. THIS AGREEMENT made this ���day of ���, 1986, by and between
the CITY OF RENTON, a municipal corporation, (City herein) , and Gerald E.
and Gail M. Schneider, husband and wife ("7he Schneiders" herein) .
RECITALS
A. The Schneiders constructed the Hilitop Apartments, an apartment
proJect located on that certain real property in the City of Renton
legally described on Exhibit A, attached hereto and incorporated herein
by this reference (the "Property" herein) :
B. Approxtmately 300 linear feet tLF) ot 8-inch, P.V.C. sewer pipe
has been installed in a certain locations on the Property. The City has
� purchased ail such pvc pipe pursuant to a Bili of Sale recorded in the
. � Division ot Records and Elections, King County, Washington, Recording No.
� 8502150590.

Ounder certain balconies constructed on the Property, which installation
� is unacceptable to the City for maintenance purposes. The location of
� such portions of the pvc sewer pipe is specif(cally shown on the shaded
portion of Exhibit B, attached hereto and incorporated herein by this
reference and referred to as the "Sewer Lines� herein.
D. The Schneiders have requested that the City waive its
objections to the installatlon of the Sewer Line and the City has
therefore agreed to waive its obJections, subject to the terms and
conditions stated herein
AGREEMENTS
NOW, THEREFORE, in consideration of the mutual promises set forth
herein, the parties hereby agree as follows:
I 1 . The Schneiders covenant and agree, at its sole cost and
expense, to maintain, repair, and replace such Sewer Line on the Property
as such maintenance, repair and replacement of such Sewer Line, is, in
the reasonable discretlon of the City, necessary. In the event such
� maintenance, repair or re lacement is deemed necessar the C
P y, ity shall so
notify the Schneiders in writing. The Schneiders shall , upon receipt of
such notification, proceed with all due diligence to complete such
maintenance, repair or reptacement within a reasonable time thereafter,
weather and other condifiions permitting. .
2. The Schneiders shall indemnify and hold the Clty harmless from
any tn,Juries to persons or property, losses, damages, or any claims
caused by the location of such Sewer Line on the Property or from the
failure to adequately maintain, repair, and repiace said Sewer Line;
except as such injuries to persons, property, losses, damages or claims
may be in any way caused by the City�s gross negligence or the actions of
its employees, representatives or agents.

3. The covenants and agreements cor�tained in this Agreement shall '
be covenants running with the land and shall be binding upon the heirs,
successors, and assigns of the parties hereto.
4. This Agreement constitutes the entire agreement between the
parties and there are no other verbai or written agreements. Any
modifications of this Agreement must be made in writing by the parties
hereto.
