AS FOLLOWS:
SEC'I'ION I : Existing subsection 21 of_ Section 9-1108 is
hereby amen�ec� by ��dding the follawing subsection:
Section 9-1108 21, as �mended:
(H) A r�strictive covenant running with the land, signecl
and propc�rly recorded after City Attorney r�vi�w, may be acceptec�
as securiry in lieu of a bond if_ the covenant auar�ntees that the
propPrty will join in any futurP L. I.D. establishe� to install
the requirad imgrovement� in additi�n to the following
conditions:
1 ) The r�strictive covenant for deferrals occurs only for
a single family development no larg�r than a short
plat.
2 ) Th�re are no similar improv�ments in tk�e vicinity an.�
there is no likeliho�d th��t the imgrovernents wi11 be
n��ded or r2�uir�d in the next five years.
3 ) There will be no detrimental effect on the public
health, saf_ety �r wAlf�re if the improvementv are nc�t
installed.
4 ) Th�re is no likelihood that t�e zoning or land use on
�r adjacent ta the sit` wi.11 change to a higher
classific�tion wi�.hin a f_ive-year period, thus
incr�asing th� likelihood th�t the imprc�vem�nts will t�e
need�d.

5 . A covenant approved by the Board shall contain lan�guage
th�t stipula�es the pr�p�.rty awner will imme�iately
install th� deferred. improvements �t his or h�r expense
upon a d�t�rmin�tion of the Board �f punizC works that
the improvem�nts have become necessary.
SECTION II: This Ordinance shall be eff�ctive upon its
passage, approval �nd thirty days a�t�r publication.
