HomeMy WebLinkAboutORD 3212 , � � j + � .. � �,, j„ , ` !� . .�, ,� -- , � CITY OF RENTON, WASHINGTON ORDINANCE N0. 3212 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ADOPTING AND ESTABLISHING BY REFERENCE THE "UNIFORM SWIMMING POOL CODE, 1976 EDITION" REPEAL3NG ANY AND ALL ORDINANC�S OR PARTS .OF QRDINANCES IN CONFLICT HEREWITH AND REQUIRING FENCES. WHEREAS not less than three ( 3 ) printed copies in book form of the "UNIFORM SWIMMING POOL CODE , 1976 EDITION" as issued by the "Inter- national Conference of Building Officials" and "International Association of Plumbing and Mechanical Officials" have heretofore been filed and are now on file in the office of the City Clerk of the City of Renton for use and examination by the public, and [n1HEREAS it is deemed advisable and in the public interest to adopt said Code as hereinabove described, by reference, NOW THEREFORE THE CITY COUNCIL OF THE CITY OF RENTON DO ORDAIN AS FOLLOWS : SECTION I: Said "UNIFORM SWIMMING POOL CODE, 1976 EDITION" as issued by the "International Conference of Building Officials" and "international Association of Plumbing and Mechanical Of$icials" , of which not less than three (3 ) printed cop�s in book form have heretfore been filed and are now on file in the office of the City Clerk and made available for examination by the public, is hereby , adopted as the "UNIFORM SWIMMING POOL CODE, 1976 EIJITION" by the City of Renton and said Code may be hereafter designated as the "CITY OF RENTON UNIFORM SWIMMING POOL, CODE, 1976 EDITION"- SECTION II : FENCES : For the protection of the citizens and general public, all swimming pools constructed shall be completely enclosed by a substantial wall or fence of not less than six feet( 6 ' ) in height . and such wall or fence and the swimming pool shall be under the same ownership or control. Any wall or fence shall be so constructed as not to have openings, holes or gaps larger than two inches ( 2" ) in any dimension, except for doors and gates. ' All openings in such wall or fence shall be equipped with gates having a self-latching, self-closing device with the latch on the inslde of the gate not readlly accesslble for chilciren to operate, and such gate shall be securely locked when the swimming pool is unattended or uncovered; provided, however, if the premises of the residence in which said pnnl is located is enclosed, then this pro- vision may be waived by the Department of Public Works upon inspection ` ' ' � M ' ; � ° ;� .• , � , � ., v ..`` �'p"` ' and approva7. of the residen�e enclosure; provided further that swimming pools already constructed and in operation shall comply with this Section within ninety (90) days after the adoption of this Chapter. The Department of Public Work.s may make modification in individ- ual cases upon showing of good cause, with respect to the height, nature or location of the fence, wa11, gates or latches or the necessity therefor provided the protection as sought hereunder is not reduced thereby. The bepartmen.t of Public Works may permit other protective devices or structures to be used as long as the degree of the protection afforded by substitute devices or struc- ture is not 1.ess than, the protection afforded by the wa11, fence, gate and latch described herein. (Ord. 1786; 9--1-59 amd. Ord. 2823; 1-21-74; Eff. �.-30-74) All private swimming pools shall be constructed or placed so as to have a side yard of not less than six feet (6') in width on each side, a rear yard of not less than si.x feet (6') in width and a front setback of not less than thirty feet (30') . No person sha11 maintain an outdoor staimming pool on his premises without providing adequate supervision at all times when the swimming pool is in use so that no person may be injured or drowned therein. SECTION III: Any and al1 amendments, additions or modifications to said Code, when printed and f iled with the City Clerk of the City of Renton by authorization of tfie City Council from time to time, shall. be considered and accepted and constitute a part of such Code without the necessity of furtfier ado�ption of sucfi amendments, modi� � fications or. additions �y tlie legislati`ve authority of the City of Renton or by ordinance. SECTTON IV: The City Clerk is hereby authorized and directed to du1.y authenticate and record a copy of the abovementioned Code, together with any amendments or additions thereto, together with an , authenticated copy of this Ordinance. SECTION V: This Ordinance sha].l not be construed to relieve from or lessen the responsibi�.ity of any person owning,. building, altering, constructing or moving any building or structure as defined in the aforesaid Code; nor shall the City of Renton or any agent thereof be held as assuming such l.ialiility by reason of inspection - 2 - � . , . y .y • • � ' ��S �� .. t ''a ' • � ♦ � authorized he�ein or a Certificate of Inspection issued .by the City or any of its agencies. SECTION VI: Any and a1�. ordinances or parts of ordinances in confl.ict herewith are hereby repeaYed. SECTION VII: This Ordinance sha11 be effect�ve upon its passage, approval and five days after its publication, unless otherwise pro- vided for hereinabove.
