CITY OF RENTON, W�ISHIN�TON OR�INANCE NQ. 3199 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON I � AUTHORIZING THE ACQUISITION OF CERTAIN REAL � PROPERTY BY EMINENT DOMAIN, PROVIDING FOR THE PAYi�IENT THEREOF; �!UTHORTZING THE CITY ATTORNEY TO PREPARE A PETITION FOR CONDEMNATION IN THE SUPERIOR COURT IN AND FOR THE COUNTY OF KIN� � AND THE PROSECUTION THEREOF FOR THE ACQUISITION '� OF SUCH PROPER'TY FOR THE PURPOSE OF E�TABLISHING AND MAINTAINING WETLAND AREAS AND A TRAIL S�'STEM I WITHIN THE CITY OF RENTON . BE IT ORDAINED BY THE MAYOR AND THE C�TY COUNCIL OF THE CITY OF RENTON, WASHINGTOIV, AS FOLLOWS: SECTTON I : It is acknowledged that the acquisition of the following described real property is part af the City of Renton � Community Development P1an. SECTION ZI : It is hereby determined that the acquisiti.on af the following described r�al property is neces�ary and far a pu.blic gurpose and use - the establishing and maintaining of wetlandS and a trail sys�em as speeifically set far�h in City of Renton Ordinance j No. 2148 and that such real property is located within the carparate limits of the City of Renton, the same being described as fallaws, �o-wit: See Exhibi� "A" attached here�o and made a part hereof as i� fu31y set farth herein. C'The ostensible awners of the a�oreclescribed real ' I property are C. A, Parker and Ka�hy Parker, husband and wife, doing business as C. A. Parker Company) zt i� further acknowledged that the Ci�y is authorized by the law� and stat�ztes of the St�.te of zi3ashington ta condemn and damage lan.ds within its corpo.r.at� limzt� necessary fc,r the above�tated purpose. SECTION III : The City Attorney is hereby authorized and I directed to cammen.ce condemna-tion praceedings against the owners and all other parties in interest in the abavedescribed land as provided by la.w; to grepare the necessary petitian in condemnation and commence and prasecute such action in �he Superior Court in and I + 1 , ' J -� � � , ' , ` ' . C . 1 ` for the County of King against all of the owners and interested parties in the hereinabove described property, and to acquire the aforedescribed property for the City of Renton; and such proceedings shall be to ascertain the just compensation for the taking of such property and/or the damaging, if any, of such remaining contiguous property belonging to the aforementioned parties caused by the City' s acquisition of such property. SECTION IV: Compensation for the acquisition of said property - rights shall be made from 1978 Budget Accounts numbered 000/000/07 . 538 . 34 . 61 and 000/000/07 . 538 . 36 .61 and/or from such other funds of the City of Renton as may be available therefor. Funding for this acquisition will originate from Housing and Community Development Projects/Wetlands Acquisition (CD-246-76) and Cedar River Trail (CD-154=76) . SECTION V: Nothing in this Ordinance shall be construed as a waiver by the City of Renton of its rights to decline to take and pay for said property after the amount of compensation has been � ascertained, and within the time allowed by law. SECTION VI : This Ordinance shall be effective upon its passage, approval and five days after its publication. � - ,,,_; : -,°.
