HomeMy WebLinkAboutORD 1383ORDINANCE NO. 1383 An Ordinance of the City of Renton, Washington, of alley in Block 20, Plat of Renton Highlands, Renton; Accepting conveyance to the City of an jacent to said alley as substitute for vacated changing location of alley at said portion. vacating a portion within the City of equivalent area ad - portion; thereby BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RENTON: Section 1: Whereas a proper petition for vacating of por- tion of alley in Block 20, Plat .of Renton Highlands, within the City of Renton, in King County, Washington, as hereinafter more particularly described, was duly filed with the City Clerk of Renton onApril 18, 1950 by George H. Jacobson and Berget M. Jacobson, his wife, John H. Hastie and Eileen B. Hastie, his wife, they being the owners of all of the property abutting upon that portion of alley therein sought to be vacated, which petition was on that date received and read at a regular meeting of the City .Council; and whereas the City Council by resolution No. 780 adopted July 25, 1950, did fix the 29th day of August,, 1950, as date of a public hearing upon said Petition, and directed the Clerk to give notice of said hearing in the manner provided by law; and whereas the City Clerk has duly caused notice of such hearing to be published and to be posted on said portion of alley for the time and in the manner provided by law; and whereas a public hearing was duly held upon said petition on the date so fixed, August 29, 1950 at a regular meeting of the City Council at 8:00 P.M., and no pro- tests or objections to the granting of the said petition or to the vacating of said portion of alley having been made, filed or re- ceived, and the City Council then having at said time voted to grant said petition for vacating and having fixed the fifth day of September at its regular meeting as the time for presenting and adopting an Ordinance to vacate said portion of alley; AND WHEREAS by and with aforesaid petition the abutting own- ers and petitioners John H. Hastie and Eileen B. Hastie, his wife, tendered a conveyance by quit -Claim Deed to the City of Renton of an equivalent area and tract, hereinafter more particularly de- scribed as Parcel B, abutting said alley on tte east, for street and alley purposes and use of the public, as substitute and ex- change for the above mentioned Parcel A portion of alley sought to be vacated, whereby said alley will remain open to its full width in a changed location; and said petitioners having by agree- ment and conveyance between themselves provided for the vesting of title to said Parcel A portion of alley when vacated to vest in petitioners Jacobson and wife as abutting owner; NOW THEREFORE the City Council finds and ordains as heeinafter set forth. Section 2: The vacating of hereinafter described parcel A. being a portion of said alley, and acceptance by the City of aforesaid tendered conveyance of substitute and equivalent tract adjacent to said alley, resulting in change of location of said alley as hereinabove outlined and as proposed in aforesaid peti- tion, is proper and advantag6ous to all concerned and will serve the public interest; it will not diminish or impair the area, value or use of said alley in its entirety, nor the purposes there- of, nor the use and enjoyment by abutting owners or by the public of said alley and their abutting properties, nor cause injury or damage to any properties or persons; but the granting of said -1- petition is in the public interest. Section 3: Accordingly aforesaid petition to vacate portion of alley is hereby granted, and said portion of a lley,herein referred to as "Parcel A",is hereby vacated, same being more particularly de- scribed as follows: That portion of alley in Block 20, Plat of Renton High- lands, according to plat recorded in Vol. 46 of Plats, pages 34 to 41 inclusive, records of King 'County (Renton Highlands Addition to the City of Rentor, in King County, State of Washington, described as follows: Beginning at the Northeast corner of Lot 1, Block 20, of said plat of Renton Highlands, thence south 10011 West a distance of 24.95 feet; thence along a line bearing North 260231 East to the South property line of 6th Avenue North; thence westerly along said south property line of 6th Avenue North to the point of beginning. Section 4: As substitute for and in exchange for the above vacated portion of alley,the City of Renton does hereby accept and take conveyance by Quit -claim deed from abutting owners John H.Hastie and Eileen B. Hastie, his wife, for street and alley purposes and use of the public, of that adjacent tract herein referred to as:"Parcel B", same being more particularly described as follows: That portion of lot 2. Block 20, plat of Renton Highlands according to plat recorded in Vol. 46 of Plats, pages 34 to 41 inclusive, records of King County, (Renton Highlands Addition to the City of Renton), in King County, State of Washington, described as follows: Beginning at the Northwest corner of Lot 2, of said Block 202 Plat of Renton Highlands; thence easterly along the south property line of 6th Avenue North a distance of 8.0 feet; thence south 260231 West a dis- tance of 15.75 feet to the west property line of said Lot 2; thence north 10811 east a distance of 18:76 feet to the point of beginning. and the City of Renton also accepts release and exemption of the last described Parcel B from the lien of existing mortgage thereon, as specifically released by 1st Federal Savings & Loan Association of Renton, Washington by written instrument dated August 10th, 1950. Said last described Parcel B is hereby accepted as and made a part of aforesaid alley in said Block 20 for street and alley purposes and use of the public. Section 5: This Ordinance shall be effective from and after its passage, approval and publication in accordance with law. PASSED by the City Council this 5th day of September, 1950.
