N.E. BETWEEN N.E. 40TH AND N.E. 44TH, AS MORE PARTICULARLY , DESCRIBED HEREIN, BY DOING ALL WORK NECESSARY IN CONNECTION THEREWITH, LEVYING AND ASSESSING THE _ ,AMOUNTS THEREFOR AGAINST THE SEVERAL LOTS, . � TRACTS, PARCELS OF LAND AND OTHER PROPERTY AS SHOWN ON SAID ASSESSMENT ROLL AS CONFIRMED BY THE CITY COUNCIL; AND ,PR.OVIDING FOR THE PAYMENT OF , SUCH ASSESSMENTS INTO THE LOCAL IMPROVEMENT FUND, • DISTRICT NO. 284 OF THE CITY OF RENTON, WASHINGTON " AS CREATED BY ORDINANCE NO. 2858 WHEREAS the assessment roll levying the special assessment agairist the property located in Local Improvement District :No. 284 generally described as Jones Ave. N.E. between N.E. 40th and N.E. 44th created under Ordinance No. 2858, dated June 10, 1974, has been filed with the City Clerk of the City of Renton, Washington by the Director of Public Works, as provided by law; and • . WHEREAS due notice.of the time and place of hearing thereon and making objections and protests to said roll was �duly published at and for the time and in the I manner provided by law, fixing the time and place of hearing thereon for July 9, 1979 a.t the hour�of 8:00 P.M. in the City, Council Ch&mbers, City Hall, ftenton, Washington, , and due notice thereof was timely mailed by the City Clerk to eaeh property owner shown on said roll as provided by law and as further specified in RCW 35.44,090 and said hearing having been duly held as aforesaid; and WHEREAS at the time and place fixed and designated in said notice, said ' t hearing on said assessment roll resulted in the following protests and/or objeetions, as 1 � received by the City Clerk prior to, at and during said public hearing, to-wit: NAME OF PROTESTING PARTY ADDRESS LEGAL I)ESCRIPTION � Robert�H.�&`Cl ari ssa M. +Fawcett�per Exhibit "A" which is made a part he�eof as . , �if fully set fortt�. Equalization for the purpose of considering the roll, benefits to be received by each lot, parcel and tract of land shown upon said roll, including the increase and enhancement of the fair market value pf eaeh such parcel of land by reason of said improvement; NOW, THEREFORE, THE CITY . COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO OR.DAIN AS EOLLOWS: I SECTION I: That the assessments and assessment roll of Local Improvement � District No. 284 which has been created and established for the purpose of paying the I cost of construction �.nd installing certain sanitary sewers and trunk lines and appurtenances thereto, and all as more particularly deseribed in Ordinance No. 2858, � further reference hereby had thereto, and all in accordance with said Ordinance be and the same is hereby in all things approved and confirmed, so that the totai amount of the assessments and assessment roll of said Local Improvement District is in the sum . of $108,887.43. . � �- SECTION II: That.each of the lots, tracts, parcels of land�and other property i . shown upon said assessment .roll is hereby determined and declared to be specially ' benefited by said improvement in at least the amount charged against the same, and the assessments appearing against the same are in proportion to the several assessments j appearing upon said roll. There is hereby levied and assessed against each lot, tract or ' � arcel of land or other ro ert a earin u on said roll the amount finall char ed � P � P P Y PP g P � Y g against the same thereon. , � � � SECTION III: That the assessment roll as approved and confirmed shall be filed with the Director of Finance for collection and said Director of Finance is hereby authorized and directed to publish notice a's required by law, st�ting that said roll is I in her hands for collection and that payment of any assessment thereon or any portion of said assessment can be made at�any time within thirty days from date of first publication of said notice, without penalty, interest or eost, and that thereafter the sum remaining unpaid, may be paid in ten equal annual installments with interest thereon hereby fixed at the rate of 7`� per cent per annum. The first installment of assessment on said assessment roll shall become due and payable during the thirty day period succeeding the date one year after the date of first publication by the Director of Finance of notice that the assessment roll is in her hands for collection and annually I -2- �ti`� . � • �,, v r � _ � _._7 , , �_ thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessment remains unpaid after the first 30 day period, interest upon the whole unpaid sum shall be charged at the rate of 7-3/4per cent per annum and each year thereafter one of said installments, together with interest due on the whole of the unpaid b�lance, shall be collected. Any installment not paid prior to expiration of the said 30 day period during which installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a � charge of interest at 7-3/4Per cent _per annum and for an additional charge of 8-3/4 per cent penalty levied upon both principal and interest due upon such installment or ' installments. The collection of such delinquent installments shall be enforced in the manner provided by law. _ SECTION IV: All of such assessments or installments thereof, and interest and penalty, if any thereon, when collected by the Director of Finance shall be paid . ,, , into the Local Improvement Fund, District No. 284, of the City of Renton as created by said Ordinance No. 2858.,, and shall be used solely for the purpose of paying the . . • . principal and interest on the warrants and bonds drawn upon or issued against said Fund, or in case no bonds have been issued�, then in payment of any installment note or notes as provided for in RCW 35.45.150, as may be determined by the City Council of the City of Kenton. � SECTION V: This Ordinance shall be effective upon its passage, approval and five days after its .publication, unless otherwise provided for hereinabove. Fawcett � who own property located witiiin LID 284 and designated as item 16 322405-9010-08 ; item 17 322405-9043-09. Said notice was received by the Fawcett' s stated that objections to the final assessment would remain on or before the meet- � ing date before the City Counsel scheduled for 8 :00 P.M. , on the 9th day of July, 1979. Please consider this letter as an objection to, said assessment roll .which indicated the assessment to the Fawcett property in the su� of $i3,713. 56 and $3142 .17. The ra����tts object to being assessed for said sewer in any sur.iiahatsoever, in as much as the sewer constructed under LID 284 does not benefit the Fawcett property wha�soever. The Fawcett property within LID 284 is 5erved by a Metro Sewer line which crosses the property from east to west in the southern portion of the property.. Through an agreement with Metro at the time of the installation af the Metra line, and as parital consideration for the Metro right of way, the Fawcett� are permitted to connect clirectly into the Metro lir�e upon payment of a designated sum to the City of Renton as a hook up charge. We look forward to the City Council acting in accordance v�ith our request for deletion of the Fawcett property from LID 284 at such time as the Council sits as a Board of Equal- iz�tion for the LID 284 assessinent roli. If any further information is desired before action by the Council , we will attempt to promptly respond. The Fawcetts have had the benefit of consultation with an engineering firm ' with respect to the feasibility and availability of the P4etro l.ine.
