AN ORDINANCE OF TUE CITY OF RENTON, WASHINGTON, REGULATING AND PR*HIBITING 'CERTAIN USES OF SOUND TRUCKS, ESTABLISHING LICENSE FEES AND .LIMITING THE USE OF SAID SOUND TRUCKS. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON SECTION I: Definitions: (a) "Sound Truck". The words wsound truck" as used herein shall mean any motor vehicle, or horse-drawn vehicle, having mounted thereon, or attached thereto, any sound amplifying equipment. (b) "Sound amplifying equipment". The words -"sound amplifying equipment" as used herein shall mean any machine or device for the amplifi- cation of the human voice, music or any other sound. "Sound amplifying equipment" as used herein shall not be construed as including standard automobile radios when used and heard only by occupants of the vehicle in which installed or warning devices on authorized emergency vehicles or hdxm or other warning devices on other vehicles used only for traffic safety purposes. SECTION II: Non*Commerc i a 1 Use of _Sound Trucks (a) No person shall use, or cause to be used,, a sound truck with its sound amplifying equipment in operation for non-comnercigl-�Urposes in the City of Renton before filing a registration statement with the City Clerk in writing. This registration statement shall be filed in duplicate and shall contain, among others, the following information: (1) Name and home address of the applicant, together with the address of iris place of business, if any, (2) License number and motor number of the sound truck to be used by the applicant. (3) Name and address of person>who owns the sound truck and person having direct charge thereof. (4) Names and addresses of all persons who will use or operate the sound truck. Lh Page One) (5) The purpose for which the sound truck will be used. (6) A general statement as to the section or sections of the in City/which the sound truck will be used. (7) The proposed hours of operation of the sound truck and the number of days of proposed operation thereof. (8) A general description .of the sound amplifying equipment which is to be used and the maximum sound producing power of the sound amplifying equipment to be used in or on the sound truck, including the wattage to be used, volume in decibels of the sound and the 1 approximate maximum distance for which sound will be thrown from the sound truck. The City Clerk shall return to each applicant one copy of said registration statement duly certified by the City Clerk as a correct.copy of said application. Said certified copy shall be in the possession of any person operating the sound truck at all times while the sound truck's sound amplifying equipment is in operation. Said copy shall be promptly displayed and shown to any policeman of -the City of Renton upon request. (b) Non-commercial use of sound trucks in the City of ;Renton with sound amplifying equipmentin operation shall be subject to the following regulations: (1) The only sounds permitted are music or human speech. Q� (2) Operations are permitted for four (4) hours each day,' 'ey'12�`"�� ,-I-• ol 6 PII except on.Sundays and legal holidays when no operations shall be the � * u (3) Sound amplifying -equipment shall not be operated unless the sound truck upon which such equpment is mounted is operated at a speed of at least ten (10) miles per hour except when said truck is stopped or impeded by traffic. Where stopped by traffic the said sound amplifying equipment shall not be -operated for longer than one minute at each such stop. Page Two 1� w s (4) Sound shall not be issued within one hundred (100) yards of any hospital, school, church, funeral home -,,hiie services are being conducted therein. (5) The human speech and music. amplified shall not be profane, lewd, indecent or slanderous. (6) The volume of sound shall be controlled so that it will not be audible for a distance in excess of one hundred (100) feet from the sound truck and so that said.volume is not unreasonably loud, raucous, jarring, disturbing or a nuisance to persons within the area of audibility. (7) No sound amplifying equipment shall be operated with an excess of 15 watts of power in the last stage of amplification. SECTION III: Commercial Advertising by Sound Truck Licensed and. Regulated No person shall operate or cause to,be operated any sound truck in the City of.Renton for commercial advertising purposes with sound amplifying equipment in operation unless a license has been obtained from the City Clerk. The fee for said license shall be $ �t-� per day. (a) Persons applying for the license required under the immediately preceding, Section shall file with the City Clerk an application in writing giving in said application the information required in the -Registration Statement under Section II hereinabove. (b) The City Clerk shall issue a license upon -payment -of -.the required license fee unless the application inquired herein reveals that the applicant would violate the regulations required in Section II of this .Ordinance or the provisions of some other Ordinance of the City of Renton. 11 (c) A licensee shall keep such license in his possession in the sound truck during the time the sound truck's sound amplifying equipment is in operation. The license shall be promptly displayed and shown to any policeman of the City of.Rento n upon request. SECTION IV: Penalty Any person who violates any provision of this Ordinance shall be deemed .Page Three • a • guilty of a misdemeanor and upon conviction thereof shall be fined any sum not exceeding $100.00 or by imprisonment for not more than thirty (30) days, or by both said fine and imprisonment. ..SECTION V: Separability It is the intention o.f the City Council that each separate provision of this Ordinance shall be deemed independent of all other provisions herein, and it is further the intention of the City Council that if any provision of 'this Ordinance be declared to be invalid,. all other provisions thereof.shall remain valid and enforceable. SECTION VI: No person shall'operate, or cause to be operated, .any sound:tauck for commercial sound advertising purposes in violation of the regulations set forth in Section II, paragraph (b), (1),.(2), (3), (4), (S),.(6), and (7). SECTION VII: This-Ordinance.shall be in full force and effect from and after its passage, approval and legal publication. PASSED BY THE CITY COUNCIL this day ofc$1, 1960.
