HomeMy WebLinkAboutRES 08286 r RESOLUTION NO. 828 AUTHORIZING ACQUISITION OF HANGAR ON CITY AIRPORT FROM VETERANS AIR SERVICE INC., TERMINATION OF LEASE ON PREMISES THEREOF, AND THEREWITH TERMINATION OF SUIT. WHEREAS, heretofore the City of Renton in writing leased to VETERANS AIR SERVICE, INC., a corporation, for a ten (10) year term commencing May 15, 1947, with option to Lessee for a five (5) year additional extension, certain area on the Renton Airport, in King County, Washington, described thusly: Beginning at the intersection of the center line of Dixie .Avenue with the center line of Runway of said Renton Airport extended; running thence North 505+0561, West on said center line of Airport and extension a distance of 1538 feet; thence South 84005, West 425 feet to true begin- ning; thence South 840051 West 42 feet; thence North 5054t56" West 80 feet; thence North 840050 East 42 feet; thence South 5054056" East 80 feet to true point of beginning; at a rental of °16.80 per month, said premises to be used by Lessee for erection and use of an aircraft hangar building, with provision that all structures and improvements placed upon the premises by Lessee or successors shall at expiration of the Lease or its termina- tion revert and become property of the Lessor City; and Lessee has erected and used on said premises such a hangar building containing also repair shop and office space; and also the City of Renton has leased to said Lessee under oral lease from month-to-month on a square footage rental basis certain parking area to the South of above described premises; and WHEREAS, subsequently BOEING AIRPLANE COMPANY has leased from City and now occupies considerable areas in the vicinity of above described premises, on said airport, and said Lessee VETERANS AIR SERVICE, INC. has instituted and there is now pending in the Super- ior Court of the State of Washington, in King County, an action, Cause No. 426686, as Plaintiff, against the City of Renton and Boeing .Airplane Co. Inc. a corporation, as Defendents, for alleged viola- tions and damages under above lease to VETERANS AIR SERVICE. INC. claimed to have resulted from manner of use of adjacent areas by said BOEING AIRPLANE CO.; and WHEREAS, by negotiations between the parties said Lessee VETERANS AIR SERVICE, INC. through its owners ALEX J. SOMPPI, Jr. and WM. M. JONES, Jr. have offered to sell and convey aforesaid hangar structure and all improvements upon the above described leased premises to the CITY OF RENTON, with the leasehold in said premises, and to terminate aforesaid written lease and also afore- said oral month-to-month lease of parking areas, and to dismiss with prejudice the aforesaid action and suit against the CITY OF RENTON and BOEING AIRPLANE CO., all for a payment of $6500.00; compromise and sat- isfaction of all claims and demands of said Lessee against the City and BOEING AIRPLANE CO. being embraced therein; and BOEING AIRPLANE CO. INC. has offered to pay and contribute $1000.00 of aforesaid sum in compromise and release of VETERANS AIR SERVICE, INC. claims and demands and suit against it BOEING AIRPLANE CO.; and the RENTON AIRPORT Board having recommended acceptance of said offers and acquisition of said structures and termination of said leases to VETERANS AIR SERVICE, INC., with re- lease of the CITY from said suit, for a payment of $ 5500.00 by the CITY: and the same being deemed a reasonable price and proposition; NOW THERE- FORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RENTON: That the CITY OF RENTON accept said offer and acquire the afore- said hangar structures and improvements on above described leased prem- ises from Lessee VETERANS AIR SERVICE, INC., and terminate above described written lease to that Lessee, and also terminate above mentioned oral month-to-month lease to said Lessee, and take dismissal with prejudice and without costs of aforesaid pending suit in Superior Court, all for a price of $5500.00 to be paid by the CITY as consideration and in com- promise satisfaction and release of all claims and demands whatsoever of VETERANS AIR SERVICE, INC. and its owners against the CITY; that upon receiving from VETERANS AIR SERVICE, INC. and/or its owners proper writ- ten conveyance of above mentioned structures, improvements and lease- holds, and termination of aforesaid leases, and release and dismissal of aforesaid causes of action and demands, the MAYOR and CITY CLERK be and are hereby authorized to execute any instruments in writing appro- priate to consummate such purposes and acquire such properties, and thereupon the CITY TREASURER be and is hereby authorized to pay from the AIRPORT fund to said VETERANS AIR SERVICE, INC. as such considera- tion, the sum of $5500.00, or so much thereof as required for said pur- poses. - 2 - Ole PASSED by the City Council this 4th day of December, 1951.
