AVENUE FROI'T 01HITVORTH S'T'REET TO SHAT'TUCK STREET, ALSO SHAl'TUCK STREET FROM WALLA WALLA AV"EN-t E TO SEVENTH AVENUE BY INSTALLING AND CONSTRUCTING �VFIATER MAIN, INCLUDING FIRE H-CDRANT, GATES, VALVES, F'ITTII3GS AND DOING SUCH OTHER ;'UORK AS NECESSARY IN CONNECTION ^1HRIITH; OR'A'TIItitG A LOCAL IMPROVEMENT DISTRICT THEREFOR; AND PROVIDING THAT PALITENT FOR SAID IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTS UPON PROPERTY WITHIN THE SAID DISTRICT PAYABLE BY THE MODE OF IIiiEE.D IAT` ; PAYMENTS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RENT'ON, WASHINGTON: Section 1: WHEREAS a proper petition for the making of the improve- ments hereinafter referred to has heretofore been filed with the City by thb owners Council of Renton signed/of the property comprising a majority of the lineal frontage upon the improvements petitioned for and also of the area within the limits of the assessment district to be created therefor, said petition setting forth the nature and territorial extent of the proposed improvement, the mode of payment and said petition being found sufficient and accompanied by a diagram or print prepared by the City Engineer show- ing the lots, tracts or parcels of land and other property to be specially benefited thereby and the estimated amount of the cost and expense of such improvement to be borne by each such lot, tract or parcel of land or other property; and the City Council thereafter by its Resolution No. 709, adopted September 21, 1948 having fixed a date for hearing on -said petition and having published notice of its intention to order the improvement requested and such hearing being held by the City Council at the time and place specified in said resolution and in said published notice, to -wit, at the City Hall in Renton at 8 PNS on October 19, 1948; and no sufficient protest having been filed or made at said 'nearing against the granting of said petition or the making of said improvement on the basis proposed and petitioned for; NOW THEREFORE, IT IS HEREBY ORDERED AND ORDAINED AS HERE- INBELOW SET FORTH. Section 2: That the followingx streets in the City of Renton, Wash- ington, to -wit: (a) Walla Walla Avenue from Whitworth Street to Shattuck Street, (b) Shattuck Street from Walla Walla Avenue to Seventh Avenue, be improved by constructing and installing therein a 6" water main, install- ing fire hydrants, gates, valves and fittings and doing such other work as may be necessary in connection therewith, all in accordance with plans prepared by the City Engineer and on file in his office. -1- Section 3: That the cost and expense of said improvement including all necessary and incidental expenses, shall be borne by and assessed against the property included in the assessment district hereinafter and created in accordance with law, the City of Renton shall not be liable in any manner for any portion of the cost and expense of said improve - sent, except only that the cost and expense of said improvement on walla Walla Avenue from Whitworth Street to Shattuck Street shall be borne by the City of Renton . t. Section 4: There is hereby established a Local Improvement District to be called "Local Improvement District No. 226 ", which said district is described as follows: All the property between the terminii of said improvement along Shattuck Street from Walla Walla Avenue to Seventh Avenue in the City of Renton, which is abutting upon, adjacent, vicinal or proximate to such portion of such streets and avenues to a distance back from the marginal lines thereof as provided by law. Section 5: That the cost and expense of said improvement, which is not hereinabove specifically provided to be borne by the City of Renton, shall be defrayed by special assessment payable by the mode of immediate payment as defined by law and the Charter and Ordinances of the City of Renton. Warrants bearing interest at the rate of four per cent (4%) per annum until paid shall be issued to the contractor for the redemption of as many of the warrants issued on the Local Improvement District fund based on estimates of the City Engineer as may not be redeemed in cash. Section 6: This Ordinance shall be in full force and effect five days from and after its passage, approval and publication.
