HomeMy WebLinkAboutORD 1621."., Z% °• ORDINANCE NO. 1621 AN ORDINANCE OF THE CITY OF R ENTON, WASHINGTON, AMENDING SECTIONS I and II OF ORDINANCE NO. 1130 PROHIBITING THE DRIVING OF A MOTOR VEHICLE BY A PERSON UNDER THE INFLUENCE OF INTOXICANTS OR NAR- COTIC DRUGS, THE OPERATION OF A MOTOR VEHICLE IN.A RECKLESS MANNER, OR THE NEGLIGENT OPERATION OF A MOTOR VEHICLE UPON ANY PRIVATE PROPERTY ADJACENT TO ANY PUBLIC HIGHWAY WITHIN THE CITY OF RENT ON, WASHINGTON, AND PROVIDING PENALTIES FOR THE VIOLATION OF' THIS ORDINANCE. BE IT ORDAINED BY = MAYOR AND THE CITY COUNCIL OF THE CITY OF RENT ON AS FOLLOWS: SECTION I: Existing Sections I and II of Ordinance No. 1130 reading as follows: "SECTION I: It shall be unlawful for any person to operate any motor vehicle upon private property adjacent to any public highway in the City of Renton, Washington, while under the influence of, or affected by the use of intoxicating liquor or any narcotic drug. Upon the first conviction for the violation of the provision of this sec- tion, the court shall provide a fine of not less than 050.00, and not more than $300.00, and not less than ten (10) days nor more than ninety (90) days in jail, or both such fine and imprisonment, and shall, in addition thereto, revoke the operator's license of such person. Upon second or subse- quent conviction for a violation of the provision of this section, the court shall impose a fine of not less than §100.00, or more than 0300.00, and not less than ninety (90) days in jail, or both such fine and imprisonment, and shall in addition thereto, revoke the operator's license of such person." "SECTION II: It shall be unlawful for any person to operate a motor vehicle in a reckless manner on private property adjacent to any public highway in this city. For the purpose of this section "to operate in a reckless man- ner" shall be construed to mean the operation of a motor vehicle upon private property adjacent to a public highway of this city in such manner as to indicate a willful or wanton disregard for the safety of persons or property. Any person violating the provisions of this section of this ordinance shall be fined not more than 0300.00 or imprison- ed not more than 90 days, or shall be punished by both such fine and imprisonment.`T' BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: AMENDED SECTION I: It shall be unlawful for any person to operate any motor vehicle upon private property adjacent to any public highway in the City of Renton while under the influence of, or affected. -1- dkl ft . by the use of intoxicating liquor or any narcotic drug. Any person convicted of a violation of the provisions of this Section shall be punished by a fine of not less than Fifty (50.00) Dollars nor more than One Hundred ($100.00) Dollars, or by imprisonment not less than ten (10) days nor more than thirty (30) days in the City Jail, or by both such fine and imprisonment; and the Court shall in addition thereto suspend the operator's license of such person for not less than thirty (30) days. AM LADED SECTION II: It shall be unlawful for any person to operate a motor vehicle in a reckless manner on private property adjacent to any public highway in this city. For the purpose of this section "to operate in a reckless manner" shall be construed to mean the opera- tion of a motor vehicle upon private property adjacent to a public high- way of this city in such manner as to indicate a willful or wanton disregard for the safety of persons or property. Any person violating the provisions of this section shall upon conviction thereof be punished by a fine not to exceed One Hundred 0100.00) Dollars, or by imprison- ment in the City jail for not more than thirty (30) days, or by both such fine and imprisonment; and in addition thereto the operator's license of such person may be suspended for not less than thirty (30) days. SECTION II: This Ordinance shall be in full force and effect from and after its passage, approval and publication.
