AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTION 4-5-040, NATIONAL ELECTRICAL CODE, OF CHAPTER 5, BUILDING AND FIRE PREVENTION STANDARDS, OF TITLE IV (DEVELOPMENT REGULATIONS) OF ORDINANCE NO. 4260 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON, WASHINGTON", TO RENAME THE SECTION AS "RENTON ELECTRICAL CODE", ADOPT BY REFERENCE THE JUNE 22, 2009 WASHINGTON CITIES ELECTRICAL CODE, PARTS ONE, TWO AND THREE, AND REPEAL SUBSECTIONS 4-5-040C AND 4-5-040D. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION I. Section 4-5-040, National Electrical Code, of Chapter 5, Building and Fire Prevention Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby amended to change the title to "Renton Electrical Code". SECTION II. Subsections 4-5-040A, Adoption, and 4-5-040B, Electrical Permit Required, of Chapter 5, Building and Fire Prevention Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", are hereby amended as follows: A. ADOPTION: Tho "National Eloctrical Code," 2005 Edition, published by tho National Firo Protection Association, as amended by tho City of Ronton, is hereby adopted as tho National Eloctrical Codo, or NEC, 2005 Edition, for tho City of Ronton, and may horoaftor bo designated as "City of Ronton Eloctrical Codo, 2005." The June 22, 2009 Edition of The Washington Cities Electrical Code, Parts one, two and 7b. ‐ Community and Economic Development Department recommends  adoption of the 2008 National Electrical Code with City Amendments. Page 95 of 107 ORDINANCE NO. three, as published by the Washington Association of Building Officials, is hereby adopted by reference, and shall be known as the Renton Electrical Code. B. ELECTRICAL PERMIT REQUIRED: In addition to tho National Eloctrical Codo, a City eloctrical permit is required boforo any electrical work commences. The City shall at all times keep on file with the City Clerk, for reference by the general public, not less than one copy of The Washington Cities Electrical Code. SECTION III. Subsections 4-5-040C, Administration and Enforcement, and 4-5-040D, Amendments to the 2002 National Electric Code (NEC), of Chapter 5, Building and Fire Prevention Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", are hereby repealed. The estimated cost of the additional water from Seattle Public Utilities is $33,000. The money for the purchase of additional water will be from the approved 2010 Water Utility Operations fund (405). The Water Utility also requests Council’s approval to transfer $67,000 from the Automatic Meter Reading Conversion Project (425/455591) to the Water System Interties Upgrade Project (425/455445) for the construction of the upgrades to the interties. There will be no increase in the approved 2010 total Capital Improvement Project budget. The fund transfers will be reflected in the second quarter budget adjustment process. Wilson, Water Utility Engineer (ext. 7295) Water System Interties Upgrades and Purchase of Water ISSUE: Should Council authorize the re-appropriation of $67,000 to the Water System Interties Upgrade Project (425/455445) from the approved 2010 Capital Improvement Project budget - Automatic Meter Reading Conversion Project (425/455591) for the purpose of constructing three water system interties upgrades necessary for purchase of additional water from Seattle Public Utilities? RECOMMENDATION: Approve the re-appropriation of $67,000 to the Water System Interties Upgrade Project (425/455445) from the approved 2010 Capital Improvement Project budget for the Automatic Meter Reading Conversion Project (425/455591). BACKGROUND SUMMARY: The City has experienced an increase in water demand from population growth and from development within the City's water service area. In response to this increase, the City has implemented water conservation measures, provided our customers with water saving incentives, and adopted block water rates that promote conservation. As the peak water demand continues to grow, the City may purchase more water from Seattle, under our existing water supply contract, to meet future demand. The best locations to take more water from Seattle are the Fred Nelson Pump Station, Tiffany Park Pump Station, and the Boeing/Longacres intertie. These three interties require improvements to operate properly including, mechanical, electrical, and telemetry upgrades. 7d. ‐ Utilities Systems Division request authorization to re‐appropriate  $67,000 from the 2010 Capital Improvements Project (CIP) budget for Page 100 of 107 The City's water maintenance and operation staff will purchase the materials and install the upgrades so that the interties can be operational in July 2010. The estimated cost for the City's installation of the upgrades is $67,000 and the estimated cost for additional water is $33,000. The money for the purchase of additional water will be from the approved 2010 Water Utility Operations fund (405). The fund transfer will be reflected in the second quarter budget adjustment process. The Water Utility requests Council's approval to re-appropriate $67,000 from the approved 2010 Capital Improvement Project budget for the Automatic Meter Reading Conversion Project (425/455591) to the Water System Interties Upgrade Project (425/455445). CONCLUSION: The upgrades to the existing interties with Seattle Public Utilities are needed to make the interties operate properly and to allow the City to monitor flow through the interties. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION I. Section 4-5-040, National Electrical Code, of Chapter 5, Building and Fire Prevention Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", is hereby amended to change the title to "Renton Electrical Code". SECTION II. Subsections 4-5-040A, Adoption, and 4-5-040B, Electrical Permit Required, of Chapter 5, Building and Fire Prevention Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington", are hereby amended as follows: A. AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ESTABLISHING A BIENNIAL BUDGET PROCESS, PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Washington State Legislature has provided that any city may, by ordinance, elect to have a biennial budget in lieu of the annual budget, which is otherwise provided for; and WHEREAS, the provisions of Chapter 35A.34 RCW determine that an ordinance establishing the biennium budget must be adopted no later than June 30, 2010, in order to be effective January 1, 2011; and WHEREAS, biennial budgeting will provide an opportunity to streamline government services through better long range and strategic financial planning, a longer perspective on program planning, and consolidation of the effort invested in the budget development and approval process, thereby improving services to the citizens of Renton; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION I. Pursuant to Chapter 35A.34 RCW, there is hereby established a biennium budget for the City of Renton, beginning with the biennium starting January 1, 2011. The 2011- 2012 Biennial Budget and all subsequent budgets shall be prepared, considered, and adopted under the provisions of this ordinance and Chapter 35A.34 RCW. SECTION II. Pursuant to Chapter 35A.34 RCW the City Council shall provide for a mid biennial review, and any modification shall occur no sooner than eight (8) months after the 9b. ‐ Establish biennial budget process (See 8.a.) Page 105 of 107 ORDINANCE NO. start, but no later than the conclusion of the first year of the biennium. The Mayor shall prepare a proposed budget modification and shall provide for publication of notice of hearings consistent with publication of notices for adoption of other City ordinances. Such proposal shall be submitted to the City Council and shall be a public record and be available to the public. A public hearing shall be advertised at least once and shall be held no later than the first regular Council meeting in December and may be considered from time to time. At such a hearing or thereafter, the Council may consider a proposed ordinance to carry out such modifications, which such ordinance shall be subject to other provisions of Chapter 35A.34 RCW. SECTION III. Acts pursuant to this ordinance, but prior to its passage or effective date, are hereby ratified and confirmed. SECTION IV. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation.
