HomeMy WebLinkAboutORD 1998CITY OF RENTON, WASHING ON ORDINANCE N0. f't' AN ORDINANCE approving and confirming the assessments and assessment roll of Local Improvement District No. 248, which has been created and established for the purpose of paying the cost of constructing and installing sanitary sewer lines and appurtenances in the West Hill area of the City, pursuant to Ordinance No. 1943, and levying and assessing the amount thereof against the several lots, tracts, parcels of land and other properties shown on said roll. WHEREAS, the assessment roll levying the special assessments against properties located in Local Improvement District No. 248 in the City of Renton, Washington, created under Ordinance No. 1943, was filed with the City Clerk of the City of Renton, as provided by law; and WHEREAS, notice of the time and place of hearing thereof and of making objections and protests to said roll was duly published at and for the time and in the manner pro- vided by law, fixing the time and the place of hearing thereon for the 5th day of N:ave,mber•, 1962, at the hour of 8;00 o'clock p.m. (PST) in the Council Chambers in the City Hall, Renton, Washington, and further notice thereof was duly mailed by the I City Clerk to each property owner shown on said roll; and WHEREAS, at the time and place fixed and designated in said notice, the hearing was duly held and all protests made in writing were read and submitted to the City Council, and considered by it and all persons who wished to be heard were heard at said hearing; and WHEREAS, the City Council continued the hearing until 8:00 o'clock p.m. (PST) on November 19, 1962, and further continued the hearing until 8:00 o'clock p.m. (PST) on November 26, 1962, at a regular meeting of the City Council, at which times the Council once again heard all persons who wished to be heard at said hearing; and WHEREAS, the City Council gave due consideration to the special benefits to be received by each lot, tract and par- cel of land shown upon said roll including the increase in the fair -market value of each lot, tract and parcel of land antici- pated to result from the acquisition and construction of the improvement in Local Improvement District No. 248, and certain changes and corrections were ordered to be made on said roll; and WHEREAS, it appeared to the City Council that the amounts charged against the properties on the said assessment roll for Local Improvement District No. 248 are in accordance with the mode of assessments in said Local Improvement District No. 248 provided by law and by ordinances of the City Council and clearly reflect the special benefits to be received by said parcels of land after giving effect to the changes and correc- tions ordered, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF RENTON, WASHINGTON, as follows: Section 1. That the assessments and assessment roll of Local Improvement District No. 248, which has been created and established for the purpose of paying the cost of construct- ing and installing sanitary sewer lines and appurtenances in the West Hill area of , the City, ,pursuant to Ordinance No. 1943, as changed and corrected and as the same now stands, be and the same is hereby in all things and respects approved and confirmed in the total amount of $166,521.89. Section 2. That each of the lots, tracts, parcels of land and other property shown upon the said roll is hereby -2- determined and declared to be specially benefited by said improvements in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments appearing upon said roll. There is hereby levied and assessed against each lot, tract, parcel of land and other property appearing upon said roll the amount finally charged against the same thereon. Section 3. That the assessment roll as approved and confirmed shall be filed with the City Treasurer of the City of Renton, Washington, for collection and that said City Treasurer is hereby authorized and directed to publish notice as required by law stating that said roll is in her hands for collection and that payment of any assessment thereon or any portion of said assessment can be made at any time within thirty days from the date of the first publication of said notice without penalty, interest or cost, and that thereafter the sum remaining unpaid may be paid in ten equal annual installments with interest thereon hereby fixed at the rate of 5% per annum. The first installment of assessments on said assessment roll shall become due and payable during the thirty -day period succeed- ing the date one year after the date of first publication by the City Treasurer of notice that the assessment roll is in her hands for collection and annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessments remains unpaid after the first thirty -day period, interest upon the whole unpaid sum shall be charged at the rate of 5% per annum and each year thereafter one of said installments, together with interest due on the whole of the unpaid balance, shall be col- lected. Any installment not paid prior to the expiration of the -3- w said thirty -day period during which such installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest at 5% per annum and for an additional charge of penalty levied upon both principal and interest due upon such installment or installments. The collection of such delinquent installments will be enforced in the manner provided by law. PASSED by the City Council and APPROVED by the Mayor at a regular meeting on December 3, 1962.
