6.CONSENT AGENDA
The following items are distributed to Councilmembers in advance for study and review, and the
recommended actions will be accepted in a single motion. Any item may be removed for further
discussion if requested by a Councilmember.
a. Approval of Council meeting minutes of 10/11/2010. Council concur.
b. City Clerk submits quarterly contract list for period 7/1/2010 through 9/30/2010 and expiration
report for agreements expiring 10/1/2010 to 3/31/2011. Information.
c. City Clerk reports bid opening on 10/12/2010 for CAG‐10‐120, Lake Washington Beach Lift
Station Replacement project; 14 bids; engineer’s estimate $330,376.83; and submits staff
recommendation to award the contract to the low bidder, Kamins Construction, in the amount
of $293,060.11. Refer to Utilities Committee for discussion of funding.
d. Community and Economic Development Department recommends acceptance of a deed of
dedication for additional right‐of‐way for widening of Duvall Ave. NE to fulfill a requirement of
the Nazarian Short Plat (SHP‐06‐037). Council concur.
e. Finance and Information Technology Department recommends a public hearing be set on
11/1/2010 to consider the 2011/2012 Revenue Sources and Preliminary Biennial Budget, and a
public hearing be set on 11/15/2010 to consider the 2011/2012 Biennial Budget. Refer to
Committee of the Whole; set public hearings.
f. Police Department recommends accepting grant funds in the amount of $42,164 from the
Edward Byrne Memorial Justice Grant Program for the purchase of 24 Automatic External
Defibrillators (AED) and for training officers in their deployment. Council concur.

SUMMARY OF ACTION:
Engineer's Estimate: $330,376.83
In accordance with Council procedure, bids submitted at the subject bid opening met the following three
criteria: There was more than one bid, there were no irregularities with the low bid, and the bid was
within project budget. However, the total bid amount exceeds 2010 budget authority. Therefore, staff
recommends acceptance of the low bid submitted by Kamins Construction in the amount of
$293,060.11, and utilization of 2011 budget authority to cover project costs.
STAFF RECOMMENDATION:
Accept the low bid by Kamins Construction in the amount of $293,060.11, and refer the issue to the
Utilties Committee for discussion funding.

The Public Works Department has reviewed the bids submitted for the Lake Washington
Beach Lift Station Replacement project and recommends that the bid be awarded to
Kamins Construction. We are requesting that an agenda bill be prepared for the
October 18, 2010, Council Meeting.
The agenda bill should be for "Refer to Utilities Committee". The total bid amount
exceeds our 2010 budget authority. The project will need the Utilities Committee's
recommendation as it will be utilizing 2011 budget authority as proposed in our 2011
budget submittal.
The bid opening was on Tuesday, October 12, 2010. There were 14 bids received. There
was a minor math error in one submittal that did not affect the order of the bids:
The low bidder is Kamins Construction, with a bid of $293,060.11. The engineer's
estimate was $330,376.83.
The project budget amounts are $250,000 (2010) and $400,000 (2011). The low bid is
within the amount budgeted for the combined 2010/2011 budget for this project.
The project will build a new lift station to replace the station that provides sanitary
sewer service to the south part of Coulon Park. The existing station has reached the end
of its useful life

SUMMARY OF ACTION:

ISSUE:
Should the City of Renton accept Edward Byrne Memorial Justice Assistance
Grant Program funds in the amount of $42,164.00 to purchase 24 Automatic External
Defibrillators and training for patrol officers?
BACKGROUND:
The developing industry standard in this region is to make available state of the
art, life-saving equipment and training to provide our citizens with the best public safety
services available.
Recently commissioned members of the Renton Police Department completed
training for the latest CPR protocols and hands-on practice. As part of this training
block, we included a segment on the use, application, and success of the Automatic
External Defibrillator (AED). We proposed the purchase of AEDs to be placed in the
trunk of each patrol vehicle in our fleet through an Edward Byrne Memorial Justice
Assistance Grant Program and were recently granted those funds. Each officer would
receive comprehensive training in the deployment and hands-on application of the AED
therapy. National statistics bear out the necessity of this protocol and use of the AED.
Recent studies point to the significance of this program and the value in saving lives.
Those statistics are alarming:
·400,000 people die every year from Sudden Cardiac Arrest (SCA) and 7,000 are
children; more people die from SCA than from breast cancer, prostate cancer,
AIDS, house fires, handguns and traffic crashes combined.
·Shocking the heart into a normal rhythm, called defibrillation, is the only
effective treatment for SCA. For the best chance of survival, a shock should be

administered within five minutes. Without defibrillation in the first six minutes
the majority of victims do not survive.
·Survival rates are over 75 percent when AEDs are readily available. The national
average survival rate from SCA is only four percent.
·The American Heart Association estimates that increased access to AEDs could
save 50,000 lives each year.
By utilizing the generous assistance of the Edward Byrne Grant Memorial Justice
Assistance Funds, we propose to purchase 24 AED units, and train our officers in the
deployment of the therapy associated with them. Each unit will be stored and
transported in the security of our patrol cars and will be ready for use in the instant of
need. Time is of the essence and a fast, first responding technician who is trained in the
use of AEDs can mean the difference between life and death.
A thorough review and evaluation of product choice was conducted. For our
application and service the LIFEPAK CR PLUS was selected to purchase. Competitive bids
were submitted and the most economical and practical choice was made. The grant
allows for the initial purchase of 24 units. There is every intent to budget for additional
units as funds become available. A total of thirty-five (35) marked vehicles, four (4)
supervisory and seven (7) command vehicles are in the future for AED equipping within
the 4-year grant period. There is an added budgetary consideration of $40.88 per year
/unit to cover the expense of a Replenishment Pak that is required by the FDA for each
in-service unit. The $40.88 figure is amortized over the four year grant funding period.
That cost will be absorbed in our departmental budget. The product description and
cost association is listed below. Training and certification in the deployment and use of
the AED is provided upon request by the manufacturing company, Pacific Medical
Systems and without cost to our agency. The costs are itemized covering the initial
purchase and include the Replenishment Pak to insure the units are fully operational at
all times. The totals reflect the amount of the grant award of $42,164 and the City of
Renton Police Department’s contribution of $3,046.00 to cover the cost of purchasing
the periodic upgrades demanded by the FDA of each unit over the four-year life of the
grant.
RECOMMENDATION:
Approve and Authorize Mayor Law to accept the Edward Byrne Memorial Justice
Assistance Grant Program funds that have been awarded to the City of Renton in the

THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS
FOLLOWS:
SECTION I. Subsection 4-10-050A.4, Enlargement, of Chapter 10, Legal
Nonconforming Structures, Uses and Lots, of Title IV (Development Regulations) of Ordinance
No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby
amended as follows:
4. Enlargement:
a. The structure shall not be enlarged unless the enlargement is
conforming^or it is consistent with the provisions of a rebuild approval permit
issued for it.
b. Nonconforming enlargements may only be allowed at the discretion
of the Administrator of the Department of Community and Economic
Development or designee if the enlargement is shown to be moving towards
conformity and is either:

AS URBAN SEPARATOR OVERLAYS.
WHEREAS, the King County Countywide Planning Policies designate certain properties in
the County as "Urban Separators" and Countywide Policy LU-27 calls for the preservation of
Urban Separators as permanent low density lands which protect adjacent resource lands, Rural
Areas, and environmentally sensitive areas and states that the maintenance of these areas is a
regional as well as local concern and further provides that modification to development
regulations should have King County review and concurrence; and
WHEREAS, the Renton Comprehensive Plan Community Design element establishes
policies that designate areas that are low density areas and areas that are environmentally
sensitive or critical areas as Urban Separators; and
WHEREAS, the City seeks to ensure that Renton development regulations provide the
same or better level of protection for Urban Separators as is provided by King County
regulations; and
WHEREAS, the City having held a public hearing to consider the Urban Separator
designations on September 29, 2010, and the designations being in conformity with the City's
Comprehensive Plan, as amended, and the City Council having duly considered all matters

MUNICIPAL COURT.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS
FOLLOWS:
SECTION I. Chapter 1, Executive Department, of Title III (Departments and Officers)
of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton,
Washington", is hereby amended to add a new section 7, entitled "Public Defense Service
Standards", as follows:
3-1-7 PUBLIC DEFENSE SERVICE STANDARDS:
A^ Service Delivery: The executive branch will have exclusive oversight ofthe
provision of public defense services. The City will provide for indigent defense
through contracting with public defense counsel ("counsel") in keeping with
RCW 10.101.030, within the terms of such individual contracts.
IL. Duties and Responsibilities of Counsel: Counsel shall follow the duties
and responsibilities set forth in the individual contract. Among other things, all
public defense services shall be provided to all clients in a manner which meets
or exceeds the standards set forth by the Rules of Professional Conduct, the
Washington State Bar Association, case law and applicable court rules. These

case duties and responsibilities include, but are not limited to, a thorough
investigation of the facts: research of relevant law; communication with each
client about the known facts: applicable law and local court rules, possible and
likely disposition or verdict, scheduling, and hearing and/or trial preparation;
appropriate motion practice: and vigorous representation of the client. In
addition to the standards provided in this section, counsel shall be required to
comply with such additional provisions established in the individual contract
including maintenance of professional liability insurance. Finally, public defense
services should only be provided to those persons who meet the criteria set
forth in RCW 10.101.010(1) or (2). If a public defense service provider is
appointed to a person who does not meet these criteria, the public defense
service provider must immediately bring this to the attention of the court and
the executive branch designee.
C Qualifications of Counsel: Counsel shall be licensed to practice law in the
State of Washington, be members in good standing of the Washington State Bar
Association, comply with all applicable rules relating to the practice of law that
have been and will be promulgated by the Washington State Supreme Court and
be capable of performing all necessary duties stated in the individual contract-
Counsel shall have the requisite skill to perform each ofthe required duties and
responsibilities. Legal interns employed by counsel shall meet the requirements
set out in Admission to Practice Rule 9.

D. Training, Supervision, Monitoring, and Evaluation: The training,
supervision, and monitoring of counsel and staff shall be the sole responsibility
of counsel, except as provided in the individual contract. Evaluation of counsel
shall be as provided in the individual contract. All training and supervision shall
conform to the standards set by the Rules of Professional Conduct, the
Washington State Bar Association, case law and applicable court rules-
Consistent with RCW 10.101, attorneys providing public defense services must
attend training approved by the Office of Public Defense at least once per
calendar year.
E. Disposition of Client Complaints: A method to respond promptly to client
complaints shall be established in the individual contract. Generally, counsel
should immediately respond to the complaint, and if the complaint is still not
resolved, the individual contract shall specify to whom the complaint shall be
forwarded in the Executive Department.
L Compensation: Compensation of counsel shall be established through
negotiation of an individual contract for public defense services, and determined
generally by number of cases appointed. However, through negotiation there
can be compensation that includes base monthly compensation, so long as the
average per case compensation is in accordance with RCW 10.101.030 and
comparable with surrounding jurisdictions of like services and time. In
determining compensation, Renton shall consider counsel's training, experience,
general court practices, including but not limited to the ability of counsel to

withdraw upon disposition or other circumstance, nature of plea bargaining
practices of the City of Renton's Prosecutor, experience and the nature and
extent of services requested, court calendaring, in court time, and time and labor
required of the attorneys undertaking the defender services. Services that
require extraordinary fees such as investigation, expert witness services, support
or other services, will be separate and distinct from per case compensation or
base compensation and defined in the individual contract.
G^. Case Load Limits and Types of Cases: The types of cases for which
representation is to be provided and maximum recommended number of cases
which each attorney shall be expected to handle shall be established by the
individual contract. Attorney caseloads shall allow counsel to give each client
the time and effort necessary to provide effective representation. Case load
recommended limits should be determined by the number and type of cases
being accepted, the years of experience of the attorney, the years of City
experience the attorney may have, the court's general practices with regard to
acceptance of pleas and withdraw of counsel. As noted above, public defense
services should only be provided to those persons who meet the criteria set
forth in RCW 10.101.010(1) or (2).
hL Administrative and Client Support Services: Administrative costs of
providing representation and necessarily incurred in the day-to-day
management of the individual contract shall be addressed in the individual
contract. Renton will make available a meeting space for client appointments

close to the Court. Counsel shall staff his/her office with an appropriate number
of support staff and other support services and maintain contacts with social
service agencies in order to refer clients to services as needed.
L Reporting Procedures: Counsel shall maintain records consistent with
RCW 10.101.030 and 10.101.050. Counsel case reporting and management
information shall be maintained independently from client files in order to not
disclose any privileged information. All reports shall be directed to Executive
Branch or its designee. All records pertaining to expenses and billing shall
conform to generally accepted accounting principles.
J. Substitution of Counsel and Assignment of Contracts: No substitution of
counsel for any appointed case will be approved without prior notification to the
appropriate court. Counsel shall not assign or subcontract any portion of the
individual contract without the consent of Renton.
JC Limitations on Private Practice: Counsel shall only maintain a private
practice as the individual contract specifically allows, and may not interfere with
the performance of duties outlined in the individual contract.
L Termination of Contract or removal of Counsel: The termination of an
individual contract for public defense services will be determined by the
provisions set forth in the individual contract. Removal of counsel from
representation by the court normally should not occur over the objection of both
counsel and the client.

M. Prohibition of Discrimination: With respect to all matters regarding public
defense services, there shall be no unlawful discrimination against any person
because of race, color, creed, gender, national origin, physical or mental
disability or sexual orientation. The City of Renton and counsel shall comply with
and ensure compliance with Title VI of the Civil Rights Act of 1964 and the
Americans with Disabilities Act of 1990 and all requirements imposed by or
pursuant to regulations of the United States Department of Justice or United
States Equal Employment Opportunity Commission issued pursuant to those
titles.
SECTION II. This ordinance shall be effective upon its passage, approval, and thirty
(30) days after publication.

4-1-170, LAND USE REVIEW FEES, AND SECTION 4-1-180, PUBLIC WORKS FEES,
OF CHAPTER 1, ADMINISTRATION AND ENFORCEMENT, OF TITLE IV
(DEVELOPMENT REGULATIONS) OF ORDINANCE NO. 4260 ENTITLED "CODE OF
GENERAL ORDINANCES OF THE CITY OF RENTON, WASHINGTON" TO REMOVE
DEVELOPMENT FEES FROM THE RENTON MUNICIPAL CODE AND ADD THEM TO
THE CITY OF RENTON FEE SCHEDULE BROCHURE.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS
FOLLOWS:
SECTION I. Section 4-1-140, Building Fees, of Chapter 1, Administration and
Enforcement, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of
General Ordinances of the City of Renton, Washington", is hereby amended to delete
subsections 4-1-140A through 4-1-140O, to renumber subsection 4-1-140P, Refund of Building
Division Fees, as section 4-1-140 and to amend as follows:
PT 4-1-140 REFUND OF BUILDING DIVISION FEES:
4A. Authority to Refund Fees: The Development Services Director may
authorize the refunding of any fees paid hereunder which were erroneously paid
or collected.
2B. Amount Refunded:
al. Permit Fee: Due to the City's cost in screening, accepting, and initial
processing of land use applications the Development Services Director may
authorize the refunding of not more than eighty percent (80%) ofthe permit fee

paid when no substantial work has been done under a permit issued in
accordance with this Code.
b2. Plan Review Fee: Due to the City's cost in screening, accepting, and initial
processing of land use applications, the Development Services Director may
authorize the refunding of not more than eighty percent (80%) of the plan
review fee paid when an applicant for a permit for which a plan review fee has
been paid is withdrawn or cancelled before any substantial plan review effort
has been expended.
3C. Method of Obtaining Refund and Time: The Development Services
Director shall not authorize the refunding of any fee paid except upon written
application filed by the original permittee not later than one hundred eighty
(180) days after the date of the fee payment.
SECTION II. Subsection 4-1-160D.5, of subsection 4-1-160D, Fee Calculations, of
Chapter 1, Administration and Enforcement, of Title IV (Development Regulations) of Ordinance
No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby
amended as follows:
5. The City Council may adjust the fee calculated under this subsection, as
needed, to take into account local conditions such as, but not limited to, price
differentials throughout the District in the cost of new housing, school
occupancy levels, and the percent ofthe District's Capital Facilities Budget which
will be expended locally. The City Council establishes the following feesi in the
City of Renton Fee Schedule Brochure.

SECTION III. Section 4-1-170, Land Use Review Fees, of Chapter 1, Administration and
Enforcement, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of
General Ordinances of the City of Renton, Washington", is hereby amended to delete
subsections 4-1-170A and 4-1-170C, and renumber subsection 4-1-170B, Refund of Land Use
Application Fees, as section 4-1-170, as shown below:
Br-4-1-170 REFUND OF LAND USE APPLICATION FEES:
The filing fees as set forth in the fee schedule for the City are established to
defray the cost of posting and processing and the proceedings in connection with
a land use application. The Community and Economic Department Administrator
may authorize the refunding of not more than eighty percent (80%) ofthe total
application fees paid provided the applicant presents a written request to
withdraw or cancel prior to the routing ofthe application for staff review. Eighty
percent (80%) of the applicable fee will be refundable if the application is
withdrawn prior to circulation by the Planning Staff. Once circulation (and review
has begun) no refund of base fees will be authorized.
SECTION IV. Section 4-1-180, Public Works Fees, of Chapter 1, Administration and
Enforcement, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of

General Ordinances of the City of Renton, Washington", is hereby amended to delete
subsections 4-1-180A through 4-1-180B, 4-l-180C.2.b, 4-l-180C.3.b.viii and 4-1-180D through
4-1-1801, to renumber subsection 4-1-180C, Charges for Equitable Share of Public Works
Facilities, as section 4-1-180 and renumber all subsections accordingly.
SECTION V. The first paragraph of section 4-1-180, Charges for Equitable Share of
Public Works Facilities (currently codified as subsection 4-1-180C), of Chapter 1, Administration
and Enforcement, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code
of General Ordinances of the City of Renton, Washington", is hereby amended as shown below.
All remaining language of this section shall remain as currently codified, except for those
amendments in sections VI and VII of this ordinance.
Owners of properties to which improvements are being proposed that have
not been assessed or charged an equitable share of the cost of public works
facilities, such as water systems, sanitary sewer systems, storm water systems,
and street improvements including signalization and lighting, shall be subject to
one or more ofthe charges listed in the following subsections City of Renton Fee
Schedule Brochure. Any fees triggered by improvements or development, as
detailed in this Section, are due and payable at the first of the following
instances:

codified as subsection 4-l-180C.3.c), of Chapter 1, Administration and Enforcement, of Title IV
(Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances ofthe
City of Renton, Washington", is hereby amended as follows:
€3. Segregation by Latecomer's Agreement: Segregation, if segregation is
permitted by the latecomer's agreement, will be governed by the terms of the
latecomer's agreement. Subsections (3)(a)C.l and (b)C2 of this Section shall
govern segregation insofar as they are not inconsistent with the latecomer's
agreement.
