WHEREAS, there are located within and adjacent to the City of Renton, a Municipal.Corporation of the second class under the laws of Washington, certain A first class shore lands of the Black River constituting a waterway known as Black River Channel, situated in the Southwest quarter of Section 18, Township 23 North, Range 5 E.W.M.., in King County, Washington, which i.s more particularly delineated on that certain preliminary print of *Supplemental Map of:Renton Shore Lands" issued by the Commissioner of Public Lands,. State of Washington, dated January, 1958,- a true copy thereof being attached hereto marked."Exhibit All and made a part hereof; the -exact legal description of said Black River'Channel being also attached hereto marked "Exhibit Btf and made a part hereof; and WHEREAS, said waterway has not been excavated and is not in use for the purposes of navigation and has not been so used for many years past and is no longer required in the public interest as a waterway, but said waterway actually has not been used for any public or:o.ther purpose .of any nature, and its present state not being in the best interests of the public, NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, AS FOLLOWS': 1. The Mayor and the -City -Council of the City of Renton .hereby find, determine and adopt the foregoing recitals as true and correct facts and findings in every respect. 2. The said waterway and first class shore lands of the Black River, commonly referred to. as the Black River Channel, are located in part within and in part outside the corporate limits of the City of Renton, a municipal corporation of the second class under the laws,of the State of -Washington. It will be to the best interests of the City of Renton and 4 the public;generally if said waterway channel and share lands, as more particularly described on Exhibits A and B attached hereto, be vacated. Upon such vacating by the Commissioner of Public Lands as provided for in RCW 79.16.310, the City of Renton shall proceed to extend across the portions s.o.vacated its existing stree.ts,.or to select there- from such portions thereof as the City may desire for street purposes, but in Page One I no. case to exceed 150 feet in width for any one such street or streets,. The City of Renton hereby agrees to make such definite selection within 60 days after the receipt of notice of the vacation by the Commissioner of Public Lands. 3. The City of Renton therefore respectfully requests the Commissioner of Public Lands of the State of Washington to take any and -all steps and actions necessary to vacate the herein»described waterway, being shore lands of the Black River; commonly known as the Black River Channel.
