AN ORDIAJAN�E Granting to the Seattls �.nd Rainier Val].ey Railway Corapany,
its success�rs and assigns, a iranchise to construct, maintain and operate
a corn�9rcial spur track in the City of Renton.
BE IT ORD�I1�Ell by the City of Renton, as follows: .
Ssction I. �hat t:�ere be and her�by is granted to thg Seatl;Ie and
Ftainier Valley Railway Company, a carporation, its successors and 3ssions, the
right, privilege and authority i;o locate, lay douvn and maintain tracks, C911-
�uits and a11 necessury equipmen-t of every sort and �o eract po3ss and stri�;
wires for strsst rail�ays, �.nd to construct, maintain ��d operate a systs:n
� of stre�t railc�ays within the city of t�enton upon the rout9s hereinaft�r de-
signa�ed, and to earry freight t�iereon, �.nu to charg� and cal7.ect zare
-th9refor, and �o enter upon any anC all of the stre�ts or �a:�t� of strpets
cornprised in �he routes hereinafter designated, for the purpose of con-
s�ructing, erecting, locata.ng, maintaining, repairing and re�►oving tracX:s,
poles, wires, conduits and squipr�ent of every sort, �.nd to oparate sai;z

Section 4. Sai d SeattlA and Rainier Valley Rail�aay Gompany, its
succassors a.nd assigns, hy acceptancQ of this franchise, hereby a�rees,
for itself, its successors and assi�ns, to protect c�nd save harmless

by reason o: any defective construction or maintenance or improper occupa-
tion of said right of way, or by reason of the nsgligant operation of
cars over said right of way, and in case suit or action is comrnenced against
said city for dama�es arisa.ng out of or by reason of such defective con-
struction, raaintanance, occupation or operai;ion, said Seattls and Rainier
�Ia1Zey Railway Co�pany, its successors anu assigns, �vill, upon propsr
notice to it of the coiTunencer�ent of said action, defend the st�ms at its
own cost and expense, .and fully sa�isfy such judgra�nt vrithin ninsty deys
aftar said action shall zave been finally determined, if cietermined
adversely to said ci�y of P,eni;on.
Section 5. That the grantes hersin, its succsssars or assigns may
rsmovs from a12 streets, avenues and public places, all parts and portions
oi thsir said roadbed and appurtsnances �;rithin thir*y days aft�?, notic�
�y the city of Rsnton of its int�ntion to improve said streets o.� avenues !
or any portion thereof, �rovided tnat v�ithin said thirty days said grantse,
i�s successars or assigns snall have pui the surface of' said streets,
avenues and public places in as good condition for pub7.ic travel and dura-
bility as the abutt�.nb portions thergof .
Section 6. In any case, this grant shall cease �.nd detsr�ine at
t��plve o'clock midnioht, ;r.ay 31, 19i9, and vrithin thirty days thereafter,
s�ici ;rantee, �ts successoi•s o: assigns shFzll hav� rsnoved irom all str�ets,
azrenues and public places all parts and portions of their said roadbed and
appurtenances, a.nd shall have put the surface of said strests, avenues
a.nd public placss in as good conclition for public travel and durability as
the abutting portion tliersof.
Ssction 7. Upon corapl�tion of constructi�n or repairs, the strests
and avenues and public ple.ces in whicn such construction or repairs have �
been made shall be l�ft in as good condii,ion for public travel as they
�rere before the commsnr,pment of such �:vork by thQ grantee, its successors
or assi�ns.
�ection 8. The City of �snton shall have ths rioht to attach or have
attachAd; any wires used for public purposas to any of the po3es placed

�aved, pZanked or macadamized, :h� o:uners of said railways shall maintain
a plank crossing aver their tracks at a7.1 atreet interssctions which ars

nuis over which the lines of said tracks shall extend shall be changed by
said city, said track shall be so adjusted and changed as to conforu� to s�.i.c1
gradp so established, said adjustment and change in �7.1 �hings �o be mads
at the cost and expensA of the o�mer or os��nsrs of said tracks. '1"h� o.�ner or

corporm-tion, or to any co;nmission appointed undPr the -�hen existin�; la�r�s of
th� Sta�s oi �rJashinoton, or to itself sxorcise ths right and privilege to
cans�ruct, lay �orrn, maintain and operate a lin� or lines of' railr�ay through,

reason of th� performance of such work or by ths exsrcise of any right pro-
vided or reserved in this ordinance.
Ssction 13. This ordinance snall not be so construed as to deprive
yne City of RQntan of any po�rers, righta or privileges �vhic.i it now has or
which may hpreafter be conferred upon it to ret;�alate ths use of �nd COri'�T'OZ
of the streets, svenues and alleys of said city.
SAction 14. That saici grantes, its successars or a.ss�;;ns, s:zall
forfeit and sh�ll �e deemsd to have forfeited and abandaned all rights,
�rivileges and fr�.nchisss conferred by tihis ordinance, unless �vithin thirty
days after the appr�val of this ordinance they file in th� office of ths
city clerk iheir writt9n acceptance of the rights and privilsges hereny
conferred, subject to the tsrms and conditions and restraints her�by i��os�d,
and in case of their failure so to do, �his ordinance shall '�e nu11 and void
and of no force and sffect ;rrhatever.

franchisa granted hsreby is no� operated in accardancs �ith ths provisi�ns
of th�s ordinance, or at all, and ths City of Renton ressrves th� ri�ht at
aszy time hereafter to so repeal, change or modify this grant .
Sec�ion 1? . This ordinance shall not bs construsd to aff'ect or i;�pair
the right af abutting property o�mers to ciaim or sue for dam�.ges: or in
any manner to affect the rights of said property oti7ners in the premises,
sxc9pt �.s it may bs deemed a protection to such property oe�rners �.nd their
