HomeMy WebLinkAboutORD 5791 CITY OF RENTON WASHINGTON ORDINANCE N0. 5791 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTIONS 4-2-110 AND 4-2-120 OF CHAPTER 2, ZONING DISTRICTS— USES AND STANDARDS, SECTION 4-9-065 OF CHAPTER 9, PERMITS — SPECIFIC, AND SECTION 4-11-010, DEFINITIONS A, OF TITLE IV (DEVELOPMENT REGULATIONS) OF THE RENTON MUNICIPAL CODE, BY AMENDING DENSITY BONUS REGULATIONS AND AMENDING THE DEFINITION OF "AFFORDABLE HOUSING." WHEREAS, the City recognizes that the development of affordable housing benefits the ' public; and WHEREAS, the City is enabled to allow increased residential density in exchange for defined public benefits; and WHEREAS, this matter was referred to and considered by the Planning Commission, and the text amendment request being in conformity with the City's Comprehensive Plan, as amended; and WHEREAS, the Planning Commission held a public hearing on January 6, 2016, and considered all relevant matters, and all parties were heard appearing in support or in opposition; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION I. The "Maximum Net Density" and "Maximum Number of Dwellings" rows in subsection 4-2-110.A, Development Standards for Residential Zoning Designations (Primary and Attached Accessory Structures), of Chapter 2, Zoning Districts— Uses and Standards, of Title IV (Development Regulations) of the Renton Municipal Code, are hereby amended as shown on Attachment A.The remainder of the subsection shall stay as currently codified. 1 ORDINANCE N0. 5971 SECTION II. REVIEW PROCESS: 1. Concurrent Review: Density bonus review shall occur concurrently with any other required land use permit that establishes the permitted density and use of a site, including subdivisions, site plan review, and Conditional Use Permits. When the development proposal does not otherwise require a subdivision, site plan review, or Conditional Use Permit to establish the 6 � ORDINANCE N0. 5971 permitted density of a site, but includes a density bonus request, the development proposal shall be reviewed under administrative site plan review requirements. 2. Authority: The Community and Economic Development Administrator shall determine compliance with the density bonus process unless the required land use permit as described in subsection 4-9-065.C.1��t#i���E��e;., Concurrent Review, requires Hearing Examiner review. 3. Submittal Requirements and Fees: An applicant shall submit applications and fees in accordance with the requirements for the primary development application�pursuant to chapters 4-1 and 4-8 RMC. D. BONUS ALLOWANCES AND REVIEW CRITERIA: 1. Affordable Housin : One 1 bonus market-rate dwellin unit ma be � 11 � v �ranted for each affordable dwellin� unit constructed onsite, up to the maximum bonus densitv allowed pursuant to subsection 4-9-065.D.3, Maximum Bonus Units. Affordable dwellin� units shall conform to the followin�standards: a. Duration: An a�reement in a form approved bv the Citv must be recorded with the Kin� Countv Recorder's Office reauirin� affordable housin� units provided under this Section remain affordable housin� for fiftv (501 vears or the life of the development, whichever is less. This a�reement shall be a covenant runnin� with the land, bindin� on the assi�ns, heirs and successors of the applicant to the satisfaction of the Citv Attornev. 7 ORDINANCE N0. 5971 b. Affordable Housin� Income Levels: Dwellin� units conditioned as affordable under this Section shall conform to the definition of Affordable Housin� pursuant to RMC 4-11-010, Definitions A. c. Affordable Unit Conditions: Affordable housin� units shall be provided in a ran�e of sizes and with features comparable to market-rate units. The low-income units shall be distributed throu�hout the development and have substantiallv the same functionalitv as the other units in the development. 2. Assisted Livin� Facilities: The development shall satisfv the definition of Assisted Livin� Facility pursuant to RMC 4-11-010, Definitions A. 3. The definition of "Affordable Housing" in section 4-11-010, Definitions A, of Chapter 11, Definitions, of Title IV (Development Regulations) of the Renton Municipal Code, is hereby amended as follows: AFFORDABLE HOUSING: Housing reserved for occupancv �-as a primary residence #e�-,a��by eli�ible households whose annual income does not exceed �� '^« *",^ eighty percent (80%) of the area median a�—income for ownership housin� or fiftv percent (SO%1 for rental housin�, adjusted for household size, as determined by the Department of Housing and Urban Development (HUD) for the Seattle Metropolitan Statistical Area, and who pay no more than thirty percent (30%) of household income for housing expenses. (Housin� expenses for ownership housin� include mort�a�e and mortga�e insurance, property taxes, property insurance, and homeowners' dues.
