C`t � �� Now, therefore, in consideration of the mutual benefits � and covenants contained herein, it is agreed as follows : ., `' 1 . As of May 1, 1994, Renton shall assume full responsbility to provide water service to the transfer area, including all of the then-present customers of Seattle receiving service in the transfer area as identified on Exhibit A. Responsibilit�r for service includes the provision of industrial and domestic water service and fire protection in accordance with the policies of Renton and State law, and the collection of bills, assessments, and � other charges . � � 2 . Renton shall be responsible to collect and � promptly remit to Seattle at its own expense all amounts due � and owing for water services provided to customers on the o transfer area prior to the date of transfer. Renton shall � apply any funds received for payment of water �services by a �; customer with an outstanding Seattle account to such account � until such time that the outstanding Seattle account is paid in full . � � � 3 . Renton shall be responsible for notifying all �= customers affected by this agreement no less than 60 days � " prior to the date of transfer. Such notice shall inform the Q customers of Renton' s rates and the date such transfer is to o be effective. � � g 4 . Seattle agrees to provide Renton with copies of ; customer records, billings, books, consumption records, and � records relating to the facilities and property interests u transferred, including to the extent they exist, as-builts, � design drawings, and maps . -t.`. �•� , i � . � m , 5 . Seattle shall provide secondary fire service to the transfer area by providing a tap at such location and specifications as are indicated on Exhibit B. Such secondary fire service shall be metered by a meter supplied by Renton and shall be paid for at the effective fire service rate. Such secondary fire service shall back up the primary fire service which is to be provided by Renton and shall not be relied on as the primary fire service. Seattle may for emergency reasons temporarily discontinue such secondary service without advance notice to Renton, although . Seattle shall make reasonable efforts to notify Renton as soon as possible before or after such discontinuation. Seattle reserves the right to terminate the secondary fire service upon no less than 18 months prior written notice to Renton; if such termination occurs, the meter purchased by Renton if still operational shall be returned to Renton and shall be the property of Renton. 6 . Renton shall at its own expense construct such • facilities and purchase such supplies, including the water . meter, as are indicated on the plans for the secondary fire service shown on Exhibit B. If either Seattle or Renton determine in the future that the water meter needs to be changed to provide efficient or accurate metering, Renton ,� shall reimburse Seattle for the expense of the new meter � less any salvage value of the meter replaced. After such �3 facilities are operational, and have been inspected and � accepted in writing by Seattle, ownership of such facilities � shall thereby be deemed to transfer to Seattle, and Seattle � shall assume responsibility for maintaining such facilities :0 thereon. Seattle shall receive full warranties for such facilities (includin the meter) as if Seattle were the � g ��j original purchaser, and Renton agrees to allow Seattle to prosecute any cause of action in the name of Renton to the extent necessary to enforce any superior rights of Renton to enforce warranties or remedy any deficiency in the design or the construction. BACKGROUND: Attached is an agreement with Seattle to transfer water service and provision of secondary fire service to Boeing at the CSTC facility. This agreement is necessary for two reasons. First, Seattle used to provide some water service to Longacres Park, and Renton would like to provide domestic and primary fireflow water service to the CSTC facility, since it is in our service area. Second, Boeing's fire underwriters have required the CSTC facility to have a secondary source of fireflow water in the event that Renton's supply went down. Therefore, the City of Seattle would provide secondary fire flow water service to the CSTC facility. The attached agreement will provide a means to satisfy both concerns. Utilities staff discussed with Larry Warren whether this agreement needed Council authorization and a Resolution, and the opinion we have reached is that it is really nothing more than an elaborate water meter application, and can be signed by the Mayor. In regard to the two comments in Larry's attached approval letter, the staff response is that the facility is in Renton's service area, and there will be no transfer of pipes, pumps, or other service equipment; rather, Renton (actually Boeing) will construct the , , . The City of Renton wants to serve water to the Boeing Longacres facility. However, ' Renton would like to have Seattle provide secondary fire service to the area. RECOMMENDATION: � The Water Utility recommends that the Agreement for Transfer of Water Service and Provision of Secondary Fire Service be approved and signed. BACKGROUND SUMMARY: The Boeing Longacres site is within the water service boundary for the City of Renton. Previously, the Seattle Water Department served water to this area. With the new Boeing development, Renton would like to assume water service to this facility. However, Renton would like an intertie with the Seattle Water Department to provide secondary fire service to this facility as an emergency precaution. J � Under the terms of the agreement, Renton will assume water service to this area as of May 1, 1994. Renton is responsible for constructing the intertie. We have arranged with Boeing to do this work and they are ready to start as soon as the agreement has been executed. The Seattle W.ater Department will operate and maintain the intertie once it is constructed. CONCLUSION: Renton is ready and able to serve water to the Boeing Longacres site and it is within our service area. This agreement allows Renton to serve this area while maintaining emergency fire flow via the Seattle system. This agreement is of benefit to the City of Renton.
