HomeMy WebLinkAboutORD 16154 Repealed by Ordinance #2879 ORDINANCE NO. & / 5 AN ORDINANCE OF TIS CITY OF RENTON, WASHINGTON, REQUIRING AN APPLICATION FOR A PERMIT TO BREAK A STREET CURB IN. THE CITY OF RBNTON, . WASHINGTON, THE DEPOSIT OF AN AMOUNT TO SECURE THE PERFORM- ANCE OF THE NECESSARY WORK IN CONNECTION THERE- WITH AND THE ISSUANCE OF A PERMIT THEREFOR, AND PROVIDING A PENALTY FOR VIOLATION HEREOF. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS FOLLOWS: SECTION I: Any person desiring to break a street curb in the City of Renton, Washington, shall, prior to any such work, file a written application for permission to do so with the City Clerk and shall at the same time deposit with said. Clerk a sum of not less than $100.00 or in lieu thereof a proper performance bond with sureties to be approved by the City, to insure the performance of the necessary work to be done in connection therewith. The City Clerk may thereupon issue such permit after the same shall have been approved by the Street Commissioner and the Superintendent of Utilities. SECTION II: The breaking of such curb and the completion of the necessary construction work in connection therewith, including the reconstruction of the sidewalk, shall be under the immediate supervision and direction of the Street Commissioner and Superintendent of Utilities and such work shall be done by the applicant as shall be directed by said City Officials, or their duly authorized representatives. SECTION III: In case the applicant shall fail or refuse to com- plete the necessary work in connection with such curb breaking as directed. by the Street Commissioner and the Superintendent of Utilities, then and in that event such work shall be performed by the City and the cost thereof shall be deducted from the deposit as aforesaid.. SECTION IV: Whenever the Street Commissioner and the Superin- tendent of Utilities shall in writing notify the City Clerk that the -1- c work has been completed as directed, said security deposit or perform- ance bond shall be returned by the Clerk to the applicant. In case it is necessary for the City to perform any labor and/or furnish any materials in connection with the completion of said curb breaking, the value thereof shall be deducted from said. security deposit and the balance remaining returned to the applicant. SECTION V: Any person who shall break a curb in the City of Renton, Washington, without applying for a permit so to do as provided herein, shall be guilty of a misdemeanor and upon conviction shall be fined in any sum not to exceed $100.00 or imprisonment not to exceed thirty (30) days or by both such fine and imprisonment. SECTION VI: ORdinance No. 1081.E and any and all ordinances in conflict herewith are hereby repealed and superseded. SECTION VII: This ordinance shall be in full force and effect from and after its passage, approval and legal publication. PASSED BY THE CITY COUNCIL this q day of June, 1957.
