HomeMy WebLinkAboutORD 1486ORDINANCE N0, V -8,6 AN ORDINANCE OF THE CITY,OF RENTON, WASHINGTON, AMENDING ORDINANCE NO. 1048, KNOWN AS THE TRAFFIC CODE OF THE CITY OF RENTON, RELATING TO THE RE- MOVAL, IMPOUNDING AND ABANDONMENT OF CERTAIN VEHICLES FOUND WITHIN THE CITY OF RENTON. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS FOLLOWS: Section 1: Existing Section 37 of Ordinance No. 1048, known as the Traffic Code of the City of Renton, reading as follows: "SECTION 37. REMOVAL OF VEHICLES LEFT ON TRAVELED WAY--OFFICERS1 DUTIES --COST AND LIEN. Whenever any police officer finds a vehicle standing upon the. paved, improved or main traveled portion of any public highway within this City, such officer is hereby authorized to remove such vehicle or to require the operator or other person in charge of such vehicle to remove the same off the paved, improved or main traveled portion of such public highway. Whenever any police officer finds any vehicle unattended in such a position that it constitutes an obstruction to traffic or provides a danger to travel upon any public highway, such officer is hereby authorized to provide for the removal of such vehicle to the nearest place of safety. Any cost incurred in the removal there- of shall be paid by the owner of the vehicle so removed and the same shall be a lien upon such vehicle." BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: AMENDED SECTION 37. (a) Any vehicle parked or angle - parked n 'wio at on of the Traffic Code, as amended, or so used or left unattended upon any public property or upon the paved, improved or main travel portion of any public highway or so used so as to endanger any user or potential user of any public highway is hereby declared to be a nuisance. Such nuisance may be summarily abated by removing the vehicle by or under the direction of a Police officer by means of towing, or otherwise, to a vehicle pound. The Police Department shall request as soon as practicable after impounding from the authority or department last licensing said vehicle the name and address of the registered owner thereof and within seven (7) days after obtaining such information notify the owner in writing that the vehicle has been impounded. AMENDED SECTION 37. (b) Before the owner or his duly author zed agent shall be permitted to remove a vehicle from such pound he shall furnish satisfactory evidence to the Police Department and the keeper of such pound of his identity and ownership. All charges for towing, hauling or storage charges incurred for the impounding of said vehicle shall be paid by the owner or his agent to the Poli.ce Depart- ment prior to the redemption of such impounded vehicle AMENDED SECTION 37. (c) When the Chief of Police shall determine that any vehicle impounded pursuant to the provisions of this Ordinance has. been abandoned by the owner thereof, he shall report such vehicle to the Chief of the Washington State Patrol and as is further required by RCW 46.52.110. Abandonment shall be pre- sumed if the owner fails to redeem his vehicle within thirty (30) days after having been notified of such im- pounding as specified in this Ordinance. AMENDED SECTION 37. (d) The impounding of any ve- hicle shahnot prevent or preclude the institution and prosecution of criminal proceedings in the Police Court Of the City of Renton, or elsewhere, charging the violator with any violation of law on account of which such vehicle was impounded. Section 2: This Ordinance shall be in full force and effect from and after its passage, approval and legal publication. PASSED BY THE CITY COUNCIL this13th day of July, 1954.
