE) OF ORDINANCE N0. 1628 ENTITLED
"CODE OF GENERAL ORDINANCES OF THE CITY OF
RENTON" ESTABLISHI�G FEES FOR USE OF FXCESS
PU.BLIC RIGHT OF WAY .AND AMENDING THE FEE SCHEDULE
ORDINANCE TO REFLECT T�E NEW FEES
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS
FOLLOWS:
�ECTION I: Existing Section 9-1204 of Title IX (Public Ways and
Property) of Ordinance No. 1628 entitled "Code of General Ordinances of
the City of Renton" is hereby amended as follows:
Section 9-1204, as amended: FEE DETERMINED: When an application is
approved, the Board shall determine a non-r�fundable fee as established
by ordinance for the temporary use of the right-of-way. The fee shall be
determined as follows:
A. For single family or two family residential uses, the fee shall
be $10. 00 annually, plus leasehold �xcise tax, if applicable.
B. For other uses wherP ther� is no public benefit, the fee sha11
be equivalent t4 one-half of �ne percent (0. 5� ) per month of the value of
the land to be utilized, plus leaseholc� excise tax, if applicable,
payable yearly in advance. Right-of-way valu� shall be based on the
assessed value of the lan� adjoining the property as established by Kin�
County Assessor.
C. For other uses where there is public benefit, the fee shall be
equival�nt to one-half of one percent (0. 5$ ) per year of the assessed

value of th� land adjoining the property, plus leasehold excise tax, if
applicable, but in no case less than $10 . 00 , payable yearly in advancP.
D. A no fee permit may be issued Qnly when the applicant is a
public agency and when the proposed use of the right-of-way consists of
the pr�vision of a direct service to the public (�.g. METRO applications
for right-of-way for bus shelters. ) .
E. There is also hereby imposed a leasehold excise tax against fees
so determined which are $250. 00 per annum or more. Such tax shall be
imposed at the rate as �stablished by the State of Washington, Department
of Revenue.
SECTZON II : Existing Subsection 19 of Section 1-4101 of Title I
(Administrative) of Ordinance No. 1628 entitl�d "Code of �eneral
Ordinances oP the City of Renton" is hereby amended as follows:
Section 1-4101 (A) 19 , 3s amended: Excess Right-of-Way Permit Fee

SECTION III : This Ordinance sha11 be effective upon its passage,
approval and thirty days after publication.
