TIONS THEREFOR, AIVD PRESCRIBING P�NA�.TIE�" FOR THE VIOLATION THEREOF. BE IT QRDATNED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENT(3N AS FOLLt}WS: SECTIQN I: For the purposes of this Qrdinance, certain terms are herewith defined: ��). ��e tercn "swimming pooln shall mean any structure or can- tainer, eitt�er above or below grade, lacated e3ther in part � ar zaholl;� outszde of permanently en.closed and roafed build» ing, design,�d to hald water ta a depth of greater than twa feet when filled to capacity, inCended for immersion of the human body, whethez for swimaning or wading or both, (b). The term „privaten shall mean that it is not open, to the public, thaC it is not publicly owned, or not otherwise regulated by the State of Washington, either by statute, or by rules ar regulatians of one af 3ts admin3.sCrative bodies. (c}. The term �person" shall include all individuals, groups of individuals, co-partn�erships, ,�ssociatians, firms ar cor.. porations. The singular shall include the plural and the masculitte the ferninine. SECTION TI: It shall t�e unl�wful far any person ta cor�,struct or main•- tain an outdoor swi�ning pool without first making application ta �he City Engineer� ing Depart�nt arcd obtaining a permit therefor. SECTION IIT: Applic�tion for such perinit shall show the name of the owner, the location of the proposed swimming pool, the safety precautions to be made to protect those makin.g use thereof, informatian shawirtg the si.ze, d.epth and capacity of such swirr�ing poc�l, together with a c�mplete and detailed set of glans and sgeci- fica�ians of said swimming pool, an,d such other information as may reasonably be necessary for the protection of public health and safety as may be required by the City Er�ggineering 33epartanent. There shall also be filed with the Ci.ty Ercgineering Departxnen.t a plot plan of the graperty cahich shall also remain on deposit with the City, showing tine location of such swimming poal thereott, tagether with full infor» matian as to the type, height and locat3on af the fence surround'zng said swimming pool and the number of gates. A11 apglicatians for a permit shall be accompanied by the apgropriate fee as established hy the "Unifarm Build.ing Gode ot the City of Rentann, -1-» SECTI�N IV: For the protection of the citizexts and general public, all swimming pools permanently constructed shall be completely enclosed by a substantial wall or fence of not less than four (4) feet in height. Any wall or fence shsll be so constructed so as not to have openings, holes or gaps larger than two inches in any dimension, except for doors and gates. If a picket fence is erected the horizontal dimensions between pickets shall not exceed two inches, and all openings in such wall fence shall be equipped with gates having a self�latching, self�closing device with the latch on the inside of the gate not readily accessible for children to operate, and such gate shall � be securely locked when the swimming pool is unattended or uncovered; provided however, if� premises �f the residence in which said p�ol is loc�ted is enclosed, then this provision may be waived by the City Engineering Department upon 3n� spection and approval of the residence enclosure; provided further that swinaning pools already constructed and in operation shall comply with this sub�section within ninety {90) day� af ter the passage of this Ordinance. The City Engineering Department may make modification in individual cases upon showing of good cause, with respect to the height, nature or location of the fence, wall, gates or latches, or the necessity therefor, provided the protection as sought hereunder is not reduced thereby. The City Engineering Department may permit other protective devices or structures to be used as long as the degree of protection afforded by substitute devices or structure is not �ess than the protection afforded by the wall, fence, gate and latch described herein. SECTION V: No electric serviee conductors or vther overhead wires shall be located above any pool, and any existing conductors shall be re-routed, if inter� ference is unavoidable, either overhead, to �void confliction,or installed underground. SECTIUN VI: Any electrical outlets or appliances or devices shall be water- proof and grounded in accordance with the prevailing Electrical Code of the City of Renton, if installed or used within eight (8) feet of the perimeter of the pool. SECTION VII: All private swi�aning pools shall be constructed or placed so as to have a side yard of not less than six (6) feet in width on each side, a rear yard of not less than six (6) feet in width and a front set-back of not less than thir�y (30) feet. _2� SECTION VIII: All underwater lights must be water tight, self«contained units with their own �ground�� connection running from a water proof junction box to a proper grounding facility or medium. All underground electric wires supplying current to said light or lights, within a distance of five feet of the pool wall or walls, must be enclosed in rigid conduits. i SECTIQN IX: All metal fences, enclosures or railings near or adjacent to pr3vate residentisl swiTTsning pools which might become electrically alive as a result of contact with broken overhead conductors, or from any other cause or source, shall be effectively grounded. SECTI�N X: No person shall maintain an outdoor swim�ning poal on his pre� mises with0ut providing adequate supervision at a11 times when the swimming pool is in use so that no. person may be injured or drowned therein. SECTION XI: Al1 privately owned swimming pools shall be equipped with the water circulat3ng system powered by a motor driven pump to circulate campletely the water within such pool every twenty four {24) hours. The Health D�ficer crf the City of Rentan may approve other rates of re-circulation or rates of application of water on the filters. Provisions shall be made for positive germicidal or bacterial control by the use of chbrine, bromine or other such disinfecting agents as may be approved by the City Health Officer. Any such disinfectin,g agent shall be applied to the pool water at a uniform rate. SECTION XII: The City Health 9fficer and/or a duly authorized repre•• sentative of the City Engineering Department shall have the right at any reasonable hour to inspect any private swirnming pool for the purpose of determining that a11 provisions of this Ordinance are fulfilled and complied with. SECTIQI�T XIII: Lights used to i lluminate any switrsning pool or fami Iy pools shall be so arranged and shaded so as to deflect light away fram any adjoining premises. It shall be unlawful for any person to make, c4ntinue, or eause to be made or continued at any swimming pool, any loud, unnecessary or unusual noise, or any noise which annoys, distuzbs, injures or endangers the comfort, repose, health, peace or safety of others. In the operation of a private swimming pool, the use or permitting the use or operation of any radio, receiving set, musical in�trument, or phonograph or other machine or device for the producing or re•producing of svund in such manner as to disturb the peace, quiet and comfort of the neighboring inhabitants w 3w or at any time with louder volume than is necessary for the convenient hearing of the person or persons in the swimming pool premises shall be unlawful. SECTION XIV: Any person violating any of the terms or conditions of this Ordinance shall, upon conviction thereof, be punished by a fine of not to exceed One Hundred Dollars ($100.00) or by impr�sonment of not to exceed thirty (30) days in the City jail, or by both such fine and irnprisonment. �r .��.--� PASSEA BY THE CITY COUNCIL this � da�.Tof At�st, 1959. .
