' M' ��� , ��+ , Amended by}ORD I�o. 4374, y�J"�� . . �b�►{ CITY OF RENTON, WASHINGTON ORDINANCE N0. 3893 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON AMENDING CERTAIN PORTIONS OF CHAPTER 34 OF TITLE VI � (POLICE REGULATIONS) AND CHAPTER 1 OF TITLE X �TRAFFIC) OF ORDINANCE NO. 1628 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON �� RELATING TO POLICE REGULATIONS CONCERNING CUSTODIAL INTERFERENCE, COMPUTER TRESPASS, TWO-WAY LEFT TURN LANES, PAWNBROKERS LAWS AND PENALTIES FOR VIOLATIONS THEREOF THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON DO ORDAIN AS FOLLOWS: SECTION I: Existing Section 6-3401 of Title VI (Police Regulations) of Ordinance No. 1628 entitled "Code of General Ordinances of the City of Renton" is hereby amended to read as follows: Section 6-3401, as amended: ADOPTION OF STATE LAWS: The adoption of State law by reference is a means of preserving public peace and serving the general public welfare . The following State laws concerning certain offenses on school grounds, custodial inter- ference, violation of restraining orders and amendments to laws pro- hibiting driving while under the influence of intoxicants and/or drugs and penalties therefor are hereby adopted by reference: RCW 28A.87 .010 RCW 28A.87 .055 RCW 28A.87 . 060 RCW 28A.87 .231 RCW 28A.87 . 232 RCW 28A.87 . 23D RCW 28A.87 .233 RCW 26 .09 .300 Chapter 165, Laws of 1983 Regular Session Chapter 95, Section 2 , Laws of 1984 Regular Session Chapter 273 , Sections 2 , 3 , 4 , 5, and 6 relating to computer trespass SECTION II : Existing Chapter 34 of� Title VI (Police Regulations) of Ordinance No. 1628 entitled "Code of General Ordinances Ordinance No. 3893 � `° . � . _ . ' � , �f � : � of the City of Renton" is hereby amended by adding the following new Section: Section 6-3402 ADOPTION OF STATE LAW: RCW 19 .60 .010 is hereby adopted by reference as a portion of this Chapter and a copy thereof has been filed with the City Clerk as required by RCW 35A.12 . 140 for use and examination by the public . RCW 19 .60 . 101 shall be a minimum standard and wherever this Chapter provides for more restrictive regulations, this Chapter shall control . SECTION III : Existing Section 10-101 of Title X (Traffic Code) of Ordinance No. 1628 entitled "Code of General Ordinances of the City of Renton" is hereby amended as follows: Section 10-101, as amended: ADOPTED BY REFERENCE: The "Washington Model Traffic Ordinance: , Chapter 46 .90 hereinafter referred to as the "MTO" and RCW 46 . 61 . 202 , 46 .61 . 215, 46 . 61 .261, 46 . 61.266 , 46 . 61 .269 and 46 .61. 290 and Chapter 148 Laws of 1980 Regular Session are hereby adopted by reference as and for the Traffic Ordinance of the City of Renton as if set forth in full herein. The definitions of traffic infraction and criminal violations as cited ' in said Chapter 148 , Laws of 1980 Regular Session shall define which violations of the incorporated Statutes shall be criminal viola- tions and which shall be traffic infractions . � (A) Penalties: Any person who is convicted of a traffic infraction shall be punished by a fine only of not more than five hundred dollars ($500 .00) except as otherwise provided herein. Any person convicted of a misdemeanor herein shall be punished by a �ine not to exceed five hundred dollars ($500 .00) or ninety (90) days in the City Jail or both, except as otherwise specifically provided for in the Statutes adopted by reference herein. , ., , � � = ' � , Ordinance No. 3893 �' ` (B) Disposition of Traffic Fines and Forfeitures . All fines or forfeitures collected upon conviction or upon the forfeiture of bail of any person charged with a violation of any of the provisions of this Ordinance shall be paid into the general fund of the City of Renton. (C) Official Misconduct. Failure, refusal or neglect on the part of any judicial or other officer or employee receiving or having custody of any such fine or forfeiture of bail, either before or after a deposit in said general fund, to comply with the provisions of subsection (B) shall constitute misconduct in office and shall be grounds for removal therefrom, provided appropriate removal action is taken pursuant to State law relating to removal of public officials . (D) Filing of Ordinance . Incident to the adoption of the MTO by reference, by this Ordinance, copies of the text of the adopted MTO and of other adopted 5tatutes shall be filed as required by RCW 35A.12 . 140 for use and examination by the public . SECTION IV: This Ordinance shall be effective upon its passage, approval and thirty days after publication.
