ORDINANCE NO. 1791 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF A SANITARY SEWER SYSTEM IN THE TALBOT HILL AREA OF THE CITY OF RENTON, ALL IN ACCORDANCE WITH RESOLUTION NO. 1014 OF THE CITY COUNCIL OF THE CITY OF RENTON; CREATING A LOCAL IMPROVEMENT DISTRICT THEREFOR; PROVIDING THAT PAYMENT FOR SAID SANITARY SEWER SYSTEM BE MADE BY SPECIAL ASSESS- MENTS UPON PROPERTY IN SAID DISTRICT, PAYABLE BY THE MODE OF "PAYMENT OF BONDS"; CALLING FOR BIDS FOR THE PURCHASE OF LOCAL IMPROVEMENT DISTRICT WARRANTS TO BE ISSUED IN CONNECTION THEREWITH; AND AUTHORIZING THE CALL FOR BIDS FOR THE CONSTRUCTION WORK, AND FURTHER DETERMINING THAT THE CONSTRUCTION OF SAID SANITARY SEWER SYSTEM IS NECESSARY FOR THE PUBLIC HEAYTH AND SAFETY, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, AS FOLLOWS: SECTION I: Pursuant to Resolution No. 1014 of the City Council cf the City of Renton# adopted on the 25th day of August, 1959, declaring the Intention of the City Council to order the improvements hereinafter described, a hearing on such Resolution having been duly and regularly held on the 15th day of September, .1959, -after notice thereof having been given in the manner provided by law and publications thereof in the City's legal newspaper, it is hereby ordered that the follcwing System of sanitary sewers be immediately constructed and installed, together with all necessary manholes, access- ories, and equipment appropriate thereto, and all ether work incidental thereto, to -wit: FROM TO ALONG LENGTH SIZE Busch Place loth Avenue South Shattuck St, S. 3160! 8" 13th Ave. S. lith Avenue South Davis Street S. 1360' 8" 13th Ave. S. SECTION II: IT HAS BEEN DETERMINED AND ESTABLISHED BY THE CI'Y COUNCIL that the costs and expensed of the proposed improvement and the assessments which m_ay be assessed against the property within such Improvement District will exceed the _1_ assessed valuation of the real estate, together with twenty-five per cent -(25%) of the actual valuation of the improvements located therein; it has further been deter- mined, unanimously; by the City Council of the City of Renton that the construction of said sanitary sewer system is necessary and required for U e preservation of public health and safety; furthermore, the Health Officer of the City of Renton and the County Health.Department have ,likewise determined and established that such improvement is necessary and required for the preservation of public health and safety. SECTION III: The cost and expense of said improvements, including all necessary and incidental expenses thereof, shall be borne by and assessed against the property included in the assessment district hereinafter .created, in accordance with law, and the City of Renton shall not be liable in any manner for any portion of the cost and expense of such improvements. SECTION IV: There is hereby established a -Local Improvement District to be called NLocal Improvement District No. 24411, which .District includes all the property within the following described are4 all within the city limits of the City of .Renton, Washington, to -wit: , Beginning at a point of intersection with the south line of 13th Avenue South produced east and the east line of Section 19-23-5; thence North along the east line of said Section 19 to the North line of 11th Avenue South produced East; thence West along the North line of 11th Avenue South to the.East line of Block 4,.Rent6n View Addition; thence North along the East line of Block 4, -Renton View Addition to the South line of :Primary State Highway No. 1 FAI- 405 Alternate Renton to Kirkland; thence Westerly along the South Right -of - Way line of said Primary State Highway No. 1 to an intersection with the North- western line of 10th Place South; thence Southwesterly along the Northwewtern line of 10th Place South to the North line of 10th Place South; thence West along the North line of 10th Place South to West line of:Lot 42 to 62 inclusive, Block 7, C. Acre .Plat No. 2; thence due North 150 feet to -the South line of 13th Avenue South; thence East along the South line of said 13th .Avenue South to the true point of beginning. SECTION V: All property included within the limits of the Local Improvement District above .created shall be m nsidered to be the properties specially benefited by the local improvement and shall be the property to be assessed to pay the cost and expense thereof. The nature of the improvement is such that the special benefits conferred on the property are not in all cases properly and fairly reflectdd by the use -2- of the zone and termini method of assessment, and it is hereby provided and ordered that the assessment in .such cases shall be made against the property of the district in accordance with the special benefits received. Furthermore, in distributing the assess- ments in the case of "trunk sewers there shall be levied against the property lying between the termini of the improvement and back to the middle of the blocks along the marginal lines of the area improved such amounts as would represent the reasonable cost of a local sewer and its appurtenances suited to the requirements of the property, and the remainder of the cost and expense of the improvement shall be distributed over and assessed against all of the property within the boundaries of the district. SECTION VI: There are hereby created and established in the office of the City Treasurer of the City of Renton for Local Improvement District No. 244 the following funds,.to-wit: (a) "Local Improvement Fund, District No. 244-" into which Fund shall be deposited all payments made upon assessments in said District :for the redemption of the warrants and bonds herein authorized; and (b) "Construction Fund", into which fund shall be deposited the amount received from the sale of the,Local Improvement District Warrants of the District herein authorized to be issued and sold, and against which Fund warrants shall be issued to the contractor or contractors in payment of the work to be done by them in con- nection with said 'improvements and against which Fund warrants shall be issued in payment of all other items of expense in connection with said improvements. SECTION VII: Local Improvement. District -Warrants shall be issued from time to time, in such amounts as the City may determine, to obtain the fund with which to pay the cost and expense of the improvement. Such Warrants shall be payable out of said,"Local Improvement Fund, District No. 244", and shall bear interest from date hereof at a rate not to exceed five per cent (5%) per annum, all Warrants to bear the same rate of interest, and shall be redeemed either in cash or by local improvement district bonds herein authorized to be issued. Bonds bearing interest at the same rate as said warrants and payable on or before twelve (12) years from the date of issuance shall be issued in exchange for and in redemption of any and.all warrants drawn on the "Local Improvement Fund, District No. 24411, and issued hereunder not redeemed in cash within a period of not to:exceed sixty (60) days after the first publication of Notice of.Collection of Asses-sments by the City Treasurer. Said bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said District payable in ten (10) equal annual installments ..3,. ■ V � • with interest at a rate not to exceed five per cent (5%) per annum and not less than the said bonds shall bear, under the mode of:"Payment by Bondst' as defined by law in the Ordinances of the City of Renton. The exact amount, form, date, interest rate and denomination of said warrants and bonds and the interest rate on said special assessments shall be fixed hereafter by Ordinance of the City Council of the City of Renton. SECTION VIII: The City Treasurer of the City of Renton is hereby directed to cause to be published in the Renton Chronicle of the City of Renton and in .the Daily Journal of Commerce of the City of -Seattle, in both of their respective issues of October, 1959 and October, 1959, a Notice of:Warrant Sale calling for sealed bids for thepurchase of said Local Improvement District Warrants, redeemable in cash and bonds as herein provided, to be received by the City Treasurer at her office in the City Hall, Renton, Washington, until 8:00 P.M. on the day of November, 1959, at which time all bids received will be publicly opened by said Treasurer and the City Council. The bids submitted shall specify either (a) the lowest rate of interest and premium, if any, above par at which said bidder will purchase said warrants; or (b) the lowest rate of interest at which the bidder will purchase said warrantsat par. The City reserves the right to reject any and all bids submitted. The City will furnish the warrants and the bonds issued in redemption thereof, together with the approving legal opinion of Preston, Thorgrimson & Horowitz, bond counsel of.Seattle, Washington, without cost to the purchaser. SECTION IX: The City Engineer of the City of Renton is hereby authorized and directed to call for bids, in the manner provided by law, for the construction and instal- lation of the improvements authorized herein, and said call for bids shall:,include a statement that payment for said construction and installation will be made in cash warrants drawn upon the "Construction Fund" of.Local Improvement.District No. 244 o -f the City of Renton.
