Home My WebLink AboutORD 3057 • � - • . • ` ' � + . � � ' � , .� , ' r • ,,• . . . . , � � f, CTTY OF RENTON, WASH�NGTON ORDINANCE N0. 305�7' AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, R�- APPROVING AND CONFIRMING THE ASSESSMENTS AND � ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRTCT N0. 291 FOR THE IMPROVEMENT OP A CERTAIN AREA ' TN THE VICINITY OF LAKE WASHTNGTON-MAY CREEK- KENNYDALE, RENTON, KING COUNTY, WASHINGTON BY CONSTRUCTION AND INSTALLATION OP WATER MASNS AND APPURTENANCES BY DOING ALL WORK NECESSARY IN CONrdECTION THERREWITH, LEVYING AND ASSESSING THE AMOUNTS THEREFOR AGAINST THE SEVERAL LOTS, TRACTS , PARCELS OF LAND AND OTHER PROPERTY AS SHOWN ON SATD ASSESSMENT ROLL AS CONFIRMED BY THE CITY COUNCIL; AND PROVIDTNG FOR THE PAYMENT OF SUCH ASSESSMENTS INTO THE LOCAL TMPROVEMENT FUND, DTSTRICT N0. 291 OF THE CITY OF RENTON, WASHINGTqN, AS CREATED BY , ORDINANCE N0. 2922 � WHEREAS the assessment roll levying the special assessment against the property located in Local Improvement District No. 291 generally described as an area in the vicinity. of Lake Wastbrigton- May Creek-Kennydale Area created under Ordinance No. 2922, dated March 24, 1975, has been filed with the City Clerk of the City of I Renton, Washington by the Director of Public Works , as provided by law; and WHEREAS due notice of the time and place of hearing thereon and m.aking objections and protests to said roll was duly published at and for the time and in the manner pr.ovided by. law, fixing the time and place of hearing thereon for June 21, 1976 , at the hour of 8 ; 00 P.M. in the City Council Chambers , City Hall, Renton, Washington, and due noti.ce thereof was timely mailed by the City Clerk to each � property owner shown on said roll as provided by law and as further specified in RCW 35 . 44. 090 and said hearing having beeri duly held as aforesaid; and WHEREAS at the time and place fixed and desa.gnated in �I said notice, said hearing on said assessment roll resulted in the I� following protests and/or o�jections , as received by the City Clerk -1- : ' , . . . , ' - . , � ` , . prior to, at and during said public hearing, to-wit: NAME OF �'ROTESTING PARTY ADDRESS LEGAL DESCRIPTION See Exhibit "A" attached hereto � and the City Council having duly considered and adjusted said assessment roll together with. .the written protests. and abj.ections aforesaid and having found that some o� the below specified properties are not presently specially benefited by said improvements and that same therefore �e deleted �rom the assessment roll; and the City Council sitting and acti,ng as a Board of Equalization for the purpose of considering the roll, benefits to be received by each lot, parcel and tract of Iand shown upon said roll, including the increase and enhancement of the fair market value of each such parcel of land by reason of said improve- merit; said described parcels of property, as described below, are therefore deleted and/or adjusted from the preserit assessment roll for the reason that said properties are presently be 'ing .served by a pre- existing water line constr.ucted in or about 1960 and owried and operated � by Wa+er District No. 107 ; provided, however, that said properties �hall be subject to the provisions of Section 3-241 of Title IZZ (Departments) of Ordinance No. 1628 entitled "Code of General Ordinances of the City of Renton" to-wit: NAME CF PROTE�STING PARTY ADDRESS LEGAL 'DESCRI.PTION See Exh'ibit 'rB'r attached hereto NOW THERE�'ORE , THE CITY COUNC�L OF THE CITY OF RENTON, WASHINGTON, DO ORDAZN AS �'OLLQWS : -2- .. .. - - . � � SECTTON 'I�:� � That .the asses:smerits and assessment roll of Lacal Improvement District No. 291 whi:ch has been created and establ.ished for the purpose of paying the cost of construction and installing certain water mains and appurtenances and all as more parti.cularly described in Ordinance No.. 2922 , .further refererice her.eby. had thereto, and all in accordance with said Ordinance, be and .the same is hereby in all things approved and confirmed so that the total amount of the assessments and assessment roll of said Local Impr.ovement District is in the sum of �4;02 ;;91'5•.•4-3'. SE"CT-ION �II:� That each of the lots , tracts , .parcels of land and .other property shown upon said assessment roll is hereby determined and declared to be specially benefited by said improvement I in at least .the amount .charged against the same, and the assessments ' appearing against the same are in proportion to the :several assessmerits appearing upon said roll. . There is hereby levied and assessed against each. lot,. .tract or parcel of land, or other property appearing upon said roll, the amount finally charged against th.e same thereon. S�ECTIO�N� �IT�I:� That .the assessmerit roll as approved and confirmed shall be filed with the Director of Finance for collecti.on and said Director of Finance is hereby authorized and directed to ' publish notice as required by law, stating that said roll is in her hands for aollection and that paymerit of any assessment thereon or any gortion of said assessment can be made .at any time with�:n I thirty days �rom date of first publication of saa.d notice, with:out perialty, interest or cost,. and that thereafter .the :sum remaining unpaid, may be paid in severiteen equal annual installments with interest thereon hereby fa.xed at :the rate of 7. 3/4 .per cent per annum. The first installment of assessment on said assessment roll shall become due and payable during the thirty. day period succeeding - '3- the date one year after the date of first publication by the Director of Pinance of notice that the assessment roll is in her hands for collection and annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessment remain unpaid after. th.e first 30 day period, interest upon the whole unpaid sum shall be charged at the rate of 7 3/4 per cent per annum and each year thereafter one � of said installments , together with interest due on the whole of the unpaid balance, shall be collected. Any installment not paid prior to expiration o� the said 30 day period during which installment � is due and payable shall thereupon become delinquent. All delinquent � installments shall be subject to a charge of interest at 7 3/4 per '�, cent per annum and for an additional charge of 8 3/4 � per cent penalty levied upon both principal and ' interest due upon such installment or installments . The collection of such delinquent installments shall be enforced in the manner provided by law. SECTION IV: All of such assessments ar installments thereof, and interest and penalty, if any thereon, when collected by the Director of �inance shall be paid into the Local Improvement Fund, District No. 291, of the City of Renton as nreated by said ' Ordinance No. 2922, and shall be used solely for the purpose of paying !i the principal and interest on the warrants and bonds drawn upon or issued against said Fund, or i.n case no bonds have been issued, then in paymerit of any installment note or notes as provided for ' in RCW 35. 45..150 , as may _be determined by the City �Council of the City of Renton. , , SECTION V: This Ordinance shall be effeetive upori its passage, appraval and five days after its publication, �� . :- -4- PASSED BY THE CTTY COUNCIL this 16thday of August , 1976 . ,��s�J G�'.� �.�'': Delores A.
