An Ordinance approving and confirming the assessment and
Assessment Roll of Local Improvement District.No. 223 for
the improvement of portions of Highlands Addition to Ren-
ton, Morgan's Grand View Addition to Renton, and Renton
Co-operative Coal Company"s Acre Tracts tplat No.l), and
certain parts of certain other streets and. Avenues, all
in the City of Renton, by constructing lateral sanitary
sewers with man -holes and all appurtenances and work in-
cidental thereto, under Ordinance No. 1343; levying and
assessing the amounts thereof against the several Lots,
Tracts, Parcels of land and other property, as shown on
said Roll; approving and ratifying certain contractual
agreements pertaining to said improvement; establishing
a Local Improvement Fund; and fixing a date for the is-
suance of bonds .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PENTON, WASHINGTON:
SECTION 1: That the assessment and assessment roll of Local
Improvement District No. 223 for the improvement of portions of High-
lands Addition to Renton, Mlorgans Grand View Addition to Renton, and
Renton Co-operative Coal Company's Acre Tracts (Plat No. 1), and certain
parts of Streets and Alleys therein, all inthe City of Renton, by con-
structing lateral sanitary sewers with man-hole.s and all appurtenances
and work incidental thereto, under Ordinance No. 1343, as the same now
stands, be, and the same is hereby, after hearing held thereon pursuant
to notice duly and regularly published, in all things approved and
confirmed.
SECTIOiv 2: That each of the lots, tracts, parcels of land,
and other property, shown upon said roll is hereby declared to be
specially benefited by said improvement in at least the amount charged
against the same and that the assessment appearing against the same
is in proportion to the several assessments appearing upon said roll
and to the special benefits conferred upon the several lots, tracts
and parcels of land and other property. There,i'shereby levied and
assessed against each such lot, tract, parcel of land, and other
property, appearing upon such roll, the amount finally charged against
the same thereon.
SECTION 3: That for the purpose of this improvement there is
hereby created and established -a special fund to be called "Local
Improvement Fund, District No. 223t1.

SECTION 4: That the 15th day of May . l., -195Q-,•.is hereby fixed
as the date of issue of the bonds required to be issued on account
of this improvement.
SECTION 5: That certain contractual agreement entered into and
executed under date of June 15 '1949 by and between the City of Renton,
acting through its 'Mayor and Clerk, authorized by the City Council,
as a party, and C. M. Costner and Edna Costner, his wife, as the other
party, whereby the party Costner covenanted and agreed to grant the
City rights of way, ingress and egress across and on Tract 8 of Renton
Co-operative Company's Acre Tracts aforesaid, for the construction,
operation and maintenance thereon of sanitary sewer lines with man-
holes and all appurtenances, pertaining to aforesaid Improvement, for
considerations therein stipulated, be and is hereby approved, ratified
and accepted.
Likewise, that certain "Agreement for Easements" executed in
writing under date of Aug,. , 1949 by and between Frank and Leona
Rosenstien, Fligio and Josephine-Belmondo, P,iorris and Francis Favre,
J. N. and Mary Clarke, and Dominic Slovitski, as owners respectively
of portions of Tracts 10, 11, 12 and 13 in Renton Cooperative Coal
Company's Acre Tracts aforesaid, agreeing to thereafter provide ease-
ments for sewer lines and connections across the East half of said
Tracts, in certain eventualities, and waiving installation of lateral
sIewer lines thereon under aforesaid Improvement, and agreeing to basis
of determining benefits and assessments thereunder, be and is hereby
approved, ratified and accepted.
SECTION 6: This Ordinance shall be in full force and effect
five days from and after its passage, approval and publication.
